I'm writing in regaurds to my brother that is sitting in jail at this time that has (4) assault /family violence charges against him. Knowing his girlfriend and his relationship well she has cried wolf each time. My brother is facing 2 10 year stacked time and a 7 year sentence. He has no other criminal record . The DA and prosecutor have already considered him guilty. He has been in jail for 5 months now his first trial is set for sept 26 2011. the girl gave the police guns claiming he was going to shot her with them and one gun was an antique gun and the other was in the trunk of his car. Never was there a gun used in any one case. She started yelling help me at a Walmart parking lot and a passerby called 911. How can our Justus system be considered equal when some one can make false allegations against someone and the law assume that they are guilty automatically. Our laws are unfair. -

My wife has been arrested twice for domestic violence .she is on felony probation.She called the police and made false acusations that i asaulted her . Both time the police arrested her.She is very angry about this and has retaliated by filing yet another false claim of abuse through family court.Now i find miself being victimised not just by her but also by the court system.I dont know where to turn for protection against her .REPORT COMMENTS

These false allegations come up on cori checks for Jobs, Rental applications and will always be in the DV registry..I too am THE VICTIM of false allegations...I cannot see my daughter, i have trouble finding employment and its caused me severe depression...Hello does anyone care this could happen to you, or anyone in your family...It can ruin your Life! Leaders we must think of more constructive ways to handle this...ex parte hearings are NOT FAIR! without the accussed present! 2 minute Hearings ARE NOT FAIR! Evidentiary Hearings are fair! This is a public disgrace! Our Civil rights are being violated. My boyfriends ex filed a false restraining order on me to keep us from taking there mutual child on vacation..I have spent countless days, weeks and months fighting these false allegations. Judges have your hearts turned to stone? The writing was on the wall with her ulterior motives for doing this but Im being told its happening because of politics...No wonder the American people have lost faith in politicians....please give fair hearings and charge the petioners with perjury..I have witnesses and voice mail recordings to prove my innocence but have never been given a fair hearing to prove my innocence....this has become a Salem witch Hunt against Men and women alike...we must impose penalties for proven perjurs..so they might think twice before ruining someones charachter, wasting time of courts and police and causing so much pain and lost wages to those they accuse...REPORT COMMENTS

Justice is not served in this state even when the domestic violence charges are valid. Please read letter my mother wrote to the court after she heard they dropped the case against my abusive boyfriend. Case # 11-155107?Domestic Violence Case # 2011CV790?Civil Case Dear Sir: I am writing in regard to an incident that occurred in your town this spring. My daughter was assaulted by her boyfriend with him throwing a shoe barely missing her head, then hitting her on top of the head with his fist, and then kicking her in the upper part of the thigh. After he speeded away with his rental car leaving my son and daughter on the curb, a police was summoned and my daughter filed charges and a restraining order was put in place. I later learned that the case was dropped due to lack of evidence because of no witnesses and/or because it might have been business related. I fail to see that these issues have any bearing on the case. In the state of North Carolina, alleged domestic assault is taken very seriously. These incidents, with the man losing his temper and assaulting my daughter, happened intermittently on various occasions in L.A. for several months with the police being called in. (During one occasion while they leaving China, he stole her passport, boarded the plane, and only through the airport transport system was my daughter able to retrieve it from him to board the plane. She kept this information from us until lately.) My daughter finally had enough courage with her brother there to press charges against him for assaulting her. Your court system dismissed it without considering what she went through. I have difficulty believing that the state of Colorado or the town of Denver would allow someone to assault another person without pressing charges. (She had pictures to prove it.) The reason that law enforcement agencies are in place are to protect the innocent and I feel that you have failed my daughter when she asked for help and I know that she feels threatened by this man. If any harm comes to my daughter from this abuser, I am holding the state of Colorado entirely responsible. I implore you to reopen this case and let the court decide if this man is guilty or not. This needs to be handles and looked into. False allegations are up since 1980 it was 5% Now it is 30%. Please do your homework and look at all the research adn reports that are so readily available. When involving a divorce tha accusations are False 80%-85% of the time. Resrearch shows that 70%-75% of people in jail are innocent. Why is this the the only thing that when it comes to our legal system you are guilty until proven innnocent. Look into this. Please. This is ripping families appart. My son has been accused of child molestation and has been been in jail since July 1.2010.He is being held on probable cause.There is no evidence or proof.And the detective sat on the witness stand and said she assumes he is guilty,but they have no proof or evidence,and they are still investigating.The only thing they have is here say from a ex wife who was mad cause he would not sign papers allowing her to relocate the children to another state.Then there is the step dad,who outside of court tells his wife's attorney that my grand daughter will stick to the story or be placed in an institution.So now my grand daughter has learned by telling story's she can get her way..The court placed her in her boyfriends home,this boyfriend and her have been having sex since she was 12.She ran away with her boyfriend and when found she refused to live with her mother...Why is the court system allowed to be so corrupt,and allow innocent men and women be charged with these false allegations???How many men and women are in prison that are really innocent???REPORT COMMENTS

I am a victim of a false PFA. I have spent thousands of dollars constantly defending myself even though I have proof and witnesses. My life is constantly at the mercy of a judge who is biased toward the accuser. There should be evidence that the PFA was truly violated and not just take the word of the accuser who is using the system to his or her advantage. If the defendant continuously proves that they are innocent and that the accuser is lying under oath, then there should be repercussions and the PFA should be removed. I can not move on with my life because of a mistake made by dating someone who turned out to be a malicious thief, and the justice system refuses to help me even though I have had no prior record while she does. I have been accused multiple times within one year of calling my previous girlfriend by a pay phone. There have been times when she did not even show up for the hearing. I am an educated person and it is ridiculous for one to believe that I would actually keep using a pay phone to call my ex-girlfriend and want to keep paying my attorney?s as well as keep taking my chances in court with a judge who knows my ex and her family. I am told that she can continue to file false charges and that I have no rights. How can this be allowed?REPORT COMMENTS
