I don't believe that your child support should be calculated from your gross income. I feel that it should be done by net income instead so that you are not paying an unfair amount of money based on your gross income. This would allow that non-custodial parent with a more legitimate amount to pay and would help by leaving them something to live on as well. If you as the non-custodial parent don not have enough money to live on yourself how can the courts expect you to support your children as well. I believe that 35-40 % of your net income is to high for the non-custodial parent to have to pay.REPORT COMMENTS

I find it hard to believe that I am told the NY State child support laws date back to the early 80's, and haven't changed much since. I walked into this somewhat ignorent on the subject. But after educating myself with all the information I was able to find about the support laws, the only stipulation on how much money the judge can frankly "demand" you to pay, is regulated in NY State to being no more than 40 some odd percent of your check. And come to find out its base on a PRE-TAX number. So not only do I have to pay tax on this money every week, and the mother takes it as non-taxable income, I also pay 68% of all child care expenses. As well as the pro-rata share of the parent is soley base on income amount, and not the fact that we each have equal time with the child, which would me the overall expenses of housing, clothing, feeding and whatnot would be even. It is amazing that with the amount of honest hard working fathers in this state that share this same story, haven't spoken up enough to convince someone in a legislative position to take action!REPORT COMMENTS

This whole thing is a joke.Now my drivers license is taken away from me,my passport is taken,and now i am in debt up to my neck.I am never done anything wrong except uphold the law but yet i am being treated like a criminal in the system.I really believe that someone now needs to take a second look at how this crap is being administered. The whole thing makes no sense and is damaging men all across this country,while the women has it so easy by just bringing our names the the support enforcement then starts feeling the heavy hands of the system.I had never taken out a loan yet i am in major debt which i am also garnished for everything that is due to me.i am not or had ever been a careless driver but yet my drivers license is suspended.I am not a drug dealer,a terrorist,nor have ever been suspected of doing anything against the law or the constitution yet they took my passport/my traveling privileges all because somebody lies and say that you are not taking care of your child . Assuming that were true,what does the government have to do with that seeing that this is between me and the mother of my kids. Further more they are even tapping into my paycheck and leaving me with almost nothing . I am wondering if one of the reasons why government won't look at this is because they are afraid of hurting the " female " vote - This needs to be addressed now so that justice can be felt across the board .Honestly i am really hurting because of this and it seems like i have nobody to turn to for help as i suffer the consequences of being a helpless victimREPORT COMMENTS

DHS/ child support should be better headless for us fathers. My son is now 8 and no where in-between the time he was born ad now did she want or need child support because I am around him and help where I can. But now she is married and has a new born by another man and all of a sudden she needs child support and now they wanna hit me for back child support and I can't pay the amount being asked. So now me and my family as well as kids will suffer do to her and the system. I'm 53,000 behind and I have had trouble finding work for a long time. I got so far behind because I used to have a large salary and the court in NY refuses to lower my $2000 monthly sum, I can't even afford to live, I've lived with my parents and friends and have no life. I love my child and refuse to be deterred by an agreement I signed to get out of my horrid marriage. I never though losing my job and struggling to find work in the OBAMA economy would be so hard...now I'm swimming in debt, and nothing I own is mine...all I want is a fair payment plan...especially when my ex makes 150k a year and demands more from me...REPORT COMMENTS

I have been supporting my daughter financially for 17 years now, my daughter just turned 18, AND she just had twins in September, her and her mother decided for her to have the children, I was basically told that she is keeping the child no matter what. Now, here it is, I have to pay CHILD SUPPORT to an 18 year old MOTHER of two. I'm actually writing a paper about this same exact thing for my writing class in college. I personally do not have children but have aided in the financial support of many children and i do understand those little people can be expensive. But, i DO NOT agree with all these women/girls laying up having all these babies, stay keeping their kids away from their father but still be able to receive the money that he works hard for. And then if they get locked up for non-payment then how do you expect them to pay it then? Some of the mother's don't even use the money for the child. They use the money to keep themselves looking "fly" and to pay their admission into the clubs (while their mother babysits) and their kids are running around looking like Rageddy Ann & Andy's little cousins. But, for the one who i guess do have "dead-beat baby daddies", you probably knew that before you opened your legs to him. NOW YOU WANNA BE REWARDED FOR YOUR DUMB*****MISTAKE?! My boys NEVER had the privelage to use the insurance that I provided for them the entire time there momma was on welfare THEY USED THE WELFARE INSURANCE why ? They had blue cross blue shield from Halliburton So even though I insured them n the welfare did have the insurance info why not use it. We all know if you go to a doctor with welfare card they treat you like trash but if you use an Insurance card that says Halliburton on it or any other company name they treat you very good becuase it's paid insurance. The WELFARE IS NOT FOR THE BEST INTEREST FOR THE CHILD. For biological reasons, men and women are inherently unequal when it comes to their roles in becoming parents. To be exact, women become pregnant and give birth and men don?t, and those differences are likely to remain into the foreseeable future. If a child isn?t wanted by both sexual partners, you?d think that?with the advent of reliable and easily available birth control?unwanted or unplanned pregnancies would happen very rarely. Well, we all know how that?s turned out. Once an unplanned pregnancy occurs, a mother-to-be and father to-be have some decisions to make, about which they might agree or disagree with each other. If unmarried, they can decide to get married if they want, and to have the baby and raise it together, if both want that as well. If neither wants the baby born, and both are in favor of abortion, the woman can decide to abort it and the man would be likely to approve. It neither believes in abortion and in addition neither wants the baby, the woman can give birth and give it up for adoption, and both would agree that?s a good solution. And if both want the baby born and both want to raise it, but they don?t want to get married, they could agree on custody and visitation arrangements, or alternatively there can be a custody hearing that would be somewhat similar to what would occur if they had been married and were now divorcing. But what about other disagreements? For example, what if the mother wants to have an abortion and the father doesn?t want that? What if she wants to give the baby up for adoption and he wants to raise it himself? And what if he doesn?t want her to keep the baby because he doesn?t want to be forced to pay child support? The law addresses these fact situations and cases differently. The first legal principle is that the mother makes decisions about her body. Let?s say the mother wants an abortion and the father wants to stop her, or the father wants her to have an abortion and she wants to have the baby. Legally he has no say in the matter. Although it?s his baby as well, the baby is developing within her body, and he cannot compel her to have or not to have an abortion against her will. That?s a sad fact of life (and death) for fathers, but there?s no way around it legally because the consequences of a different ruling?that he could force her to carry the baby and have it against her will, or force her to have an abortion against her will?would be terrible. Of course, you might say that with abortion all of it is terrible anyway. But adoption is different. No, a father can?t compel a pregnant woman to keep the child and raise it after its birth. But if she does decide to bear the child and wants to give it up for adoption, although the law is complex and varies from state-to-state in terms of what he must do to preserve his right to raise the child, much of the time he can do so?providing, of course, he knows there is a child in the first place, and is willing to accept responsiblitREPORT COMMENTS

I'm in the military, and I had custody of my daughter, for seven years. She lived with me, and hardly ever saw her mom. I had to deploy one summer, so I let her stay with her mom in Jacksonville NC. Her mom made up so much crap and tried to make me look very bad to the courts. They took my daughter away from me and gave her custody, I couldn't make the court dates in NC, so I had a very bad lawyer, who basically screwed by case up. I had to pay $633 dollars in child support, plus they said I owe 19 thousand dollars in back child support, although my daughter lived with me all her life. Now thanks to the courts, my daughter has been abused, in and out of foster homes, arrested, and kicked out on the streets by her mom. Someone need to tell these people that it takes more than money to raise a child. I have not seen my daughter in years. Thanks Jacksonville NC and Jacksonville Florida, My daughters life is ruined. I need serious help, but the child support system won't even talk to me. This system is so messed up. The state is also getting a small percentage of the money that suppose to go to my daughter.REPORT COMMENTS

The system needs to be changed, there are too many ways that the custiodal parent can use the order to make good dads appear like dead bets. Father's in GA have no rights at all unless they pay for it. They helped make the child why are their rights not granted like the mother? Losing your job while on child support is your death sentence. The Fatherhood program is a joke, the host didn't even show up the last two times we went to the meetings. They take DL's away, how are dad's suppose to go look for jobs, go to the fatherhood program, and spend time with their kids if they can't drive? I believe that the system is more damaging over all than helpful. The amount of child support they tell my Fiance he has to pay is ridiculous and it was based on a TEMP JOB he had. You can't modify for three years, and losing your job or being underemployed is not enough of a reason to reduct your support order but they will throw you in jail even though you have shown you cannot make the payments. We have mailed letter after letter stating our case and yet they continue to tell us, that we are in volation of the order and must comply. They told us if they wanted us to pay say 1500 on the arrears he would sit in jail for three months. The state dosen't give the mother any of that money though and he is still responsible for current support even though he is locked up. So the 1500 he is sitting in jail for is washed out by the 1500 that went to the arrears why he was sitting in jail . I have seen many mothers abuse the child suporrt system , not all women, but the women who have children for the sole purpose of using them as a paycheck and a weapon.REPORT COMMENTS
