    I request congress to check the past and current EB1C cases. Companies like Cognizent and others used the international manager loophole and filed offshore coordinators under EB1c. After they get EB1c they just release this resource from the project and have a new resource. Why do offshore companies need so many international managers. They just need offshore coordinators as this is project by project basis and the projects are not permanent. Also there is no proof that the person who filed as international manager is a legitimate and these companies can provide fake mamager prosition if the resource works for more then 1 years in India in that company. There a many instances where those who got EB1c has no ability to talk in English with the client and doesnt have higher degree and the pay is much less than the sr resource at the client place.

    This abuse has to be stopped. TATA Consultancy services is one of the biggest abuser of EB1. They bring people in managerial roles with fake hierarchies and file for GC in EB1. They also started doing it since L1 visas given to Indians were reduced significantly in 2013. All L1A visa holders had their GCs filed then through fraud hierarchy and a peanut salary of 75k - 85k.

    This has a real potential for abuse and Indian companies like TCS are using it for their own benefits. I have seen cases where the individual holding EB1C green card are basically in a people managing role which can be easily performed by an American since that doesn't involve any technical skill. Further, I like to request USCIS to investigate each and every one of approved EB1C cases for potential abuse. Most of them are obtained using fraudulent documents.

    Please Do Not Stop EB1C. Make more stringent rules and requirements for EB1C filing which stood stop Misuse of EB1C if people think it is misused. Stopping EB1C is going effect the genuine cases. Also, USCIS employees who are processing these cases are intelligent and equipped to find the fraud cases.

    As I heard from one of my friend : An Indian Company brought the candidates to USA on L1A Visa (Since there H1B got rejected) even though they work as Developers or Testers. Now because of potential restrictions on H1B visas they filed EB1 for those candidates. Most of them got the Green Cards. This is unfair

    The EB1C abuse by Indian consulting companies must be stopped. It must be applicable to high raking executives such as - CTO, CEO, COO, CFO of multinational non-consulting companies. Each I-485 application taking EB1C route must be interviewed in-person to see if they have qualification. TCS, Infosys, and CTS, HCL, Wipro are the biggest abusers of this EB1 category.

    Cognizant & TCS are leading perpetrators of this immigration fraud... They just create a ad-hoc team structure and prepare necessary paperwork and apply for the EB1-C petition... once the petition is approved then the cycle starts now... I currently know 2 people in the process of applying from Chicago, they work for CTS... Pls stop this abuse

    This should be stopped as most of the applications from CTS/TCS/Infosys are fraud and the organization charts are fake. A thorough investigation should be performed to find out and punish these consulting firms which are breaking law and driving the wages down and taking lot of jobs offshore.

Moreover, the abuse of EB-1C is hurting other categories so much that it is just unbelievable and there is no solution in sight. This is a trickling effect, if H1B does not work try L1.     EB1C abuse should not be tolerated because it is severely affecting genuine EB1A and EB1B petitioners, as evidenced by yesterday's (and last year's) EB1 retrogression for India. Either the review of EB1C should be made as rigorous as EB1A and EB1B to minimize fraud or even better EB1C should be downgraded to a lower preference category so that only that category would retrogress if it is abused.

    Dear Sir, It seems EB1C category is being misused by Indian software companies. 2014 there was 1000 EB1 ( EB1A, EB1B, EB1C) applications filed in total. In 2017, it is >29000 total applications. it is 30 fold increase in 2 years. This is severely impacting the EB2 category, who have been working here for more than 10 years. Appreciate your help.

    Tcs l1a applications from Chennai displace American workers at a large scale. Please check to see why the l1 executives are needed when so many managers in it industry are job less. The reason is Chennai l1a folks get paid 60,000$ while the American it managers get paid 95,000$. Check this with any body working at Tcs you will get the truth.

    Cognizant is the biggest abuser of this category. There are scores of people in the DFW area that are proud to abuse this loop hole and have green cards within months. However, people like us who have a US degree and are following the rules, are not given priority in anyway. This broken immigration system, combined with such abuse is only bringing in less skilled workers to US.

    There is no benefit to getting a Master's degree in the US anymore. EB2 and EB1 categories have become a cesspool of blatant fraud by Indian outsourcing companies. Before targeting the H1-B visa, Congress needs to take action on the L1-B abuse and conversion to EB-1C Green card category. A 10 year wait for a green card after getting a Master's degree in the US is ridiculous.
