Dear Sir, It seems EB1C category is being misused by Indian software companies. 2014 there was 1000 EB1 ( EB1A, EB1B, EB1C) applications filed in total. In 2017, it is >29000 total applications. it is 30 fold increase in 2 years. This is severely impacting the EB2 category, who have been working here for more than 10 years. This has a real potential for abuse and Indian companies like TCS are using it for their own benefits. I have seen cases where the individual holding EB1C green card are basically in a people managing role which can be easily performed by an American since that doesn't involve any technical skill. Further, I like to request USCIS to investigate each and every one of approved EB1C cases for potential abuse. I totally agree with this petition. EB1C creates avenues for fraudulent applications which is causing grievance for people in other categories who have been waiting in line for several years in EB2 and EB3. Even among EB1 people with extraordinary abilities take a lot of work and effort to do research to qualify. However, the international manager category, is a great avenue for less qualified and less talented people to enter into this great country and obtain permanent residency. I request the government under the current administration to take immediate action and put and end to this category or impose very strict measures to allow such petitions to go through.REPORT COMMENTS

This is not fair as company's are abusing this loophole and filing GC for any Tom, Dick & Harry who can show that they have worked abroad for 1 year in some managerial position. Indian IT company. Mainly Cognizant Technology Solutions has been abusing the EB1C Green Card category for many years now. Only requirement for EB1C is that the employee must be a manager for 1 year out of the country. EB1C status does not need to file Perm Labor application with DOL as well as there is no wage requirement nor high education qualifications needed. The employee and their whole family get EAD cards as soon as they arrive in the US and file their I-140 and I-485 concurrently. This is having an adverse effect on EB2/EB3 categories especially for people born in India as there is no spillover happening from EB1 India. The company acknowledges the same and had recently gave out a statement that they will no longer use EB2/EB3 categories for their employess but just plain EB1C as long as the loophole is open. It is unfair for Indian born people who applied more than a decade ago in EB2/Eb3 categories and waiting patiently in the line and contributing to the country for more than a decade just to see some person who is just a manager offshore in India come into the USA and get a Green Card in EB1c category in less then 1 year without any significant contribution to the great country.REPORT COMMENTS

Cognizant and other offshore companies are using EB1C loophole and doing mass filings. Why do a offshore team need so many managers. Leading 4 member team in India doesn't make international executive/manager. In India anything can be shown as USCIS cannot visit the location and see. The people who applied in EB1C are not genuine international managers (90% are fake managers created by these companies). There should be a change with having minimum pay requirement and higher university degree for EB1C as they are high paying and real talent people who should be in the criteria Not the fake managers created by Cognizant and other companies. I feel it will impact the economy in long run giving GC's to all these fake managers created by offshore companies.REPORT COMMENTS
