    Firstly, I think all the Indian citizens need to stop backing these type of claims due to them not being able to get a GC. For a non-Indian trying to get a GC, been in the US for 5 years on a L1-A and am a fully fledged exec that does look after a whole part of a business, I am sick of every forum I check being full of the same people complaining. Get a better role and enhance yourself. How you can say that I am abusing EB1-C is crazy. This is why you have your own category. Abuse in every category. Wise up. Stop looking for the golden egg

    Being an indian and a H1B employee of a big american IT service company, I have witnessed first hand how EB1C green card is being abused. An employee whose designation is manager or above(there are thousands) is brought to US on either an L1/H1B visa and after spending 6 months in onsite a EB1C GC application is submitted and within an year he/she is GC holder. All this while these so called manager does mundane jobs like micro managing resources, testing, coding etc just like any other employee. To worsen the matter a new kind of abuse is happening where a person whose EB2/EB3 is in process is promoted to manager and sent to canada for a year so that they get 1 year international manager experience(BS) and brought back on a L visa and within GC application is upgraded to EB1C

    Eb1 c says Executives or Managers. Perhaps when this law was made, being a manager was a rarity. However, now with so many people in the tech industry, being a manager is easy. Moreover, several Indian companies like Infosys, TCS, Wipro and also some companies like 'Google/McKinsey' have made their employees managers and then transfer them to US. This is a systematic fraud/abuse of the system. The category needs to restrict itself to 'Executives' and for people with years of international experience.

    Request you to please stop EB1C fraud by Indian Consulting Companies. They apply for international manager with fake experience under EB1C . Once the employee gets GC he/she leaves the company and joins another company with the same fake experience as these companies pay less salary. What is the use of filing so many EB1C if the employee is not staying in the company. They are just using the loophole. Also requesting to revisit previous EB1C filings from past 5-7 years and see how many they applied under EB1C and how many are still in the same company.

    Please STOP EB1C abuse by Indian companies like TCS, COGNIZANT, INFOSYS, WIPRO, TECH MAHINDRA etc, they are not even fit to be managers and misusing the category there are several of them who are in BPO industry and git GC’s in no time under EB1 C category stealing all our jobs and also after 2011 onwards there are so many Indians who are not legit and made through H1B with fake experiences and total mismatch with academic qualifications.

If you request/give permission for someone to stay in a country for some-time, its best if you gave them the rights after a reasonable time limit. Otherwise people are going to leave. Never mind if they are EB1/EB2/EB3. History will tell how US curbed the rights of immigrants, by putting them in queues based on race and arbitrary criteria.

H1B being well addressed, but we would like to make bring your attention of EB 1 permanent residency visas abuse especially “EB1 C” which is more dangerous to all American workers (not just IT/STEM) than H1B abuse. EB1 (extra ordinary) category awards 40,000 permanent residency visas annually in which majority used up by EB1 C. With the recent measures taken to curtail fraud in programs like H1B, the perpetrators have increasingly turned to this EB1C category. But unfortunately no body is noticing it. When EB1 law was written, there was no information technology offshore-onsite model and no internet etc. Law makers created EB1 (i.e. a persons with extraordinary ability with international recognition for example like an Oscar award, Olympic Medal or Nobel Prize etc.). The law makers intention was to give EB1 C visa to give top notch organization heads/executives/managers with international recognition (traveling weekly internationally) on par with EB1 A and EB1 B (Nobel Prize/Olympic medal/Oscar ward winners) with extraordinary ability. We request you to please understand EB 1C abuse more dangerous than H1B abuse as EB1 C gives permanent residency. That means an EB1 C GC person can replace any American Worker permanently and his spouse & children can work/replace any American worker not just the specialty like IT/STEMP. The EB1 C applicant once received GC, he and his family can replace any hard working American like in Walmart or any job. EB1 C visa is permanent need not be renewed. Whereas H1 B is temporary, For example, we would like to bring your attention the EB-1 C category abuse especially on those granted or applied for Indian nationals. Please note that the numbers of EB1 C green cards that are granted for last 7 years to Indian Nationals on Managerial or executive category are of around 80,000 as per USICS Statistics. It is simple common sense, even in India; there will not be requirement of 80,000 international Managers or executives in Information Technology. It makes suspicion that whether these 80,000 are really international managers/executives/department heads. Once EB1 C is granted, it seems they are working at client places just like regular consultants/architects/Junior-Mangers. Kindly please note that the above is just example on EB1 C Indian nationals, but it is epidemic in worldwide category EB1. Respectfully, we would like to again bring your attention that yearly 40,000 EB1 permanent visas being awarded on extraordinary capability and majority being EB1 C.

    This is a malicious campaign by people who are not qualified enough and or do not have enough managerial experience and are hurt by the fact that some others are simply better than them. They fail to see through the fact that people have to go to great lengths to PROVE that their qualifications AND manegerial work experience. It’s like I did not have the opportunity to study hard and work hard to get ahead in life so why does the other person deserve to get ahead? Even if the guy with L1 A who filed GC under the EB1C category is going to extreme lengths to provide all documentation that USCIS asks for and has paid all their dues in the last 7+ years. I hope karma gets the malicious few behind this campaign. Remember this...the windmills of God grind slowly but they grind exceedingly fine!

    Project Managers, Release Managers, Account Managers are getting green-cards faster with EB1 filing while the true hardworking talent such as architects, engineers have been waiting long years having filed thru EB3, EB2 categories.     you cannot believe all you need is Manager title. program managers(Personal assistants who takes meeting notes), delivery managers etc get green card. Most of these guys from Junk MBA degree from 4th grade colleges. For EB1C there is no PERM process, hence ppl taking advantage of this loophole

    I don’t live in US but have close friends who have got their GCs in all 3 categories. I also have friends who have migrated and settled in countries all over the world from India. Another way to look at this is that EB1C category works as expected and it’s EB2 & 3 that need to be reformed and brought at par with it in terms of the time it takes to get a GC. In many developed countries like Australia, Canada and those in Western Europe, you can get residency within a couple of years of working there. In many cases, you get it even before you step foot in the country, based in your back experience and qualifications. I totally understand the frustration of those waiting for EB2/3 approvals. However, a more constructive way forward would be to speed those applications up instead of slowing EB1C or even abolishing it as some people are suggesting. People just seem to accept that EB2/3 categories will take 5-15 years. Why not ask Congress to reform that and put a cap of max 3 years to process all sorts of GCs like most of the other developed countries do?

    While the whole country is focused on H1B visa violation, no one talks about the silent killer - the L1A visa which is misused by many companies to ramp up foreign employment giving foreign workers access to US greencards in less under 1 yr! These companies do NOT look for talent in America - they hire abroad and transfer their employees to the US under L1A visas and speedily access a US greencard. Violators include such companies as Cognizant, ZS Associates, TCS and Infosys.

    As a PhD student in STEM field from a top notch US university, it makes me feel really angry to see such a blatant abuse of EB 1C by many IT firms. Why should US give green card to some manager(again this criterion is highly misusable). EB1-C should be scrapped i do not comment on any forum online. But this blatant abuse by many companies especially from India needs a through check.

    EB1-C is a blatantly abused. International managers category pale in comparison to EB1-A abd EB1-B categories w.r.to eligibility. They are neither more competent than EB2 or EB3 nor get more salary than EB2 and EB3.     I have a Master Degree from top university, I have a Bachelor Degree in Engineering , I am certified Management professional, I earn $185K/year, managed teams in 3 different countries from US office. I am not eligible for EB-1, i have been waiting for my Green card on EB-2 category from 8 years. My Friend is not an engineer, studied from a community college MBA, worked as a Delivery Manager/Program Manager in Foreign Country, no team under him, he came to USA on L1-A , earning $90k/year, filed Green Card under EB1 and got in less than 1 year. Is it fair???? why don't you check their salary? education qualification? Why international manager is so special compared to US managers? Not fair.. International Manager doesn't belong under EB1. It should allow only Executives VP and above. Also, company should have minimum 100 employees. Please fix this fraud loophole and investigate all the Green cards issues under EB-1C category.

    Dear President, I am an employee on H1b and I have graduated from one of the top 10 universities in US with Masters degree. While I wait for 8 to 10 years for GC on Eb2 it is unfair for people with lesser qualifications to get GC with EB1 by just having a manager experience outside the country. Kindly take a look at this issue and make sure the checks are in place to give GC to right candidates based on merit.
