You can read between the lines HOA's are ex*****ve, controlling monopolies that just may not have the homeowners best interest in mind. They are fueled by self serving attornys. I am in a HOA that has board members that have served on the board for 20 years are more. When homeowners inquire about this, they are told to mind their own business, or threatened. How did the American people let this kind of control and power take over?

A year and a half ago, I moved into a new home in Olympia WA in order to be closer to my family. The home is in a community governed by an HOA. While I had no problem adhering to the CC&Rs, it soon became obvious that one of the board members seemed to be trying to use them to enforce his personal preferences. Also, it seemed that certain people were targeted, while others received a pass, giving rise to suspicions of bias. It became very uncomfortable knowing that this person was constantly scrutinizing everything that I did on my property. In less than a year, I was written up for a very petty violation which, fortunately, was overturned. In any case, I am considering moving, despite not being in the best of health. The stress is just not worth it. HOAs are great in theory, but too often lead to abuses.

I could go on and on of why I disagree with the authority that HOA?s have. I have found my HOA to be abusive, harassing, and a dictatorship. They have gone beyond the authority that the contract gives them. The only way to fight it is through the courts costing myself, my neighbors, and fellow homeowners money. Pink flamingoes should be no reason for 20K law suits. Our government, state and federal, has allowed this to go on far too long, benefitting only the lawyers, the government, and the developers.

We need legislation now to stop hoa s telling us what we can do with our home when they r not paying the mortgage they have created monsters in all communities because the same people stay on the board and want to dictate what you do to your property instead of work with you the only duties hoa should have is maintenance of green belts and walls and landscaping otherwise they become too gestopo and treat adults like children with colors used to paint and it seems they play favorites and do not want to negotiate I recently applied for free mediation to resolve my issue and they refused to mediate and tacked on lawyer fees to my assessment the mediation is given free to city nhomeowners and no lawyers r allowed to osrticipate so we know they r hiding from being exposed about how they r treating us we need to stop them immedtsty till we have better understanding and more rights when it comes to repairs colors on property we r paying for not the hoa time is now out hoa s on immediate hold they've getting too out of control and do not own our home stop hoa dictators and make them accountable and give homeowners option to sue them individually if they continue to target and harass

I was only told that an HOA exists, and what the fee is, when I bought my house. If I had been giving a rule book before finalizing my purchase, I would not have bought this house. Example: I'm required to mow public land that is not my property.

I found that our HOA dispute was more of a personal matter, where the mini dictators did not like us because we were the newest members of the association and the house we bought had so many repairs and updates to be done that the changes were too quick for their taste. The board became fueled by jealousy and desire to slow our progress down. Every day we had one or more of the board members standing outside of home evaluating and trying to intimidate us, which quickly became harassing in nature. Every update we did was questioned, objected to, and halted in some way. This was a deteriorating house and neighborhood, which needed the maintenance and updating to be considered a livable home. We were accused of bringing down everyones property values, which was clearly absurd. A lawsuit insued over the color of our home being too dark to be approved, even though it was harmonious with the hues around it. And when we had the tone evaluated along w the colors they "recommended," ours was evaluted as the lightest out of all samples provided, which were evaluated as "deep" in hue. At every meeting, we were steam rolled, yelled at, and pushed along a process that was never meant to find an amicable solution. They were just crossing their "T"s and dotting their "I"s preparing for court. A two and a half year process of daily stress and duress. Constant threatening emails delivered to our home, that amped up every holiday as a way to harm our happiness and livelihoods. It was a hopeless and helpless feeling to be at the "mercy" of the little dictator's power displays. Anyone who spoke up for us became harassed and threatened w fines of their own. The board members picked and chose who the members would be without votes from the neighborhood, and they fabricated every document with false info to add to the neighborhoods record of us. They tried to coverup any and every wrong doing acted upon us. I found our board full of jealous, spiteful, status hungry, bored and malicious tyrants, hidden behind a superficially "cute" 36 home, with no common areas, neighborhood...just waiting for the right people to move in to reign hell upon. I would NEVER recommend ANYONE to unknowingly sign your constitutional rights away.

May 21, 2016 Dear President Obama: Dear Representative Posey: Dear Senator Nelson: Dear Senator Rubio: HOA's have long been taking advantage of the American people and their dream to own a home and make it their own to raise their families. HOA's have become dictators overstepping their authority. In these times where home sales are plummeting, homeowners are trying to do things to increase interest in their homes and an HOA is a turn off to new homebuyers. City ordinances are already set in place to ensure residences do not become health or safety hazards. People that buy expensive homes want to be able to make their home for their own style, comfort and security. HOA's are most often controlled by a few that enjoy their status as dictators and want to control and approve everything about homes they do not own. Home ownership is loosing it's true meaning and is no longer a place of refuge. I am an Air Force Veteran that was so exited to finally return home after my retirement. With so much excitement I began to try and refurbish a 1994 deteriorating home to finally have my forever home. The hell I went through that deeply effected my health and mental state and hurt me financially no American and myself a Disabled Veteran should be forced to endure. There is no legitimate legal course to turn to for help from bullies of HOA's. Something has to be done. It is becoming a new controlled landscape in America that will be it's demise. As all these neighborhood's continue to age the problems will get worse. Property owners have lost all their rights. Please see: https://recharterhoas.wordpress.com/page/2/

2008--they attempted to take one of me parking spaces (on my deed). I Ended up sueing--$10,000 later it's still my parking space . During the lawsuit my air-conditioner was vandalized 3 times. Nails in my tires and verbal harassment--in front of my daughter. Currently, now having to pay special assessment--$1500 and our monthly dues increased from $317 to $338. My daughter went to live with her father--hates our home. Most owners rent out--and don't go to board meetings cause no one has a say. The board votes each other in and out--its a complete dictatorship--and I've lost my family. I'm a school teacher--and my work is close. I don't want to rent and real estate prices are too high. I am stuck living in hell. I cry every day.

The purpose of an HOA is to create better communities however the actual result is that it motivates neighbors to wage war against one another in secrecy. Communities no longer talk with each other to resolve problems but instead complains to an HOA body in secrecy when they have an issue with another neighbor. No more are the days where neighbors talk to each other because HOA's create a sense of distrust among neighbors. HOA's are also given too much power where laws set in an HOA superceded what is law in a city, county, state or federal governing body.

I live in community with an HOA. The Hoa is nothing but a bunch of bullies. They try to control every aspect of your life just because they can. They raise fees any tine they get the notion to do so.

HIA's are a communist concept. If you own your property and home, then you have private property rights that no HOA should abridge. If you don't like what your neighbor is doing to their home, then either be an adult, talk to your neighbor, and try to persuade them to do something else, or move out of the neighborhood. This is America, for crying out loud, not communist China.
