Stop adding BAH into child support for our Military Members

    My husband is in this exact same situation. I do not feel it is for the children at all to include their housing allowance, each parent is required to provide a home for living and visitation suitable for the children and the fathers means to do so, in my case, should not be compromised. If that is the case, if the parent is the one to be receiving child support, that income should be included as well, or if they receive food stamps or subsidized housing, the value of that subsidy should be included. BAH and BAS in essence are subsidies given to soldiers by the government. Time to be fair.

    This is not only a problem that has happened to my Soldiers in the past but now a problem I am dealing with. The judge used my LES from Hawaii at the time for the alimony and child support calculations. I now reside in a different state with a considerable change of financial resources. After doing a ton of research I've have found that I'm not in a rare situation.

    IM glade to see this and I hope something finally get done about it. Id like to add my story starting back in 2012 when my agreed upon child support or of 450 a month for one child was found lacking in my home state since I was an E-4 in the military stationed in Hawaii which I was allowed by my unit Commander to stay living off post, so my state added in my BAH, BAS, And base pay for a new court ordered support of 1496 a month still only one child. which also left an owed balance of 6000ish, since was filed in July, but order came out in December. I hope that something can be done for those that are still on active duty and be treated with the resect the family courts should give to them, and to finally make it fair and equal for those parents that have made the sacrifice of duty to our Country in all aspects of Child Custody and Child Support.

    I just paid the State of Alaska a back child support of $20,000 lump sum which was all of my lifetime savings. I am military 16 1/2 years active duty and now being garnished another $960 a month on top of two other child support obligations. My tottal monthly garnishment equals $2,135 a month and my recent X wife is working to raise my support obligation from $875 to $1,750 a month because she knows BAH is higher here in the state of Alaska. I work two other part time jobs outside my Army job in order to stay finically afloat and now possibly getting QMP'd out of the Army for poor performs due to my constant 16 to 18 hr work days every day. I am working my self to death and have no choice. I am happly married and I Love my kids but I'll never have the chance to see them. I'll be dead before the fight is ever won. Theirs only so many hours a day a person can work so much and their is only so much a father can cope with mental and physically with non stop work and no break, no relief in site. In the end it's only all my children who suffer and the future of their generations to come.

    I am part of this statistics and their needs to be a change. To add BAH & BAS as part of my gross income for child support and alimony it is not only an unrealistic calculation but it puts a financial burden on any military member as well as the recipient who receives the support. BAH & BAS is not included in W2s and it is not included when you retire. It can hurt the recipient when a military member gets out or retires because they are no longer receiving BAH or BAS but regular basic pay. The recipient is dependent on that support and now it will either drop down dramatically or not get any if military members are not able to find a employment right away. This needs to change so no burdens will be put in neither the military member and the recipient. I am for support to my children and ex spouse but it needs to be fair. A different state guidelines needs to be implemented in military cases.
