Stop adding BAH into child support for our Military Members

    My husband and I are stationed with my 3 children whom are obviously now his stepchildren. Per some state laws he is not legally obligated to support step children... in our case, TEXAS. However per DOD regulation, a service member has a duty to support his dependents and can get in trouble with his job for not doing so... This is another gray area that needs to be addressed... State judges should not be allowed to enforce laws that put a service member's job at risk WHILE ALSO including OHA and station allowances to determine support. For TEXAS, 2 kids equals an automatic 25% of income. Taking out rent and utilities on my own, child support takes over 50% of the ACTUAL NET INCOME he sees after paying rent and utilities...leaving 3 kids overseas on a remote island that's CRAZY EXPENSIVE with literally, no money. It is WRONG....WRONG WRONG WRONG. I am happy to speak or partake at any board meetings I can regarding this matter and will fight beside you till we win....I have been studying the laws, state federal and military for over a year now to try and help families... whoever started this can email me if you'd like to add another ruthless fighter to your corner.

    Stop complaining and take care of your kids. Reading these comments make me cringe. Some of you get off scott free for months and even years without taking care of your children due to the soldier and sailors relief act. Deal with it. There are problems on both ends and it is being taken out on the children. Find a place to stay that you can afford. Et discounted meals in dining hall. Get a room mate. Get a partner that makes money as well. You would be surprised how quickly a so called broke service member will take care of another broke woman but complain about taking care of their own children. Slow down on getting into another relationship if you can't afford it. The kids will be there but it isn't promised that the new love interest will last. Nobody cares about the EXTRA things you WANT. Just like you honor the sworn statement to Uncle Sam honor the birth certificate and take care of your children. Don't worry if your ex is a bum it will catch up with them when they take the child support. No decent custodial parent is going to want to sit around and wait for child support which is very uncertain money. There are mothers and fathers out here that are not getting any or enough help with their children from an active duty service member who will quickly take care of whoever they are sleeping with and living with at the moment. I am a former service member I know. I have seen guys brag about the money they make verses what they pay in support. They make it hard for y'all. The guys that lie make it hard for y'all not your children. custodial parents myself included know what its like to have a service member fall off the face of the earth and stop helping with their children and you know what happens next... you have to file for support on them. Just take care of your kids and don't have anymore. How will you take care of a new one if you won't take care of the ones you already have?? Must be from that paycheck you complain about.

    Why would they not include the BAH when you are using your dependents to get it? Some are getting it because they are at the rank to receive BAH but having dependents adds more money. Also it is still income and should be counted as such. Thank goodness the powers that be understand this.

    Is frustrated when you ex- use the child support for buy car and other stuff. Always want more and more and. The soldier family start getting economic issues and worse case scenarios divorced or making wrong decisions because cant handled what ever situation is. Our soldier leave his/her family alone,risk their lifes to keep our country safe and stronger. Is time for our politics do SOMETHING for our armed forces.

    It doesn’t make sense, if bah and bas are not taxable and not considered income and always fluncuating then it should not be considered in child support payments. It is unethical and it causes service members to suffer and creates major financial hardships.

    I am a Sgt E5 and I have to pay 1540 in child support. My BAH is 1600. She won’t budge on a daycare that’s 1200 so I get screwed. She also lives rent free with her parents in a 400,000 dollar house. Absolutely ridiculous. I am struggling to even survive. Please help...

    I got orders to San Diego, my BAH has gone up, I live in Lincoln Military Housing, they take all of the BAH. My ex wife wants $500 more a month because my BAH went up, she lives in Nevada. My paychecks are only 1k. I'm married and have a son who lives with me here. There's no way we can live like this. I'm going to have to move into a 400 sq ft 1 bedroom apartment in order to survive and take care of my family. DONALD TRUMP please help.

    Completely agree!! This is unreasonable and causes a lot of military members to pay an outstanding amount in child support that they realistically can’t afford. We should not be putting our service members in financial hardship due to a non-taxable allowance made strictly for housing purposes. BAH is constantly changing which makes service members have to constantly modify their child support arrangement. Child support should be based strictly off of base pay or annual gross income shown on tax forms. This is a mass problem that isn’t getting the attention needed. Needs to change!

    It is understandable that for BAH, CS should include the difference between Single and Dependent rate, but the BAS is meant for the service member and not the family otherwise it would have a dependent rate as well. Not to mention they don't count the dependent rate BAH that is given with the GI bill, so if the custodial parent doesn't have any other source of income but that BAH the non custodian parent(service member) wont get an "offset payment amount"...

    I am going through this right now as well. this needs to be included in the SCRA that courts may only use the base pay for child support calculation. I am going to have to pay $956 a month for one child which is almost as much as my ex makes (1300 as she claims). This is ridiculous.

    I'm going through the same thing. Everyone is so quick to say " We love our service men and women". They are lying! They are programmed to say this. If they only knew what we go through and all that is trying to be taken from us. I also want them to know if they are including our BAH an BAS they have to take in consideration that some of us are married to GS employees so every time we PCS they leave jobs and have to wait for the government to rehire them again. Its hard on military spouses to find jobs!!!!!

    As a disabled purple heart veteran I completely support this. I am having to go back to school through Voc-Rehab to learn a new skill and while in school I get BAH as part of my benefit. I now have to give more to my ex that puts me right back into financial trouble like after not being able to got to work.

I'm not against making the necessary payments but I feel like there's no need to put one household into financial hardship, just to make sure another one is comfortable. Why can't both parties be comfortable? It's bad enough I can't see my kids when I want to, do I need to be punished financially too??

NOW I BARELY HAVE TIME TO SEE MY KIDS BECAUSE I CAN ONLY MANAGE TO SAVE ENOUGH MONEY FOR A FEW FLIGHTS TO SEE THEM THROUGHOUT THE YEAR.     My husband is paying 1086 in child support and he extended and received a 10k bonus and then deployed. His ex found out and now filed a motion for a new trial. She is asking to factor in his one time bonus of 10k into the child support so it's raised to 1229 for the next 8 years. I find that insane that you take in to consideration his bas and bah, then now his one time bonus of 10k. It's not as if he receives 10 k every year for the next 8 years. Our military receives no justice at all
