YFS Title 30 Cases Apply If No Abuse and Neglect October 14, 2013 , in the New Jersey Supreme Court in DYFS v .I.S., A-81-11, reset the standards for invoking New Jersey’s child abuse statute, Title 9, for cases of child custody cases absent a finding of abuse and neglect against a parent. The Court held that the lower courts must apply Title 30 to cases that do not involve abuse and neglect. Cases brought under Title 30 must adhere to difference procedures and standards to determine what course of actions should be taken to ensure the safety of a child in an at risk situation. The New Jersey Supreme Court found that if a lower court determines that there is no finding of abuse or neglect against a parent, a trial judge should proceed under Title 30 to determine if the parent has been “unfit to be entrusted” with the care of his or her child. Under such a determination, DYFS (now formally called the Division of Child Protection and Permanency or the DCP&P) would be allowed to engage the family and offer services, resources, and other assistance to help the unfit parent to rectify the harms that he or she has been exposing the child to. If, over time, the parent does not comply with the services and resources that DYFS provides, the child may be taken away from the parent and placed in DYFS’s care. Essentially, by proceeding under Title 30, the court has a much broader scope from which it can intervene in a family situation to protect the interests of a child. Prior to the ruling in I.S., if a court could not find that a parent abused or neglected the child under Title 9, the action would have been dismissed. Under Title 30, the court orders must be reviewed every 6 months, and parents who have lost custody of their children are permitted to prove that they have taken steps to remove the harm that their child was placed in and therefore custody of their child should be returned to them. In order for parents to regain custody of a child that DYFS has removed from their care, they must comply with the services, evaluations, and programs that DYFS will offer to them as a means to demonstrate that they are fit to be a parent. Dyfs took my children from me because i was a victim of domestic voilence which ultimately lead to me losing our home. Dyfs was well aware of the situation. I was very fourthcoming with every element with my issues and things i needed help with. I lost my home in nov. They had zero contact with me until January... 2 days before they showed up, they knew the date i was losing my home and didn't contact me at all but charged me with neglect. Dyfs It is absolutely ridiculous and needs to worry about children that are actually being abused or neglected. after court did not go in my ex's favor for visitation and child support after almost two years of not Paying or seeing my son he had someone call dyfs on me claiming I use cocaine, pills, and weed. The accusation is false and my son more then adequately taken care of. He well mannered, extremely loved, spoiled, chunky, and goes to a catholic school. My house is spotless and my son has everything he could ever possibly need or want. So without a doubt the case worker could clearly see he is not abused or neglected. She wanted me to take a drug test even though I felt like my rights were being violated I agreed. Now that I passed the test it should be immediately closed they have nothing but this lady is dragging her feet like she is trying to find a reason to keep it open. My sons visits with his dad are in a counselors office and the caseworker told the counselor she is going to keep it open for a while to see how it goes??? How what goes if You are worried about his dad then open a case against him I don't want my name to be out their like this. What can be done???REPORT COMMENTS

I can attest to all that is being written. Our child care system needs reworking. I know someone going through this in Bergen county and for some strange reason they appear to be favoring the parent whom is documented as being a danger to the child. While on the other hand the other parent works hard for a good company and has an extremely supportive family to help get them through this. What this person is going through is obsurd. There shouldn't even be a case here. But as usual Bergen county is ruining the lives of yet another family and dragging things out with poor choices that are negatively impacting the child and placing that child in danger rather than getting it away from danger.REPORT COMMENTS

These are the rights, (listed below), that are being violated by various "child protection" agencies; d.y.f.s, d.c.f, d.c.p.p and etc.. for N.J and other states, in the grip of acute emotional and mental suffering brought about from illegal abuses. Those responsible for subverting the prime directives of protection for all families and their children, must be made accountable for the betrayal of the America peoples at large. Because of their actions, the above mentioned agencies, must now be considered as criminal organizations. They must be restrained, guilty employees must face recriminations, and be made accountable for their transgressions against society, reforms must be implemented, and replaced by fairer and more humane alternatives. The evidence of their criminal activities is overwhelming. They operate as organized crime. The U.S government must make a stand against this pandemic - if We are to survive as a nation. Please understand, that these organizations are criminal, (regardless of who sponsors them), and must to be brought to justice. Here are the reasons why... Amendment I Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the government for a redress of grievances. I am single mother of two & in a fight of my life, I'm a DV victim & I called DYFS for help, instead of helping me but they've targeted me & investigated me, they have lied & took my kids from me. Instead of helping me they have used their power to destroy my family. They have discriminated against me because I am an immigrant, you'll be surprised to see how many immigrants that they have violated just because they are immigrants. These people do mo harm than good. Removing a child from their parents is more traumatic. I just wish that parents where ever you are, stand up & fight. I wrote 2 complaints letters about DYFS, one to the Congressman & two to the state Legislators. I will also be writing one to the DYFS Director or DYFS Commission. These are my kids & I have every right to fight for them & justice. Last week I noticed that my daughter had a bruise on her forehead, when I ask if she hurt herself, the caseworker said oh no she's not hurt. Like really?a black bruise don't just appear out of no where. so instead of DYFS investigating real abuse they give excuses & only targets innocent families.REPORT COMMENTS

DYFS and anything that spawns from it, is a corporation. In order to grow, people must be oppressed by taking away their rights and liberties. DYFS ultimately would like to see the middle class crushed - (is this one of N.J's true purposes?). The pursuit of liberty and happiness that was so hard fought for in 1776 is now threatened. This sounds so dystopian, (a bad and grim future), that people can't that something like this can't be happening. It is, and that is way this outrage is happening right under our very noses. This sort of thing would not remain in existence if acting Governor Jim McGreevey had not spared dyfs - they where supposed to be shut down... look what happened to him. So, once dyfs was spared, they resumed the abuse. They however be made accountable. 'DYFS' employees can be sues, judge says. A Phillipsburg mother has won the right to sue state employees who charged her with child abuse after her husband allegedly stabbed her and kidnapped their child. Michelle Mammaro, 29, continues to "seek justice in her case against" the state child services workers and police who "pursued her as a child abuser," The Federal District Court in Trenton ruled that these state employees are not immune from suit for conduct in violation of the constitution rights of parents, and Mammaro has won the right to sue department heads and individual employees of the state Department of Children & Families, its Division of Child Protection and Permanency (then the Division of Youth and Family Services, DYFS). It took more than a year for a Warren County Family Court judge to rule that Michelle Mammaro was not guilty of child abuse, Rosellini said. During that time, Rosellini and his client allege, caseworkers and police violated Michelle Mammaro's parental rights and went "beyond their constitutional bounds." According to their complaint, in 2012, Mammaro was no longer able to stay at a state "safe house" and had to move to a friend's home in Watchung. This is a victim of domestic violence, and instead of helping her, they investigated and targeted her. Rosellini said that instead of inspecting her new living space, case workers arrived with police to take the child from her mother. Under the law, the "emergency removal" called for a court hearing within 72-hours and a judge ultimately ruled that the agency should not have removed the child, Rosellini said. N.J. family sues 'DYFS' for home intrusion, civil rights violations. A Warren County family is suing the state's division of child protection and permanency for alleged unconstitutional home intrusion and civil rights violations, according to a press release issued by their attorney Kenneth Rosellini. Christopher Zimmer Sr. and his wife, Nicole, of Belvidere filed a civil rights complaint in United States District Court in Trenton today against DCPP, a DCPP supervisor and one of its case workers for an alleged "unlawful and unconstitutional home intrusion of their home in January. These are some of the facts that dyfs / dcf do not want innocent families to know. It is extremely difficult to bring down the family / children "devouring" monster as a unit, but it is only the sum of all it's parts.Sure, there are good people that work for the Division of Department(s) that deal with children and families, however once assimilated into the system, they become corrupted because the "system" is corrupt. One dyfs female worker of spanish ethnicity, bragged to a helpless woman (who had just lost her niece to them), that dyfs or the dcf, did not have to answer even to God because they were bigger than God. Are they bigger than The Federal District Court in Trenton? We must save the people, families, and children from these monsters, (all of us are potential targets), and return them back to America. 1776 and 2017 - Revolt under the American flag. D.Y.F.S and the Dept of Children and Families must be dismantled by infrastructure. The sound parts should be transferred to a completely new and revised model designed to not only protect our children and their families, their constitutional rights, dignity, and well being. These rogue arms of the State of N.J were given charters by N.J for well intention and in good faith. These "conglomerates" have fallen well short of the vision plan for healthier families to make N.J a strong state within the union. These entities, have become a blight infecting many innocent families who reside in N.J. There are people who are guilty of abusing children, their numbers pale in minority to the many more innocent families. Families who through no fault of their own have mentally and /or emotionally ill children. Children who unfortunately have learned to use these now criminally operations; (D.Y.F.S and D.C.P), for own personal reasons,as weapons against their very parents, with D.Y.F.S / D.C.P happily sponsoring this juvenile terrorism against parents. There is now a growing sentiment : that is now becoming dangerous to raise children in the State of N.J - is this the legacy we want to leave for future generations? Is this the image that N.J's care and concern for Her children is just a lie and an illusion? No! - We cannot let the "few" destroy the "many". We cannot allow that the only concern for children is that they are to be used as siphons of their parents material and spiritual assets. All the complaints about these "feral" organizations do carry weight; the bounty on "impressed" (or "stolen") children, the reward or possibly undocumented bonuses for high numbers. Something very ironic about that system however, is that the lower ranks among the d.c.p and d.y.f.s workers are given vacation days that they can't take advantage of because there just isn't enough staff to give respite - (work load). Therefore the goal is then to rise through the "ranks" in order to realize the payoff. If that ascension through the "pecking order" is achieved, then innocence of knowledge of corruption can no longer be maintained. Continual perjury in order to cover-up continual malfeasance, ill motives such racism (mixed couples), victimization of the poor or struggling, jealousies, etc., has become the norm. This sounds damning, but "what can be done?" These departments. and divisions claim to be "bigger than God" as they do answer even to him. Just complaining about these atrocities is not going to drive them away. They're larger than god? Well if you don't in the God We Trust, then who exactly do you believe in? Let's get our heads for a moment - if you will, out of our flat screen T.Vs, our text messengers, etc., and take back our constitutional rights. Make your taxes count by contacting your congress person. Spread the word on this "disease" that is slowly eating away at this and it's people - (something akin to a snake devouring it's own tail). Organize under the American flag, use the truth to address these transgressions with Class action law suits, cut off the money supply to this ideal that has become infested with personal pursuits that it not in line with protecting children and families, and getting help for those troubled children who need it. Their (D.Y.F.S and D.C.P) thing, is to turn troubled children into monsters and weapons, as a means to destabilize the family household as there is money to be inadvertently made from these insidious actions. Most importantly, it's all about reform and not destruction that these vultures intend to met out. We must defend ourselves from enemies, foreign and DOMESTIC. D.Y.F.S and it's dangling offspring D.C.P, think that they are invincible, can't be touched, and can get away with many crimes as along as it is "in the name of children". Singe the heads of the serpent went you cut it off so it can't grow back together, let's build a better, healthier N.JREPORT COMMENTS

I'm a foster parent that someone made a bogus call about they came to my house like a swat team while I my boyfriend and 16 year old foster child were watching a movie allegations of smoking pot were made so my boyfriend and I went for drug tests that came back negative. the worst part of this was the investigator whose name is Colleen violated my Hippa rights my foster child knew my results 2 weeks before I was actually told by her caseworker .I'm seeking legal advice NO ONe is gonna violate my rights NOT Even DCPPREPORT COMMENTS

oh yeah..one more thing that i find baffling,confusing and utterly non sensical is dfys will tell you how they did a investigation and the abuse is not really abuse , stepmom the abuser, kid being abused and father who states he was unaware of all this even when confronted with the fact that the abuse often occurred on his watch are all now in counseling and case has been closed.. well if the case has been closed, how can compliance with counseling be substantiated by dyfs??? this just does not make logical sense to me but this is the assways manner in which the division works but once again if the kid is killed maimed or comatose to the point of death due to this unsubstantiated counseling, here they come on tv crying and having breakdowns and often admitting they were overwhelmed, didnt really do a through investigation and like i said will falsify a record or notes to justify how they were do their job... this is the institution that prides self on saving kids.... child please...... this is to the actual dyfs kid from jersey city who posted comment as of december 2016 actual dyfs kid consider yourself the lucky one.. many many many kids were not as fortunate as you to have a positive outcome..thank god you had a dyfs worker who did her job and did it to the best outcome for you. however like i said, there are kids who still remain in horrendous and abusive conditions due to dyfs involvment or lack there of. i think you speak from a place where the outcome was beneficial to you, but like i said you are among the lucky. when you go to bed tonight think of the other kids who did not survive the abuse or who is still continuing to be abuse today by the same system who you stated saved you. how does that work actual dyfs kid from jersey city? so yes you can talk positively but there are many many kids in the ground due to abuse .. something you was saved from,,, who saved them actual dyfs kid from jersey city. why don't you be advocate for these kids so they can enjoy the same life nourishing enrichment that you now doREPORT COMMENTS

bunch of unprofessional lackeys.. you kid has to die first (dyfs) that's what dyfs stands for to me. the supervisors aint worth a grain of salt and they are the reasons for the incompetency that is permeated thru out the system. supervisors will lie and cover up their workers incompetencies and have been known to falsify records..thats why they don't want to share information with you. When confronted about their idioacy, the supervisor is quick to pass you back to the worker.. Even when confronted with abuse in the form of re cordings and photos, these *****es will still deny that abuse took place and they just gonna recommend counseling. they will actually say that the kid recanted his story as if recantation is not part of the abuse cycle... They will say how they got a independent world reknowned psychiatrist to interview the kid and how he has now stated that he doesn't believe there was abuse and this after being confronted with evidence... god forbid if the prepetrator lives in another county.. now that county steps in and says oh we couldn't substantiate if any real abuse occured... how is that when the doctor called you and said it was and a case needs to be open? they ignore true signs of abuse and instead downplay the abuse that has been substantiated... if you call them and leave messages they never ever return your calls. they give excuses for not being at their desks for four and five days.. the supervisor will lie and give some bogus*****excuse for the worker not being available and the worker will give another bogus*****excuse that doesn't jive with what supervisor told you. they cover for each other people... you call and make the complaint and now all of a sudden you ain't privy to nothing or told after a few interviews with the prepertrators that there was no abuse. what kind of******is that... like i said mother let father have kid until her housing situation was improved. she now lives in a gated community with all the amenites child needs. like schools, hospitals, transportation and she was told child is to remain with the father and never told her why.. child was not taken due to neglect or abuse, this was never a issue with the mother.. so why is child not being reunited with his mother. then those dirty *****es had the nerve to tell the father to take mother to court for child support.mom is on public assistance.. what kind of sneaky bullcrap is this? JUDGES AINT NO DAMN BETTER. when mother went to court to get her child back..mind you both parents have joint custody,the damn judge had the nerve to tell her that kid was to remain with the father and when asked why she couldn't even give the mother a credible reason why nor what could mother do to get her kid back with her... S o the judge aint' worth a damn either because she or he sanctions the abusive behavior with a pat on the back and a that's all folks kind of mentality.. they don't even tell you that you can file criminal charges when your kid is abused... so i'm kind of confused as to exactly what dyfs does and does not do and they don't do shit..... but give you a bunch of damn excuses as to why they don't thorougly invest. how many kids have had cases closed only to be found dead in the home due to the abuse they claim they could not substantiate.. this is a god damn travesty and my wish is for a dyfs worker to have one of their kids abused and see how it feels. i know i'm wrong for saying this,but it needs to happen so they know what it is like on the other side of the fence.. do nothing bunch of con artists. there will be another death and another death.. dyfs is nothing but a death machine.. remember dyfs.. you kid has to die first before they do anything and then they turn around and have nervous breakdowns and teary*****admissions that they didn't do enough, m eanwhile you burying your kid... no faith in them at allREPORT COMMENTS

the division of youth and family services in the state of new jersey is a joke... a complete joke..they do absolutely nothing but pass the buck.. Even after abuse has been substantiated by the medical profession, dyfs will still claim there was no abuse.. a female i know personally had experience the issue of homelessness,so her son was given custody of the boy,not due to neglience, mind you,but due to the issue of mom not having a permanent place to stay at the time..okay. meanwhile her is with the father who has a new wife who appears to like beating children. while dad turns a blind eye. dad is in the military and may not be around when his son is getting his*****kicked by his wife. I know for a fact it was abuse cause being in the law enforcement field for 31 years i know when i see abuse, okay? the boy came to visit with his mother as she has visits with her son one day out of the month, usually on the weekend. i found that to be troublesome as why does she only have access to her kid one day out of the weekend and he can't even spend the night? this is the arrangement done by the kids dad and for what reasons still remains unknown.. like i said previously son was not taken due to neglect okay? and its not like female gave up her parental rights.. one day kid comes to visit his mother on a saturday.. she calls me up very frantic because while kid was changing his clothes his mother noticed that there was large bruises on his ass. she asked kid where he got them from and he said that the stepmother did it and beats him on a continuous basis and has been for the last year or better. kid has been with his father since november 2015 okay.. the mother was completely frantic and did not know what to do next. I told her to photograph the bruises and take child straight to the hospital. mother who is 26 took kid to the jersey city medical center in which case he was e xamined by physician who said that this was abuse in his professional opinion and it was he who notified dfys.. Since i also saw the bruises i too wanted to call and also make a complaint but i figured one was enough for them to at least investigate.. They are full of******and need to be fired. they don't given a damn about your kid, all they care about is getting a god damn paycheck. they don't do shit. They lie continuously about how they are investigating the case and if they get back with you at all with any results, you are blessed... Dyfs opened up a investigation as they call it but didn't do anything after that. since father lives in atlantic county, dyfs was informed in that county. don't you know they had the nerve to say that atlantic county doesnt think this was abuse and this after a medical doctor etablished that it was okay? the mother who contacted the hospital was treated like she was lying and did not know what she was talking about.. the kid was very scared to go b ack to the home and didn't even want to tell the authorities because he would be punished for it. this was supposed to be a little secret and would have remained so if not for his*****being covered in black and blue marks indicative of a major*****whipping.. dyfs did not take into effefct the child's fears but returned him to the same home. When mother called to find out what was going on with the case, these dyfs workers wouldn't even discuss the case with the mother and then had the nerve to say that the kid is now recanting his story as if that is not the norm in child abuses cases. kid recanted because he didn't want to face the punishment of having to reveal what was going on in that house of horrors. recantation is a normal occurence and these so called dfys professionals know this. at the outcome of this *************investigation, the new wife who was inflicting the damage gets to go to counseling along with the kid as well as the dad who sits by and lets his kid gets demolished.. dad pretends that he didn't know this was going on, yet he sleeps in the bed with this abusing********** he calls a wife.. would you believe this ***** has a newborn of her own.. Why dont' i just go put some marks her new borns*****and then recant? whats the difference? Dyfs never kept the girl informed of their results saying that they don't have to share their results with her.. since when? wasn't she the one who levied the charges? didn't dyfs come out to investigate? only to tell her she cant know the results?? what kind of ******** is that? during the investigation mom made many calls to dyfs and if she made contact then she got special powers cause all you get from them is a damn recording... when she does make contact here come the oh we can't divulge this or divulge that. the reason why they cant is because they dont do a damn thing but sit on their*****and act like they saving the world. please. i spoke to one supervisor named melanie and she was the most umprofessional person in that division. She acts like she is doing her job as she likes to remind you but in essesence she can't even answer the most basic of questions and will pass yu back down to another equally incompetent worker in the good ole game called pass the buck.. I USED TO defend dyfs but now i completely understand how they are the most corrupt people in the state.. They don't keep you abreast of anything and treat the person reporting the abuse as if they committed it. sorry***** bunch of losers who don't deserve a god damn dime for nothing they do. ******** con artists who will decieve you about their services and what they can do and not do. they tell you one thing and then will tell another rep something else. they work behind your back with flashing colgate smiles and work against you. the worst con organization in the world and i wish them nothing but hell. oh yeah kid, mom and dad in counseling and case was closed. meanwhile i bet kid still getting his*****beat... sometimes pops won't let him come on the one day weekend. and im sure its because kid got another good*****whipping and pops want it to heal before he comes back to see his mother. ain't nobody stupid here okay.. but dyfs will only get your kid killed... need to dis band and fire all those incompetent *****es.. melanie you need to go hide your head in your ass. your the reason why kids are being killed everyday and under dyfs watch.. . look at new york city if you think im lying...REPORT COMMENTS

dyfs suck they smile in your face and stab you in the back I took a foster child in on thanksgiving shes 1 with typical 16 year old behaviors no one wanted her a bogus call was made by my sister (jealousy) and said we were doing drugs so we had to come in to get drug tested when we arrived they said if it comes out negative we have to take substance abuse classes any way over my dead body I will not go but in the mean time kharma got my sisters*****and now dyfs is all over her shes a addict they might take her 2 boys and because I wont comply the boys will now go in the foster system I cant get them and ive had them twice in the past 10 years I will fight for them when she looses them but she ha to live with it cause I believe the dad to the 11 year old will get his sonREPORT COMMENTS

My family has been torn by these people. When I was ill and my daughter was born she was in foster care. My teeth were decayed causing infection. My children were returned my baby Aimee age 2 . Kathy Vacca the x-fostermother got in touch with my daughter at age 12 after saying how pretty she was on line. She's lied to Dyfs and broken my heart im sure what she has done is not legal. Dyfs has taken my daughter it Dff been 4 months I do not see her they won't give her the 200 in gift cards to her favorite clothing stores I gave to them . I am a child and D.C.P.,P. Was called and our "mother" brought a stranger in our house before we ever met him and we were scared and uncomfortable that this man we didn't know would be sleeping in the same house we would be sleeping in. That was the breaking point besides, not having hot water or heat all winter, our mother screaming and hitting us for no reason and more. Bottom line we talked to DCPP and they heard our cries of scared and uncomfortable and neglect and they said your house is safe and okay. Because our mom cleaned the whole house knowing they would come and put on s fake smile. And when I said I was scared and uncomfortable all she said was "do you have a lock on your door". Telling me that I should need to lock myself in my room in my own house. And then I talked to a supervisor after crying to her and she tried telling me that I'm wrong the house looks okay and I cried to her telling her it's all s smoke screen and I asked her how can she be in charge of an organization for the protection of children and then yell at me and tell me I'm crazy. There is no hope. Not all are like this but they do not have their priorities in line nor do they truly care about the choices they make AND the consequences of their actions. This is how children get killed or beaten and raped in their houses. For the children who have been killed because the case workers over look it and simply say "is there a lock on your door" I'm sorry.REPORT COMMENTS

my 2 kids were taken my children's and families of warren county on may 2015. i just moved here in march of 2015. from day 1 according to my lawyer we were guilty. the judge is not far my kids have been moved several times my son has been in 3 group homes. one of the places he was sexually assaulted and they dismissed it saying he was a liar he is only 9. both my children are being placed for adoption. i feel i never had a fair hearing.how can they take kids from families with no evidence and all heresay. its just wrong.REPORT COMMENTS
