    It is another form of government and those who benefit are Attorney's, lobbyists, Property Management personnel, and even local governments who are no longer providing services to people who pay taxes. Everyone who has lived in one of these places despises them and they actually decrease property values because no one wants to spend the extra money to have a bunch of incompetent board members who think nothing of breaking the laws of their state. And many of the states have no remedy for Homeowners to file claims against them because they can't pay the legal fees. END THIS NIGHTMARE!

    My Grandmother went into Assisted Living in 2015, and the HOA was a month late, so they hired a lawyer for $500 to send her a letter. We refused to pay the attorney fees, and continued to pay the HOA. The attorney fee's a year later or over $6,000, and the HOA is now refusing to take partial payment, and is doing Lien/Foreclosure. HOA's should be illegal.

    Our 33 yr old HOA has been run by the same people for over 10 years. One of the 2 men went as far as being involved on the board in the 1990's and helped another board member steal property willed to the community. There are (2) 83 yr old men who have disobeyed the state, county laws and HOA CCRs, forged documents the HOA attorney has incorporated into county records, have increased assessments incredibly, have, are getting kick backs from vendors, hired a maint. man for 50K a yr. without owner approval, use this man to do all sorts of work on their private homes at OUR cost. Refuse to hold valid elections, continue to retain their seats on the board. We have them on TAPE saying they don't care about the law. They refuse to leave their position, they are dictators, and robbers. HOAS should be outlawed! We had the SAME issue happening at our condo association when we lived there, presidents who had family on the board, stayed on for decades, stole money etc. HOAS are double taxation, incompetent neighbors have no business ruling over their neighbors. They cost homeowners millions to fight, DECREASE property values, i.e if assessment dues are too high, a seller has to drop his house saless price to compensate. They are unconstitutional.

    my hoa constantly harasses me over things that are absolutely ridicules when i buy a home it should be mine to do with as i please the sales gimmik of a hoa neighborhood is to make it all sound great but once you move in you are miserable and want to move and feel harassed i hate not being able to do anything with my yard and i am sick of threats from my hoa disturbing my peaceful day and causing anxiety

    Live in an HOA in Oklahoma, board members lie, raise dues and assessments ignoring the CCR's even special assessment for one board member private attorney, there needs to be check and balance on boards if they ignore the contract, make it up as they go. We have a duration clause, which they missd the window to amend with 3/4 vote, but they said they would ignore the requirement if window missed of unanimous vote because they know they can not get unanimous vote. Want to raise our dues to highest rate in state, and we have absolutely nothing to show for it.

The contracts binding its members are unconscionable due to their variant nature beyond their original intent and their propensity to force free, educated, and logical adults into compulsory life style choices and even going so far as to violate the unalienable rights to which everyone is endowed in many cases.

    There should be federal laws to prohibit formation of these organizations. If developers want to have communities that have facilities they should get local government to oversee their maintenance and charge more taxes to those homeowners choosing to live in communities with pools, tennis courts, etc. HOA should not be regulated by a bunch of incompetent volunteers and state laws favor the HOA and make it expensive and difficult to sue them. The people who are benefiting from these HOA are corporation, attorneys, 0roperty managers, insurance companies, local government who would rather the HOA deal with residents complaints and save themselves money but still charge taxes. It is now a big problem for Condos and HOA who drew people to buy into their development by advertising golf courses and the like and now getting rid of them. This is a second type of government gone out of control.

    Homeowners Associations are an intrusive and gross violation of private property rights. They are the very definition of communism as they take, by force, individual private property rights and give them to the community. As such, they give control by a third party, over properties that they would not otherwise have any right to control. Once the associations are controlled by tyrants, the dream of home ownership and the rights bestowed to property ownership make the homeowner a slave to the whims of other forcing the owners to live a lifestyle dictated by some else.

    I live in woodbridge Va within the Wexford Community. Iwas fined $1000 for a No Solicitation sign on my door which was protecting my family from unwanted individuals ringing my door bell during the week and weekends. HOA not only fine me but took away the solution which was protecting my family for the last 4 years. Since the sign was removed I constantly have unwanted people ringing my door bell. There is a lack of empathy or common sense being applied to protect tenants. To make the situation worse the community have no signs displayed to protect the community however we are not allowed to protect families. The body who instituted HOA needs to revisit since they created mafia like temperaments of people making up HOA. Interesting enough as tenants we are told we are part of the association nerveless w/ no voice.

    Our assesments randomly go up... no end in sight, special assesments, painting our house without or approval of colors, locking our pool saying a variety of reasons we are a temperate climate and a sidewalk connects our properties on east and west so we cannot walk sidewalk for many months of year it's random so no dates exist when it's open this just started 3 years ago did not ask/vote to lock gate for reasons that change whenever they are asked.. we pay for termite 12 months of year never see any treatment on my home, we are constantly being given new mandates what we cannot do, the control is getting tighter, and they pick on various residents to do what appears a property grab, a few years back in conjunction with a hurricane devastated our community the were foreclosing left and right on homeowners... it's not longer "Life, Liberty and Happiness" it's rules, money, and more rules, and more money - no peace, no freedoms, no rights.

    Ignorance is bliss, and there seems to be an abundance of blissful folk here. HOAs are not the enemy unless they are run by bad or ignorant people. A good HOA is a valuable asset to ensure that the community stays clean, attractive and cared for by a potentially diverse group of people. People who do not like HOAs should not move to a community which has one...it's that simple. There are plenty of areas where they do NOT exist.... and cities, counties, state and Federal laws rule. Yes, an HOA is just one level 'down' from the city or municipality. HOAs exist in many areas where new developments were created with common areas needing to be maintained and a 'look or feel' was identified for the area. Again, no one is forced to buy in these areas. Some of us like the feeling of unity and cohesive living styles; safety, neighborhood, etc that they afford. When a developer finishes an area, he has to maintain it until a % is sold. After that, the new owners need to maintain it....and the HOA is the vehicle for included parks, yards, and appearance to remain consistent and complimentary. Yes, if you don't like that, don't BUY there! It is simple. A bad HOA can result from homeowners who are too busy, too unaware, too disinterested or unable to understand the 'business' of the HOA. (Just like you can get a bad city council and Mayor if you don't pay attention.) An uneducated board tends to hire a management company to 'handle' things..... and often makes a bad decision and ends up with one not watching out for the owners best interests. Deterioration, trash, disarray and conflict can run rampant due to not forcing compliance OR it can be too rigid and generate turnover by those who cannot comply or constant issues of many kinds. A good HOA can be like a super-glue to ensure that all aspects of a strong, sustainable community exist. But they need extensive communication with community members; attention to details and listening for important factors. The stronger the individual members of the community and the more they are willing to invest time to see things are done appropriately and accountably, the better the HOA will perform. Volunteering their time to be involved board members is the best investment any professional can give. Non-professionals need to be ready to get educated and attentive to details.... not something for everyone. HOAs are like so many things. People should not complain if they chose to live in one. And if the one they chose needs to be strengthened, they should participate. But to 'tear it down' is an attack on community and well-being for all. It is selfish and not helpful. The truth is that HOAs are less the problem than the realtors and real-estate practices that do not adequately inform prospective owners, residents or tenants of the restrictions of the HOA for a property they are considering. This is where the biggest change needs to come.... so that those not choosing to live in conformance, can find areas where they are not restricted by another layer of 'government'. To the person who says they are bullies with no power; think again. Look at the many people forced to sell their homes due to fines, violations, etc that led to high bills to be paid; or liens that impact potential sales. I am not advocating or protecting HOAs. I am merely saying they have a place and, if done well, are advantageous. If not, or one is not willing to comply, they are difficult...in need of modification.

    The Declaration of Independence is the binding thread between Gods Word and the Constitution of the United States of America. The Word of God, the Declaration of Independence and the Constitution are inseparable. They are what has made America the greatest nation in the history of the world. The Declaration states that we are to be governed by the Law of Nature and of natures God. That would indicate that every contract between individuals should be written such that all parties are in agreement and that no right of either party is infringed upon. A contract that includes an HOA is a contract that violates the Laws of Nature and of Natures God,The Declaration of Independence and the Constitution of the United States of America. They are able to get away with it because the people that we have elected, paid and trusted have perverted the Law. Instead of them promoting justice they promote injustice and we have allowed them to get away with it because of our apathy, complacency and indifference. In order to maintain liberty and justice we need a moral and virtuous citizenry who will elect moral and virtuous representatives who will govern by the Laws of Nature and of natures God. That is what made America great. But America has fallen from its greatness because we have drifted to far away from Gods Word. Once we drift away from Gods Word we fall under the evil nature of man. Our Republic was never intended to be controlled by mans Laws but by Gods Laws.That is why we have unjust HOA'S. Well, what now? That is another story, which most people do not want to hear!
