    The Declaration of Independence is the binding thread between Gods Word and the Constitution of the United States of America. The Word of God, the Declaration of Independence and the Constitution are inseparable. They are what has made America the greatest nation in the history of the world. The Declaration states that we are to be governed by the Law of Nature and of natures God. That would indicate that every contract between individuals should be written such that all parties are in agreement and that no right of either party is infringed upon. A contract that includes an HOA is a contract that violates the Laws of Nature and of Natures God,The Declaration of Independence and the Constitution of the United States of America. They are able to get away with it because the people that we have elected, paid and trusted have perverted the Law. Instead of them promoting justice they promote injustice and we have allowed them to get away with it because of our apathy, complacency and indifference. In order to maintain liberty and justice we need a moral and virtuous citizenry who will elect moral and virtuous representatives who will govern by the Laws of Nature and of natures God. That is what made America great. But America has fallen from its greatness because we have drifted to far away from Gods Word. Once we drift away from Gods Word we fall under the evil nature of man. Our Republic was never intended to be controlled by mans Laws but by Gods Laws.That is why we have unjust HOA'S. Well, what now? That is another story, which most people do not want to hear!

    I live in a small HOA of 12 homes. This organization is unduly expensive, has taken sides against neighbors for largely personal vendetta reasons, and filed stupid lawsuits that cost everyone money. They have passed restrictions that hurt everyone's property values causing home sales in our area to take years and years. They are a blatantly unconstitutional dictatorial usurpation of property rights and should be prohibited nationwide ASAP.

    We bought a house that has a "non manditory" hoa. Its a bunch of retired people with too much time on their hands driving us crazy. We keep our lawn nice, and no trash out, or break any of the rules but they are just gossipy and rude. They even have the odasity to how many pets you can have inside your home.

    A person should never have to live under the stress that HOAs and HOA management companies create. They don't go by the CC&Rs or by laws like the residents do and complaints go unanswered or your ongoing request/complaints never get resolved. They sometimes even become vindictive and create more issues for the homeowner. They spend all their time dodging their responsibility instead of taking care of them. They have turned their management responsibility into abuse. That should not be happening. All people deserve respect. They need to be outlawed.

I live in Diamondhead POA in Arkansas - Welcome to Hell Of course when you first buy, because homes are cheaper than most area homes, and you are not familiar with POAs / HOAs the realtors don't bother to tell you the truth about the POA fees and problems. Most residents have never seen or signed anything - When you buy they've Got You. Diamondhead has a golf course. there are 1500 +/- residents - 100 +/- golfers. Golf course and 19th hole have lost $1,000,000 and counting in the last 3 years. Infrastructure falling apart. Committees and POA board are golfers. Developer said he is no longer developer just grantor, Developer trying to sell for 2 years Board mostly appointed now - No one wants to run anymore because former board members that were elected were run off POA board when trying to correct problems and create transparency for residents. Board is attempting to have sworn law enforcement officers to enforce Diamondhead rules and fines. Vacant lots won't even sell at state tax auctions. homes are being foreclosed on because of past due fees and fines. One family with severe medical problems - a long time resident - is losing their home via Diamondhead foreclosure. So much more happening - feels like a 3rd world country with a dictator - Breaking the bill of rights and seemingly nothing you can do. Horrible, Horrible Place - POA lawyer bought a foreclosure for $10,000. Discriminatory practices and enforcement etc. etc. Please ask many questions before buying in A POA / HOA search the internet about HOA / POA.

    My HOA is absolutely worthless! I pay $300 a year and I don't get anything. No playground for the kids. No swimming pool. No tennis courts or basketball courts. All they care about is landscaping( which is fine as long as it is kept up!) and a lake with brown water and a fountain in the middle of it. All they do is continue to raise the fee yet provide no amenities for the homeowners. ABOLISH THE HOA NATIONWIDE!!!!

Sun River Homeowners Association is not so bad when it comes to our rules and regulations, parking. Some are silly, but we moved into a 55 or older community to be protected from unruly or uncaring neighbors. The problem is a builder who has been building since 1997, nearly 20 years. He was to be out after 8 years, but the building kept going and in the by-laws, he was to give up control in 2013. He manipulated the board to extend his control until the last lot is sold and who knows when that will ever occur. The builder owns the management company and every dollar collected of HOA fees goes to his management company, $4.400,000. He manipulates the board into giving his construction and a private company owned by him within the management company, for work to himself at inflated prices and without outside bids. When I write to the governor, attorney general and all law makers, to tell of these violations I am totally ignored. The only recourse is to hire a private attorney at personal expense to force the Management Company and board to follow the laws. Very hard to do when you are older and live on a fixed pension. This is completely unlawful and not one person of authority does a thing about it. When you cannot get anyone to even investigate these problems, our law makers should get rid of HOA's completely.

    HOA rules are VOTED on by lot owners when they are established. The intent of the rules is to protect the investment (and enjoyment) of the owners of residences in the subdivision. Some HOA's are actaully special purpose districts that are VOTED on by the owners of residences and businesses in a designated geographic location to provide some amenity that makes the area safer, retains or increases property values and provides a service or ownership of value to residences and businesses (street lights, police, fire and EMS districts, swimming pools, parks, etc.) when local governments deem the service or ownership serves too few people to make it a government-funded service/ownership. Taxes, or fees, are then collected from owners of parcels in that geographic area by the local taxing authority to pay for and maintain these services/parcels. HOA's serve the same purpose. HOA rules can be modified by the HOA members. But just like government services, they provide for the public goods and services that are desirable by most people who could not by themselves afford such essential services (codes enforcement, EMS service, fire service, sanitation pickup and disposal, etc.). HOA rules modifications are easier to accomplish than ordinances and statutes (laws). Get involved with your HOA to make your voice heard. Gather like-minded people to make your ideas stronger, then seek modification. What is disconcerting to me is reading the responses below. Too many people in today's world want to live without ANY rules, even those most of us want. USE THE PROCESS! Understand that you have to live by rules (laws). I don't want you to put your pigpen next to the house I saved for and try to keep up. I NEED the value to go up! I will NEED to borrow my home's equity to send my children to college, help them buy their first car, help them have some pride in what they own and work so hard for. If you don't like HOA rules, don't buy a house in a neighborhood that has them--DUH! If your neighborhood wants to start an HOA, get onboard to express your views. Try to CONVINCE your neighbors to adopt your viewpoint. Don't make foolish threats. Unfortunately, that seems to be the norm these days. Remember, if your viewpoint loses, there will be many who will remember you and how you acted and they will act as forcefully as necessary to counter your rudeness.

    My HOA dues are $565 a year and the only service included is trash haul-away and a small swimming pool. I don't know where all that money goes as there are over 160 homes here. I'm all for abolishing HOAs nationwide.

    I live in Grand Rapids Michigan and I am part of an HOA . They are basically dictating to me how many adult people can own a vehicle and live in my 2 bedroom condo. I have a one car stall garage and technically own 3 vehicles between me and my two sons . The ridiculous bylaws state that only visitors can park in the "common area/ visitor's parking lot and not on on a continuous basis which they have defined as being parked stationary for more than a 5 hour period of time. By the way this lot remains empty over 60 % of the time. So in addition to having to block myself in everyday and play musical chairs with cars before work at 6:30 am because that would be the only way to be compliant ... I can NEVER be compliant if my 3rd vehicle comes back into the picture because there literally and physically would be no where to park.I can't have any guests spending the night either. Who are these people ? Who are they accountable to?? I'm paying 240.00 dollars a month to live in a prison with a manicured lawn. I say get rid of them !! They are trampling all over the quality of my life , my basic civil liberties and my constitutional rights !.

They run businesses out their homes but you can't and they fine you for anything they want fine for. You are always in wrong but they can do wrong and no one is above their wrong doings. They present wrong budget and most money not used by budget. You end up paying 4 sources for roads county, state , store drainage and Hoa . They put they pay taxes in budget so you give them tax money but they don't report races because they non profit. You can't get ahead and Hoa atty is already paid in budget but if they have letter sent from atty you pay 400 to 1200 for one letter. It's ongoing unfair fine circle.!hoa atty is most time realtor so after you broke from pay them all your money they take your home from bill they run up to 1800 wrongly and if you ho court cost you 10,000 or more to keep them from taking your home , your only home, the Hoa atty conflict interest realtor foreclised and then can bid or sale your home take your home or sale make more money its biggest scam rip off. Needs to end. They fool you into thinking you can't live without Hoa but actually you won't you have more peace without Hoa

    25% Jump in annual HOA fees. They justify the increase due to legal fees from renters not paying their HOA dues. J&M property management took over, and has raised the fees every year. Why should we have to pay more? All new builds here in Spanaway, WA are HOA governed. Just another layer of Government eroding quality of life for middle class Americans. They really do little for our neighborhood. J&M maintains two gates and landscapes around the gated area. Is't that what we pay property tax for? Pierce county should cover street lights, street maintenance etc. We are so ready to move on.

    We were asked to sign off on our HOA CC&Rs when we bought our new home. Now we are looking at doing our landscaping and the HOA has sent me a completely different set of rules that tell the "design rules" . These rules tell us we have to put incertain trees and bushes in a certain way. Doing so will completely take away our vies and cover up our home so people can't see it.

    I rented a home that had HOA and it was just so frustrating. They sent a notice for a car that wasn't ours because it had been parked there for two days. They sent us a weed notice and then a fine that we had to pay for weeds. When we asked them about it they sent us a picture of the yard and you couldn't see the weeds. To afford the rent we have to work therefore are not able to do the weeds morning, noon, and night. They have way to much power. What first started as a good idea to keep the neighborhood looking nice has turned into something Awful. I refuse to buy a home in an hoa neighborhood. They need to be shut down.

    My HOA is inconsistent on enforcement and targets the lower income parts of our community. The enforcement personnel do not follow their bylaws and harass those who speak out or try to fight fees and penalties for violations. Several homes are being forced to replace concrete driveways costing thousands of dollars or face severe financial penalties, including liens and legal action. Please help us stop the abuse. We are organizing a group to hire an attorney and dissolve our HOA. This is a business, not a community organization that is looking out for our best interest.

    Our home owners association has completely overlooked their fiduciary obligation to protect their homeowners. They are imprisoning homeowners in the pool area without a safe way out. Their answer is to use public emergency funds to release their homeowners as trespassers. The homeowner must travel down an unlit fairway to find their own way out. I am in a state that has many wild animals and indigent people. Who will pay for a wrongful death, or disfigurement claim? The board see's nothing wrong with what they are doing.     I live in an hoa where the manager allowed his license to be put in an inactive status, he still does the work of a contractor and is lent out to other HOAs at a fee. Which is illegal in CA. He sent out a letter to influence the voting, also in violation of CA law.

    HOAs are arbitrary and chose whom to harass and what to harass homeowners about. They should NOT be allowed to tell me I have to paint a decoration in my front yard to match a certain paint scheme. They should NOT have the authority to charge me for how my backyard looks when no one can see it. HOAs have gotten out of control and are being allowed entirely too much control over how people decorate and live. The house is mine and as long as I am paying rent or a mortgage I do not believe someone else should be handing out violations and fines for every little thing. Dissolve HOA power and jurisdiction. STOP trying to exert control over every aspect of people's lives.

Corruption, harassment, prejudice, discrimination, privacy invading, favoritism, manipulation, blackmail - since when is any of this "LEGAL" in America?? That is what these HOA's and POA's are allowed to do to people and it's time for it to STOP. HOA's and POA's are a money making scheme that is lowering the value of homes. There needs to be way more protection against these mafia-like organizations for homeowners and the time has come for them to be dissolved, once and for all.

    I got a letter from manager of Arrowhead Ranch Phase 2 in AZ sayings my sunscreen IS FADED/SILVER SCREEN. It need to replace a new one. My god my tenant lives in house more than 5 years, and she could not know but she "manager of HOA" knew it right away . I bet she walks and study my sunscreen frame to spot right on. By the way we just put the Solar system on a roof and HOA does not like it. But HOA CANNOT REFUSED IT BECAUSE IT IS A LAW IN AZ.     My HOA charges monthly and are raising what we are currently paying. We have 270 homes. They say the increase is for maintenance of a dam. They are showing a 15,000.00 balance. Why do we need to pay more. Our yards are small and the mowers do horrible work. Some of us have to mow after they are done it is so bad! The bylaws say they will remove snow from driveways and they do not! We are paying a lot of money for nothing. Help Americans to get rix of these money thieves please!

    The HOA in which we are living, offers nothing. They continue to collect the yearly dues, but offer not one single thing. They rule and abuse certain homeowners, while allowing others to do the exact same thing. I am paying for my home, keep it very tidy, have actually done many upgrades to the home, and they Hoa is forcing me to remove a fence I had installed to contain my dogs. The fence isn't the only one that does not meet HOA standards, yet we are being forced to remove ours, while others in the same neighborhood are allowed to keep theirs. HOA's as a whole are crooks, and they need to be done away with.

    Hoa just fines you to tell you how to live on your own property. No HOA should be on tax paying homeowner who owns their own home&bland. I can understand reasonable fee on condos&stow homes but not property homeowner maintains. This Hoa problem is out of hand and SC homeowners having health problems and heart attacks . Please let us live in peace, we pay 4 sources as tax payers county, state, storm drainage , & Hoa and ROADS not maintained properly to be safe and look horrible . Not fair we pay for someone to collect to dictate to us. Hoa cannot be fair ever. They can take your home after running fee up to 1800 , people owe more in credit cards and they not taking your home. Hoa threaten you and claim no one has jurisdiction when they are just rip off unfair controlling and take your last dollar for nothing. They not paying taxes but we tax payers suffering. HOA is biggest rip off. Hoa must be banned forever . To have life, liberty, freedom, health & pursuit of happiness. HOA be Removed out our lives forever. Hoa takes away precious time & health that should be valued.
