If a man that decides to have another child after getting divorced, that new child shouldn't suffer because the first child mom is getting all that money for her nails and such. While his new child suffers financially of his needs because of everything is going to the first born mom. Child support shouldn't be calculated from his income but by his needs. It takes two to make a baby it is not fair for only dad to pay it should be equal. These laws need to change. In Texas the first born gets 17.5% of his income if another child is born while that child only gets 5% at the most 10% but unlikely of his income . the law is practically saying the first child is more important than his new child. These laws need to change . the other should not get more or less than the other it should be equal. -

You know I am fed-up with this DEAD BEAT WOMEN that states cater to. I have been on child support for 16 years with no arrears, I claimed my son from day one. I have had a job since then and support everything . . . . She has not worked in 16 years thanks to your finance payment of child support that my son barely gets so I have to give him money under the table or his mother will take it. She has also sent my son to her mother house to go to school. Her mother then tried to file income tax on my son which I counter very quickly. Let mention that she stays in MY HOUSE which yield another son who is now 2 years old. I did not want to have any more children by this women, but I am getting old and my first son needed a brother, every now and then she threatens to file child support on the 2nd one who stays in MY HOUSE AS WELL, I do not have the money to get a lawyer to fight this due to it all going to her. Bottom line I am paying child support for 16 years and this women is in MY HOUSE. The only reason she is still their is because I care so much about my kids and don't want them to end up in a shelter when I can provide for them. She also threatens to harm them which is something I cannot take. I am so fed up of taking care of a grown*****women who don't want to work and the laws enable this. I have told her plenty of times to leave the kids here and go get on your feet you can could and get or see the kids on the weekend to no avail. I am a very bitter and un-happy man who has been trapped by the loop holes in the Child Support Laws. I have also told the child support office and the women at the desk just laugh like I am lying and just don't want to take care of my kids, this makes me very very upset when all these DEAD BEAT WOMEN stick together. I get home from work my 2 year son is greeting me at the door until she calls him like she don't want him around me. I cook, she sends him to bed and saying he already ate. I don't know how much more I can take, I am too nice but their is a time when this will come to an end. Sometimes I think of just leaving the country and starting over. my fiancé made 31k. after child support taxes and insurance he makes negative pay. no back child support but they tell him he is capable of making more. he doesn't have money to eat or buy gas to get to work. on top of it why is it okay for another man to be living off his child support? who stands up for the men. who enforces court orders when the woman decides to claim the kids when she wasn't supposed to. The rude woman at the child support agency said he should get three jobs and said he should get a lawyer. WITH WHAT? why not drug test the woman that's receiving the money. You have taken a hard working man that was a good father and made him homeless, no rooms to bring his kids to, no money to do anything with them all because she decided she wanted another man. My fiancé doesn't own anything because he let her keep everything in the house for the kids sake. She is netting 18,000 per yr and gets food share, badger care but he still is paying the high insurance. She lives in a big house that a lot of couples that both work can't afford to live how she does. and this is why he feels there is no way to make it and tried to kill himself. The Child Support System needs to be reformed. I am familiar with several people who are involved with these unfair practices in this system. The system is horribly skewed towards the mother, who is often the custodial parent; and is very, very, VERY biased against the fathers. Under this current system, if a non-custodial parent- usually the father- is unable to pay, their driver?s license is suspended. How can they go to work to earn the money needed to pay the debt if their license is suspended? Additionally, if they should happen to miss a court date for any reason, an arrest warrant is issued and they are incarcerated. How are they to go to work to pay the debt if they are incarcerated? In this present day society, no other debt collection causes your driver?s license to be suspended nor ends with the result of incarceration. Question: if you didn?t the money to buy your child a pair of shoes this week, would your license be suspended? Certainly not. Why, then, are these types of punishments placed on non-custodial parents who are unable to pay child support? Every parent that pays child support is not a deadbeat; their situation is simply a result of the demise of the relationship between both parents. While the system does serve a purpose, it is in desperate need of monitoring. Far too many instances occur where the custodial parent?s demand for child support is not a result of actual financial need for the child; their goal is to be a thorn in the side of the parent they are no longer in a relationship with. If the parent files a claim for child support, they need to be able to show that they need child support, and the amount of the support needs to be contingent upon how much the non-custodial parent is able to pay. Sadly, many of the custodial parents that exercise these cruel tactics are female parents. What claim is the non-custodial parent able to file in such cases? While he's barely able to pay his rent, she's demanding that he pay child support so she can take another trip or buy another pair of $300 sneakers? Where's the justice in that? The system is also an opponent to non-custodial parents who re-marry. The assumption is often that the non-custodial parent will forget about his ?old? children and lavish all of his abundance upon any children he has in the new relationship. I work 60 hrs a week to be able to live and give my ex 1,200$ a month and judge keeps on granting her everything as I'm getting to the point I can barely make rent on top of this she is court ordered to provide the essentials when they come over and she doesn't even do that and I also pay for the extra curricular activities and all I've asked is for more time with my kids and get denied for no reason because the they think more time with my kids means less child support which is sad because kids need their daddy's also. Last thing is when we sold the house her dad bought her a house and she lives rent free and dad bought her a car also which is sad considering she is 35. I'm tired of the laws screwing dads. Time for changes illinois hasn't changed laws since the 80's . The state of Indiana is making me pay Child support past my 3 boys emancipation ages. I was in the arrears because of an illness for 4 1/2 years and I was finally approved for SSDI last July. The judge just ruled on this and refused to retro active their emancipations. According to Indiana child support guidelines, it states. Children are emancipated by operation of law! You read down and then it contradicts it's own law by saying the non-custodial parent has to file a modification, before they will remove the child for emancipation? My oldest is 28 and the middle is 26. Basicly I'm overpaying by about 30-40 thousand dollars. The definition of operation of law in Black's law dictionary 9th edition says it means it's automatic! This is certainly one sided in my opinion. When I went to court, they wanted a full disclosure of all my bills (necessities and leisure). They didn't care that my ex was lying about her tips she made as a bartender. They went off of what she claimed she made. No one I know claims all their tips when reporting them. I had to have a bankruptcy because my ex kicked me out of my house and then got sole occupancy through the court system to prevent me from trying to move back to my home. The judge said to me "I don't care if you drive a jalope and live with your parents as long as your children are taken care of. I was not even able to present my living situation because the judge didn't want to hear it. I was slated to make just what I had for the past 5 years and my judge projected that I would make 7 to $8,000 more than I actually did for that year. She set my obligations, based on making $72,000 (judges calculations) which turns out is $379 a week. How can that even be realistic? What's more, the judge didn't say "oh, and you should try to find a job that is more on the books so we can actually see how much money you actually make. We went back to court so I could ask for a reduction and the judge told me to get a 2nd job if money was tight. Seriously? So, my kids should see less of me so I can make things even by working 2 jobs? New York State is pretty ruthless regarding men. If I have to pay this kind of money, why can't I claim it on my taxes at the end of the year? I worked for the money that goes to her, I pay taxes on the money that goes to her, what is wrong with this picture?! Why isn't the non custodial (paying parent) the default parent to claim the kids on their taxes? Maybe now I should explain that I have my kids for 4 days per week every other 4 days (50%) of the time. Definitely not fair. I don't think I should have to pay my exes mortgage while trying to figure out a way to be able to care properly for our kids. Especially when we have them equally and the judge didn't even care... Hope something changes for the rest of the poor parents that get shafted by the system like I did.REPORT COMMENTS

How is it right that if someone doesn't know that they have a child and does something to get locked up for 19 years they still have to pay court ordered child support??!?!? That makes no sense whatsoever. That person could be in a 23 hour a day lock down and can only use the phone while still shackled and still getting thousands and thousands of dollars of back pay. How is that person even supposed to make those payments? Yes they shouldn't of gotten locked up I know but it's not right that a bill is going to get added up when the at person has absolutely no way of paying it. I've been told by a cs attorney that someone could be completely disabled in a wheel chair and paralyzed and cant even walk and still have to pay child support? So I am active duty military and I am responsible for maintaining my own living establishments with accordance to state laws and regulations pertaining to my parental responsibilities. I am paying more than I can legally afford within my pay. If its for the best interest of the child/children then the noncustodial parent should not be hung out to dry, especially if they are active in the lives of their children. I am sent on military orders to other duty locations and am required to provide a healthy, safe, environment for my kids but if I am not even able to provide that for myself then how can I do that for them as well? Congress, I ask you to set a basic needs of the child across the board. Not off how much the parents make, but off a fair assessment of requirements. For example, if a parent is trying to better themselves so they can financially support the child then why should a percent of their success go to the custodial parent just cause the noncustodial parent utilizes what available to be in a better situation? in my case the custodial parent was given primary physical custody without a choice to me, and I am paying for it. I am limited on my visitation, my living arrangements don't allow me over night visitation due to the state laws of gender living arrangements. Please reevaluate the support standards table across the states or at least make the states responsible for adjusting the guidelines to reasonable amounts. I have been paying $1,273.00 a month for the past 3 months since they adjusted my amounts and my children have NOT seen a dime. The custodial parent works 9-4 M-F, receives EBT, discounted rent through her work, child support from another parent, her standard income, and since she works at the daycare facility of the children she receives a very discounted rate. I am a firm believer in supporting my children, but they are now suffering the loss of time with their father due to my limited resources and availability to maintain a location to have my time with them. I vowed to support this country and the local state government destroys people in my situation while Washington sits and does nothing. I just want my time to be a father. I'd like to know exactly (proof) what my money is paying. I pay child support for two teens who see me as a ATM and don't want me in there lives yet they don't say NO to my money RIGHT! I too don't want any part of all that families lives. I pay top cap of support for both teens and I don't see them benefiting from it, they dress cheap. There stepdad that they call DAD who can't even support them dresses well and his two daughters that he has with the mother of the two teens I support. Yet those two (mom & stepdad) don't make what I make in one of there life times. Unbelievable how this child support system works because they say its here for the best interest for the children yet in reality its more like making sure they don't have to financially support the children. My husband who works 60 hours a week and is a partially disabled combat veteran (who has yet to receive his disability payments after waiting over a year and a half since he got out) with 20 years of military service is getting taken to the cleaners by his ex wife for child support for their 2 teenaged sons aged 17 (soon to be 18) and 16. Actually, the payments are technically for just the older of the two because the garnishments began while there was split custody; the younger one was still living with us at the time and had been for about a year and a half. The State of Maryland ordered my husband no longer had to pay $750 monthly since custody was split as well as the fact that their education and insurance is paid for. Now after his ex wife went behind his back and a back door, my husband is having nearly $1200 garnished a month for the past 6 months. He has since been in the process of trying to get this appealed through Child Support Services in Tennessee to no avail. Their "system" seems backwards and archaic as they make my husband mail in his paystubs and new requests to appeal these garnishments every month. His older son will be 18 by the time the payments are adjusted fairly! Aside from that, his ex wife used his income from when they divorced over 10 years ago, my husband was serving over seas, working 2 jobs, and earning much more AND they factored in his Basic Housing Allowence the military provides which they are not supposed to do. His ex apparently was lazy and didn't work for years but, she now has a job and has NEVER provided the court with her income and assets. Evidently, she has family members who work for the court she went through including the clerk who assisted her in the process which should be illegal as only non-partial parties should be involved. My husband was never received a summons to court or anything to show cause and was surprised to find over $550 of his paycheck garnished. He also is being threatened to have his Federal Income Tax Return garnished for back child support for last fiscal year. When husband got custody of his younger son, a year or so prior, he provided his current income which was not factored in. We had to another city where the cost of living is substainly cheaper because of this and I had to quit my job. My husband was able to transfer with his job though. He sent his son back to his Mother because he felt he could no longer provide for him and the area where we moved is not a kid friendly neighborhood. We are struggling because I can't seem to find a job (and I'm ineligible for UI because I quit and moved for my husband). My husband lost wages due to some health issues and being hospitalized recently however no matter what the nearly $1200 is being garnished like clock work. We have been late on rent and almost got evicted from our townhouse. We have trouble paying our other bills. We do with out in a lot of cases. Our 2 small dogs eat better than we do. My husband has two children from two seperate relationships which we have 30% custody of. He makes great money on paper but only brings home 2,000$ a month. That isn't enough money each month to provide food, clothes and a roof over his children's head not to mention going and doing anything with them. All the while his children's mothers either live rent free or pay next to nothing. They each take several vacation trips per year and always have new clothes and extra things. He was recently promoted and I just don't understand why he has to pay more to "even out the style of living between the homes" when they have a better style of living at their mothers homes. We are asking for 50/50 of his son & we were just informed that he will still have to pay her around 500$ a month while she is living at home with her parents working part time. Something needs to be done to protect the fathers that want to be in their children's lives. How will he ever be able to buy a home for his kids to grow up in if he can never get ahead in life? It doesn't take one male to make a baby. The child is 50% the mothers reaponsibility, there is no reason why fathers should have to pay for the mothers to be able to hold up to providing for THEIR child on THEIR half.REPORT COMMENTS

I am a mother to two boys and two stepchildren. I work 3.5 to 6 hours a day at our school district while our children are in school. It helps to make up the $200 a week my husband pays in child support (he has 50/50 legal and physical custody).I started working there when my youngest was 6. I've been paying over $950 a month for 2 children. Worked extremely hard this past yr to get a promotion and make some more money. The minute I accept it, and the ex finds out she files for modification to receive more money. Why should a man even try to better himself? Why are people allowed to use the system as a weapon? Now I'm not able to pay my own bills, or even go do fun things with our children when I have them because she's sitting back getting the worlds biggest free ride ever. I'd love to have our children, but it's simple... The system favors the mother no matter how good the father is. You're punishing the fathers that actually do want to be a part of our children's lives and are not dead beats. This system needs fixed badly.REPORT COMMENTS
