They willingly gave up there right to said child support when they ended the relationship. I'd been abuse for years by the child support system, they were taking 900 dollars a month from my check and i am only a security guard, making 15.23 hr 30 hours a week. there is no institution that seems to care about the abuse, child support collection unit raise the arrears when they feel like and they refuse to audit my account. this is fraud and extortion, a have another son that is 1 year old, and the legal helpline that someone suggest to me said, that i should've think twice before i had him.REPORT COMMENTS

My husband and I have custodial custody of my step son. His biological mother was order to pay child support when we got custody, when he was 7yrs old. She went to court and turned in a modification for child support in November of 2015. My stepson is now 17 years old. The judge stated in court that they do not feel she is creditable because she was claiming she only worked one day a week and was working for free at a barbershop "intern" her and her boyfriend actually own the shop. They get to use the shop for free, don't have to pay no rent on it because the boyfriend's family member owns the building, so they make a free income. She lied to the judge about her income after the judge got done saying all that they stated that the father was to pay the mother $209 a month in child support. She doesn't see my step-son or does she even bother to call him. He doesn't live with her she lives off of Section 8 and gets food stamps and Medicaid. We have to pay Kaiser for medical insurance which my son is also on. She pays $100 a month in rent. How is this Fair how can this girl claim to be this person making no money, and my husband and I work full time jobs to pay our bills and take care of her children, and now pay her child support for a child she doesn't see. Mother doesn't see my step son but maybe every 2 to 3 months; however is granted child support because she makes less money, as she claims. Giving this girl money for a child she does not take care of. Nor does she have a bedroom for him sleep in. If/when he goes over he sleeps on the couch. The worst part about it is as they're making us pay back pay from November of 2015 ($1,200). She just paid her back child support because her attorney told her it look good, now we have to pay it back to her after we went and spent the money on new clothes for my son, food and two bills. We got my son a car a few months ago and he just got his licence. She never been involved in his life. She pops up every now and then when it's convenient for her. She has one other child she pawns off to the grandparents. This is not right. We're paying 1400 for my son to go to Washington DC we have to come out of pocket that money plus pay 1200 to child support for this girl to spend on herself.REPORT COMMENTS

I worked so much over time in 2015 because my second shift delivery driver woman was able to watch my daughter for me so i could provide a nice car for her to drive while she was prego. Son was born amd eanted everything her way. We faught. She left me went to court in march. Told the guy i have joint for my daighter. And pay 250 a month for her for day care. I havent worled any over time and was bringing home 325 a week. The mediater ignored my pay checks and used my w2 from all that over time. Now im 3 bills behind because ober time is not availble at my shop so you have to jump through all these loops to get heard. While shes on food stamps. Wic making more money then me cause she dont have to be honest on the tips she makes. Something needs to be changedREPORT COMMENTS

It doesn't only apply to men. Women are sometimes given the mess end of the stick too. It isn't fair man or woman everyone should pull their weight when raising children but it shouldn't be a burden on one parent and a picnic for the other. I pay 2100.00 per month and my wife left me because I did not want more children. We had agreed to have one and we did but she wanted more after the one. She left for another guy now remarried with her next child. I pay that 2100 faithfully but during tax time, she is not taxed on child support I am in top of 28000 in taxes. I get limited time with my kid but the judge couldn't see this was not my fault. My ex was greedy she didn't have a job when we went to court but soon after the ddivorce was over she went back to work hot remarried and now I'm the one suffering. This country is so wrong when it comes to divorces. I guess the judges see their daughtets in our exs. Men don't stand a chance.REPORT COMMENTS

Both parents need to be financially responsible for their children, both incomes need to be counted. Texas only takes the non custodial parents income when calculating child support. If the parent pays 1100.00 in Texas, in a state that includes custodial parents income it would be closer to 750.00. If both parents are deemed fit they should both be custodial parents with equal time. The child support laws and family courts divide parents and children. These laws need to change!! I have been abused by this system in Pennsylvania since 1990. Recently I had a contempt hearing for failure to pay. I had medical problems and all parties involved knew this. In the hearing the judge said, find employment and catch up all of March 2016. I found employment, my wages were garnished and I paid up for the month. The judge fumbled around my pay stub as if it were a hot potato and claimed he couldn't "read this" and handed it to the DRO officer. He then listened to the Mother, which he usually just listens to her rant and moves on, and then gave his sentencing. 90 days in jail with work release if I didn't come up with $500 in 4 days?! Child Support should work as follows: *****Divorced Couples***** 1: A "realistic" child budget should be formed. (Some families raise their children with $5,000/year, some $50,000, but never more than they are comfortably able.) Both parents should, of their own volition, be able to contribute in whole, or as much to the agreed upon portion as they can without harming their own future survival. 1a: The child budget, based on the ACTUAL cost to raise a child, shall be split 50/50 regardless of custody when visitation rules are in place. The payment amount shall never exceed the set amount of the agreed upon budget, unless done so willfully by either parent. The agreed upon amount is set-up as a contract between both parents, and mediated by the state who will handle the payment transfer and bookkeeping. The state may demand a set fee to assist with this service, or a percentage. 1b: A non-custodial parent who, WILLFULLY, does not pay their portion endangers his/her relationship with that child by restricting their own visitation. 1c: In the event that either parent becomes unemployed, he or she shall not be fined, punished, taxed or ineligible for visitation for a period of 60 days, once per calendar year. The 60-day absence of payment may be paid back over time in 6 months, 12 month or 18-month payment plans, without interest. Unpaid monies, beyond 60 days, become a debt to the civil courts, or child support agencies, and affect only the credit rating, and visitation capabilities, -only for willful non-payment- of the individual in arrears. *****Unmarried Women***** 2: Women who are not married, but are pregnant from a relationship that is less than 6 months, are ineligible for child support. Because of the options available to women in these modern times, there is no excuse as to why a child should be born into a destitute and broken family unit. A woman who is unmarried, whether she left the father or the father left her, who has chosen to keep a child, does so of her own free will and is thus accorded the sole responsibility for that child. 3: Women who become pregnant by fraudulent means in order to extort or solicit monies from men via the family court system shall not be eligible for child support from either parent or state. *****Stipulations***** 1: Child support shall be considered a taxable income to the beneficiary, unless those funds are placed upon a designated child support card which is limited in purchases relating to the welfare of the child directly. 2: The parent who pays the majority of the child support due to the limited income of the other, is entitled to claim the child as a dependent on their taxes at the end of the year. 3: At no time, may either parent be fined, judged, or jailed for failing to pay child support. No judge, or institution of any kind may garnish any wages or intercept any monies of either parent. I went to court today to file papers to finalize my divorce. At which time "Friend of the Court" told me that they would not file my paperwork because I refused to make my daughter's father pay child support. They told me that if I wanted my divorce to be granted then he must pay child support. Their reason being that I have government insurance on myself. My judge said he would give me a couple months to switch my insurance, due to the fact I am remarrying once my divorce is final. Friend of the court said No, my ex must pay or I need to drop my insurance. So I dropped my insurance as soon as I left. I WILL NOT ALLOW THE GOVERNMENT TO FORCE MY DAUGHTERS FATHER TO PAY ME MONEY I DO NOT NEED. His responsibility is to help take care of our daughter, not me or the other members of my household. He has a home of his own to maintain, which he needs to be able to care for our child while she is with him. Women work this system to get a free ride and it MUST stop!! If you can't support your own home then give the child to the other parent that is capable. Its that simple. My fiance gives his ex $500 a month for his boys because that woman refuses to work and lives off government aid but he only gets to see his boys four days a month. It isn't right. We fight to have those boys with us and the courts only care about the money. Why is it that he can go to jail if he doesn't pay but nobody cares that his sons suffer not being able to see him enough. The government needs to change their priorities!REPORT COMMENTS

My ex wife benefits from my hard work and career and financial gains. Child support should be a set amount per child. Not, "Well this man earns more money, so he pays more." Either raising a child costs a flat rate or not. True, men that earn more money should share that wealth with their child. But I do! Not only does my ex wife benefit, but I spend more money on our child than she does, WITH MY MONEY! The entire system is flawed. My ex wife lives at home with mommy and daddy, rent free, while her parents and family help her with everything, she filed bankruptcy, while I moved out of our house, had to trade in my vehicle for a cheaper one, and am struggling. "For the best interest of the child" is what is claimed for collecting all this money from non-custodial parents, mostly fathers. If "For the best interest of the child" is what is most important then quality time with each parent should be top priority not money. The lawmakers want the children to have the same lifestyle that they would have had if the family was still intact. News flash! That's a fantasy land you're trying to create. There are now 2 households that have to be supported. All the court looks at is the kids primary residence. Well, the kids need a roof over their head and food to eat when they visit the non-custodial parent too. Where is this money coming from if the non-custodial parent is having to send most of their paycheck to the custodial parent? The custodial parent gets the pleasure of seeing their children on a regular basis while the non-custodial parent gets the crumbs. A limited set time to see their own children. No more time is allowed unless the custodial parent gives them permission. Permission? It's like these children are their property!! 1. Non-custodial parents have to pay a big portion out of their paycheck for child support. If they get a raise or a better job they have to pay even more money. They are punished for trying to better their life. There is no incentive to do better if the custodial parent has their hands out for more money that the non-custodial parent worked hard to earn. 2. The non-custodial parent has to claim the child support paid as income earned on their taxes even though it went to another household and they didn't get to use it. While the custodial parent doesn't have to claim the child support as earned income on their taxes so it's free money. 3. Unless stated otherwise, the custodial parent gets to claim each child on their taxes and get the child tax credit which gives them even more free money. 4. A lot of court orders makes the non-custodial parent provide insurance for the child and sometimes also pay, or help pay, the co-pay and deductibles for them too. 5. Some court orders require the non-custodial parents to help with paying for extra curricular activities. 6. If a non-custodial parent gets behind on child support, no matter the reason, interest is added on to the arrears making it even harder for them to catch up and get out of debt. Where is the custodial parents financial obligation in all this? They are getting the benefit of seeing their children most of the time while the non-custodial parent is forced to pay them for this privilege!! The court doesn't demand equal time but they sure do demand that the one who rarely sees the children pay for not getting to see them. There is no reason that these custodial parents shouldn't be held financially accountable for their children too, especially when the children reach school age and they no longer need to be at home with them all the time.
