Stop adding BAH into child support for our Military Members

    My husband is going through this now. He is ordered to pay over 1300 in child support because they account for his bah, food allowance, clothing allowance, etc. Those entitlements are there to ensure he is taken care of l, but instead it all goes to his child support. The worst part is that the mothers' don't work because they can just collect a high amount of child support. It is very wrong that they take all his money that is supposed to be used for his well being, leaving him (and myself) with financial hardships.

    Im a soldier in the u.s. Army and i am married paying child support to my ex gf with 2 kids. It isnt right to take money from an allowance that is meant to help put a roof over mine and my wifes head. There isnt alot of help in the system for courts and military personel as it is. Why couldnt it go off before the pay you make being married? Its unjust

    States really screw service members with this. Then if the custodial parent isn't working they raise child support. BAH should not be use for calculating child support giving the fact it constantly changes.....

    A non-custodial parent must use the BAH to provide a safe house for their children. Therefore BAH should allow the non-custodial parent to do this and not be included in the child support amount calculation!

    he child support amount should be based on the area the CHILD resides, not the amount the service member receives in BAH.

    I am stationed at Ft Bliss, the current BAH is 1260. My child support is 1400, all my BAH is gone and some of my nase pay. I struggle to make ends meet, i am married and have children with my wife plus step children. It is really hard not to be able to have the money to even take my kids out to the movies or a nice dinner once in a while.

    This is a serious injustice to servicemembers. The federal law states that housing can't be garnished for any reason. An yet they allow the states to decide the faith of military personnel and theyre lively hoods.

    Please change this, it is riddiculous for me to have taken custody of one child and still have to pay for the other. meanwhile i have moved a bunch of times and my BAH changes...this is not right for courts to include this in the income for child support...i do have my own family and that money is intended for housing.

    I divorced coming from an Overseas Tour where I received Overseas Housing Allowance in the amount of $2500 a month per the house I lived in at the time the marriage disolved. Overseas in Germany your rent is set by the amount of rent that is on your lease. You cannot pocket any of the BAH called OHA overseas. That is calculated into Child Support. You cannot move into a smaller apt for $700/mth and still receive the $2500 a month. This would allow for the excess to be used toward paying the monthly child support that was ordered. Due to my OHA and COLA (Cost of Living Allowance which was close to $580/mth) I was imputed at $7200/mth disposable income. I am now in the states and earn $1590/mth in BAH and no longer receive COLA with a total of $3200/mth disposable but am still imputed at the total of $7200. I tried to do a Motion to Modify due to change in circumstance, but the Judge stated that I would have to remain imputed at the higher rate. I believe that in the instance of being stationed Overseas that OHA or BAH should not be calculated. Earning 3200 a month and having to give my ex 2200 a month (maintenance and child support) has put to large of a financial strain on my me and unfair. When she is living with someone for the last 2 years, who makes $65K a year and they refuse to get married until alimony is finished. I live off of $1000 a month. I gave her 40K in alimony/child support last year. This makes me sick.

    I pay $1083 a month for one child. I still have three kids at home that have to do without because the court believes it take $2166 ( if both parties are paying the same amount) to raise one kid. After I pay housing, child care, vehicle payment and utilities I have nothing left at the end of the month.

    Crazy how the new trend is for girls to get a military guy so they can get as much money as possible and cheats on him while in Afghanistan but the courts order custody for the mother cause the father can be deployed at any moment

    TRUE STATEMENT! Calculating BAH into Child Support put many military families in financial strain. I had a Soldier who PCS'ed to a location where the BAH was significantly lower by over $1,000 but was still getting child support taken based off of the previous duty station. Additionally, if a Soldier lives in on-post housing, they never actually see that amount because it is immediately deducted from their pay.
