As per our regulations and CFR's bah is a monetary fund for a given soldier to house him and his family. Just because a Soldier divorces doesn't mean that he no longer has to provide a place for the children to reside when they are in his or her care. BAS is a monetary fund given to the Soldier to feed him or herself not the family. I support this petition. Taking care of my kids is a priority but by adding in BAH it does put a burden on taking care of my kids and living comfortable or even getting ahead. Especially when you have to fight just to see your children and then when they come to you their clothes are too small, shoes don't fit, and just not in good condition. So all this child support that you pay out is not even being used to take care of the child. It's almost always the fathers who have to pay for the separation or divorce. You lose out on time because your serving your country and that's held against you also. The system is not fair for the fathers. Again I completely support this petition.REPORT COMMENTS

I absolutely agree that BAH and BAS should not be considered when determining child support. I am required to maintain a home with bedrooms for my children when they visit. I agree! BAH should not be used when calculating child support, nor any other services! It is NOT income! If a military member lives on base, their ENTIRE BAH is taken for housing... They don't see a penny of it! So why would that be used to calculate child support? I PCS'd from a low-rate BAH location to a higher rate (Washington, DC) for 3 years. At the end of 3 years, I PCS'd again back to a lower-rate location. Local Magistrate ruled my PCS from Washington was a "voluntary reduction in income" and ordered that my new income be counted as if I were still at my old duty location, meaning I am paying child support based on a BAH rate I no longer receive! Over $16,000 year, or $150 extra per month that I do not make nor have. Fathers are screwed royally when it comes to kids and being in the military.REPORT COMMENTS

"Allowances" fluctuate depending on the location the military member is serving. To have to return to court everyone a service member changes duty stations is extremely costly. Hawaii for example issues COLA to offset the higher cost of living. Once that service member leaves Hawaii, COLA is no longer given. This also holds true when the non-custodial parent lives in a different state than the custodial parent because the BAH is for where the military member lives and not the child anyway! Also, if the military member lives in privatized housing and is automatically deducted every month, how is that "income", when the military member does not see it! The government is giving me a free house, but is making me "pay" for it but yet I have to claim it on my taxes but not state that I pay "rent." How is this right, when the benefit changes frequently with every location!! I guess we are supposed to take the ex-spouse back to court for an adjustment!! disgusting!! These men and women serve their country, they DO NOT get paid as much as the civilian sector does AND they deploy at a moments notice and our government thinks that their entire income should be included!!! I am given a larger then average basic allows for housing because I live in New York and this is factored into my child support. The mother lives in Colorado in a low cost to live area. What they don't factor in is with the money given to me is barely enough to cover housing costs and my housing isn't very nice. I will now be forced to move to extremely low income housing to survive. I don't live near a military base so cannot move on base to off set my actual income.
