BAH is not a definite amount, although being considered "income" on a distant perspective. It is variable, and can change base to base. It is not fair to consider it's entire amount as income to any military member. Things to consider, ie - a military member HAVING to live on base because off base is not an option, in which case their BAH does not go to them, they do not receive it. I was divorced in Texas and even made the Attorney General's office aware of CFR 581.104. The representative actually chuckled and told me "Well, we don't follow federal regulations, we have a state policy." I've since filed for and completed a Chapter 13 bankruptcy and during visits with my kids, the money is so tight that I can't do for thin what their mother can.REPORT COMMENTS

This goes for BAS as well. BAS is an allowance specifically for the military member. It does not change or come about with having a family or dependents. It's a non-taxable allowance for just the military member. Aside from that...with my pay as an E-6 at my duty station...my child support for 1 child that includes all my Base Pay/BAH/BAS nearly matches my ex spouses monthly income. And I don't give her spousal support. I feel a federal regulation on this is necessary to protect all military members from this injustice.REPORT COMMENTS
