BAH is based on the area you reside in order to secure housing in that location, fluctuating depending on the local area cost of living. It should not be counted in the overall equation for child support. This is money that goes into your pocket and sometimes alot of it. It IS a income, whether tax deductible or not! Quit trying to pay as little as possible for your kids. By the way, I would be a lot of you claim them on your BAH so you get more money. Be a responsible military father and pay what your supposed to. Cash in your pocket is cash in your pocket, i.e. BAH. The BAH should not be included, it's not a consistent number first off and changes every time the military member moves. Military BAH pay should not be entitlements to Child Support, during my case Child support is $1768, which is more than my BAH and BAS combined...which is not far at all. Wives are realizing this and marrying Soldiers cause they know the court system will be on their side. In my case she was charged with Domestic Voilence, the courts awarded the wife custody and I pay $963.00 a month.REPORT COMMENTS

I agree. These are entitlements to the service member. BAH is completely variable and is meant to provide housing for the Servicemember. There's a reason it is non-taxable income and it should also be prohibited from being included in child support calculations. It's not right that a Servicemember could be paying child support based upon higher income just because they were stationed in a high BAH area at the time of divorce. As soon as they're relocated the BAH will decrease but their existing child support obligation will not.REPORT COMMENTS

I whole heartedly AGREE!! This is even stated in the following: Title 42 Ch 7 Sec 659; says ?Consent by United States to income withholding, garnishment, and similar proceedings for enforcement of child support and alimony obligations. (h) Moneys subject to process. (B) do NOT include any payment-(i) by way of reimbursement or otherwise, to defray expenses incurred by the individual in carrying out duties associated with the employment of the individual;(ii) as allowances for members of the uniformed services pursuant to Ch 7 of title 37, as prescribed by the Secretaries concerned (defined by section 101(5) of title 37) as necessary for the efficient performance of duty; etc? 3)Title 37 Ch 7; ?Allowances other than travel and transportation allowances? lists items such as ? Sec 401. Basic allowance for subsistence, Sec 403. Basic allowance for housing, etc Please please please STOP adding BAH/BAS into the calculations for child support. Eeven if a military member is living on base & eating in a chow hall their LES states they are receiving BAS/BAH, BUT it is immediately taken away so we do NOT even have this income to provide for any child support. I agree, if anyone had the intelligence to review military regulations then they would know that entitlements like BAS for instance are for the service members ONLY. BAS is deducted from a service member's pay whenever they go to the field, something most states don't bother to understand. And BAH is relevant to the area in which you live, so if you're living in a high cost of living area, how can you expect someone to find adequate housing when their former spouse is taking a large portion of their pay check? And why even consider BAH if the service member lives in government housing? Base pay is the only thing that remains constant and in my personal opinion states are robbing service members of a right to live, especially if they are trying to do the right thing by their children. Don't punish the service members simply because they have a guaranteed income!REPORT COMMENTS

My Ex-wife currently bartends making over 5,000 a month but due to not having to claim cash tips she only claims 2200. I pay her almost 900 a month 600 for my daughters school. I barely have enough to pay my mortgage and eat the way I should and forget about finding someone else in my life, yet she is taking trips to Barhain, Zanzabar and other places.
