    The servicer of my mortgage, Colonial Savings in Ft Worth, TX is giving me a runaround for the loan modification program. I am on a fixed income of Social Security monthly disability benefits. I know that I DO qualify for the HAMP, and my monthly mortgage payment is DEFINITELY greater than 31% of my monthly gross unearned income. But Colonial Savings is saying they have to 'factor back in' 1.25% or 125 percent for taxes! What the hell?? My income has already been taxed!! Either way I figure it, for my 'gross' OR 'net' unearned SS benefits, my house payment is STILL more than 31% of!! Upon approval, how much would my monthly mortgage payment be reduced by anyway - only $137 or even less? And I understand the whole thing will ruin my credit score - which BTW I have been working hard to improve since my bankruptcy in March of this year. And after 5 years in the program, I understand that the interest rate will jump 1% added back? What if I'm never to re-enter the workforce again? How will that increase affect my financial situation at that time? And I read that the providers will get cash-bonus incentives for each loan modification. How corrupt is that?! This is all so egregious! I don't even understand what this "125%" crap Colonial Savings is pulling on folks? One of their staff told me on 11-19-2010 that for every 100 who apply for the loan modification (HAMP) maybe less than 20% are even approved. It seems to be a scam and STINKS all the way around. What's the friggin' use OR hope here if the stupid government doesn't REALLY want to approve or help you anyway?

    I started the process in March od 2009 and it has been a nightmare. I was told in May of 2009 that I qualified for a modification and was put into the 3 month trial program with reduced payments. After the 3 months of on time payments, I never heard back and called to ask about documents to make the modification permanent and was told they were backed up I should continue to make the reduced trial payment. i caled them every month for 6 months and was told the same. Then in December of 2009, I received a letter of intent to accelerate saying I owed the difference betwwen the trial payment and original payment for those months. I called and was told those letters were computer generated and to disregard and keep paying the trial payment. Then in May of 2010, I was asked to send in all the documents and paystubs and hardship letter again and they told me to continue making the reduced trial payment. I kept getting the default notices and was told to ignore them. Then in July of 2010, my home was put into foreclosure. They said it may be delayed because it was in modication review and call back 2 weeks before foreclosure date. I called back at that time and told the date was not changed and keep calling back. I xcalled back every few days up until the day before foreclosure and the original sale was still set. They said they could still delay the sale up until one hour before sale time. I couldn't take the chance, as I had nowhere to go if my house was sold in foreclosure, so I filled bankruptcy to stop the foreclosure sale. They would not accept my trial payments anymore after they put the house in foreclosure. They would only except full payment of all debt, which at that time was around 10,000 dollars. They still tell me its in review even during the bankruptcy. I know that was long, but actually that is just part of it as I left out many other details that make this whole process ridiculous. The bankruptcy court will surrender the house to BOA, but at least I have had time to find a place to rent.

    I have been trying since August 2009 to get my loan modified in New Jersey--a process which was suppose to take only 60 - 90 days!!

    On November 5, 2010 we TOOK - in person - our documents to Prommis Solutions (for Litton Loan Servicing). We had to fly to Atlanta with our documents to request that Prommis accept them and give us written and verbal assurance that they were complete. They did so. Now we're waiting on a decision. We'll go in person to Litton, too,l if we have to.

    Please make Banks more responsible and liable for their unfair business practices against people which are by the way customers. The country is in a deep recession and people are hurting all over in this great nation. There are hardly any jobs and people are hardly making end meet.     HAMP in its present form is a cruel hoax. Lenders/servicers are incompetent liars that should be held accountable for not following HAMP Regulations when taking taxpayer money. Treasury should stop aiding & abetting fraud.

    This national situation is a nightmare, not only fo the loan modication scam if not for all the fraud committed by the banks and all homes gone on foreclosure when the lenders had no standing for foreclose. The homeowners do not know what is going on the foreclosure papers filed on court. Do search, and get an attorney.

    Someone needs to regulate the banks and how abusive they are to the customers attempting a loan mod. There is no recourse for us --we have to "suck up" the abuse to save our home. Chase is horrible - they are purposely delaying loan mods for thier own benefit.
