    Our Mortgage Servicer lost/misapplied payments. Because we did not recieve monthly statements this error went undetected for 18 months. The servicers added thousands of dollars in fees by this time. At that point the servicer attempted to foreclose. We disputed the court action and the mortgage servicer stopped the court action, but delayed us in our attempts to rectify the issues. When we presented clear evidence of timely payments we were given excuses or ignored. All the while they continued adding fees. Finally the loan was sold. Through three additional servicers/loan holders we attempted to find the trail of where our funds had gone. As we made payments to these servicers, they took our money and used it to pay the fees they were adding to the loan and did not apply it as payments. Each servicer continued to added many fees and report our loan as delinquent. All the servicers did not return many, many phone calls. It took thousands of dollars in attorney's fees and alot of luck to finally straighten out the mess that servicers had created. Is this the United States of America, or some third world contry where anything goes? Pass real legislation that makes the mortgage servicers and loan holders play fair with their customers. This is not a hand out request, but a demand to level the playing field. Right now, the loan holders and servicers hold all the cards in a game where they write all the rules. STOP THIS FROM HAPPENING TO THE AMERICAN PEOPLE!

    Our loan documents are about 60 pages of protections for the bank..and where were our protections? The average person trusted the bank to guide us through THEIR process. The average person is not a lawyer. I was told by the the IndyMac loan originator that our construction loan would "roll over" into a perm mortgage - just re read the paperwork...it's an ARM. IndyMac lowered our appraised value (internally) when the property rates in my community had not gone down and refused to give us the rest of the money to finish our house but charged us 8.75% interest ....big monthly payments and we had to finish our house out of pocket... a second, credit cards, lines of credit.....IndyMac has refused to modifiy terms. Filed Chapter 13 last week to stop them from taking our home. And the big question is will they modify now? It can adjust up to 13%.

    It is just wrong for servicers to be paid higher fees for foreclosing and reselling than they are paid for actually helping struggling home owners. What is their incentive to actually help people keep their homes ??

    I'm suing Ocwen Federal and First union National in Vicksburg, MS. I was offer 50,000 with my exlawyer Bridget Clayton and 600,000 to 1million without her. It is hard to gain trust now. You can Google Ocwen Federal and see all the suits agaianist them. One case won 3million the other 11.5 for the same thing they did to me. Here is a short BREIFING. SHORT BREIFING ON Oct 3,2003 at 8:30 in the morning. Ocwen Federal Bank put my family on the front lawn of my home in Vicksburg's,MS. I live in a well name community call Fairways in Vicksburg. I Ouida Claiborne have every payment that I have ever paid with MONEY ORDER since 1998 when I bought my home. I had Bridget Clayton for a lawyer, but she didn't know what she was doing. I dismiss her cause she want me to take a lower settlement. I'm Pro-se as of now. The judge is not respecting me cause I'm not a lawyer. I went to court in VIcksburg ,MS. And the judge in Vicksburg told me that I did pay no notes. If I didn't why want he look at my payments. Ocwen lawyers told the judge that I haven't paid anything. I file an appeal in the next court up. My family is not going to stop fighting Ocwen. We are going to file appeal after appeal. No my home is just sitting there since 2003 for the judge in Greenville ,MS. Stop them from selling our home . Its up in court now. '''Ocwen did make a selement with us, but they only want to give us 50,000. that is nothing when a family have no home, Ocwen mess up my credit, and no one want to rent cause of Ocwen. I Pray to God that one day my case get settle right. There are more people in the US against OCWEN FEDERAL BANK...........I filed an appeal and keep paying money, but the Judge want let me speak in court. He keep doing whatever he wants.     I had and have excellent credit so far! When I bought my house the bank said they would finance if I could not pay the loan off in 2011, Now they say they are not refinancing at all because I'm self employed and have stated income, my payments are $2000 per month and I have never been late in 3 years or ever for that matter!! HELP>>>

    A homeowner is a homeowner. It should not matter if you live in the property or not. You own the home, you pay the mortgage and when you get into a situation where you need help, i.e., property goes underwater, income decreases, etc., lenders should help. A mortgage payment made is a mortgage payment made. When the economy was strong, Lenders were not refusing payments on rental properties, they were lending on rental properties and now when the "owner" needs assistance, the Lenders want to play the rental property card and don't want to help. It is property owners like us who give families a safe place to live.

    I bought my home in August 2009 for $318,000 and put $30,000 down; I have found myself in ownership of a home that has lost over $100,000 in value in 14 months. I began to sink underwater shortly after I purchased this home, and took on the responsiblity of raising 2 teenage half-siblings who were living destitute in another country. In my caring for them, along with my 9 year old daughter,I incurred a great deal of living expenses much of which were covered with credit cards and savings. At this time, in my efforts to help them and live, I have maxed out each of the 3 credit cards I have, and I have depleted my savings entirely, including borrowing on my retirmenet accounts depleting them completely. I was a person who bought my second home responsibly, putting down $30,000 at the closing table, qualified for a conventional loan, and made at the time what I thought were intelligent home buying decisions. When I began to struggle with paying my $2400 mortgage and my $500 minimum credit card payments for 3 visas, in addition to a home equity loan and a major student loan, I contacted my mortgage company and requested a hardship. I explained my complete circumstance and submitted all the requested documentation. That was 6-7 months ago. I have paid mortgage on time, sacraficing eating, living and paying other bills. I am totally behind on things and I have barely enough money to feed my family after I pay the bills I am responsible for paying. I requested a loan modification. I was told no, I didnt qualify; my gross income as compared with my mortgage represented 29% as opposed to the mandatory 31% for modification eligiblity. I am 2 percentage points away from assistance. I have received nothing. Sadly, I am now faced with walking away from my home, as have millions of Americans. My bank as the servicer with Fannie Mae as the owner, say they cannot do anything for me. I am stuck with a home that is worth far less than I paid for it and owe, and a mortgage that I can no longer afford. The bank has suggested that I ask my siblings to leave, and put them in the street so that I can pay the mortgage. They too are American citizens, and I should put them in the street so that I can pay my mortgage for a home that is now a major financial loss. As a public servant of the federal government who works for a major federal government agency, a person who has strived to be responsible and dilligent, I feel that my country and government has failed me. There are thousands of Americans who are facing a variety of hardships and we are not receiving help, despite our continuous pleas. The flip side is that in order for us to discontinue drowning under water, we must pack up our homes, and hopefully find another place to live, and suffer from bad credit for 7-10 years, which means limited to no means to live, rent, eat, own a car, or even qualify for certain jobs, etc. I did everything I could and paid my mortgage on time non stop even when I was at my low
