Since our community was annexed by the city, the HOA's only responsibility is to maintain the drab common areas, which are tiny corners that consist of sparse trees and gravel. I am astounded at how 20% of the population can be subjected to this private property management system that is supported by legislative schemes that are all-but drafted by the corporate owners of these associations, and a judiciary beholden to those interests that has lead to a national epidemic of abuse and corruption that is tearing apart the lives of thousands, but gets little or no coverage by the national media, or even local media, and nothing more than lip service in legislatures across the country. The question I keep getting is "what can be done?" The answer is both simple in its identification of the solution, but a bit more complex in how to achieve it. One simple solution is to just ban them. This property ownership and management system, under the guise of "freedom of contract" takes all government accountability out of the equation, and leaves millions of Americans subjected to the whims of appointed boards with sweeping powers to fine and sanction homeowners, and foreclose on homes for violations of HOA rules without adequate judicial oversight, and in accordance with full due process protections. It turns law enforcement power over to these private corporate boards, and allows citizens to lose their family homes in matters as miniscule as a few hundred dollars in as unpaid assessments or "fees" with no real due process protections. It turns the core functions of municipal government over to private corporations, with no power of the vote and no public accountability - it is, in essence, a form of corporate autocracy, and that has no place at all in a country that was formed as a constitutional republic. banning altogether may well be an appropriate remedy. As I have said, however, I am somewhat new to the issue - it has all been revealed to me over the past couple months of my campaign - and I have not been fully versed in the alleged benefits of these HOAS, and, having heard and learned most of what I have from those being injured by the abuses, would need to listen to the opposing views from the proponents of this system, and the laws that support them. I know enough to know, however, that this system is in need of some serious attention, and serious reform, and it is a national problem that would be an appropriate field in which the U.S. Congress would have constitutional power and authority to act. I am so disgusted with Williamson management. This management is HORRIBLE!!! They do nothing for homeowners and their customer service sucks!!! Bad attitudes, don't follow up or return phone calls. They are known for doing "back-door deals" with their buddies and also allow some homeowners to break the bylaws and don't send out violation notices when neighbors make complaints. Here in Florida there is no real "regulation" of these HOA dictators. Homeowners are left to hire lawyers and defend themselves. It's a racket...it all feeds into taking more money from the homeowner held hostage by the HOA. It's taxation without representation at best. I understand it's original intent, but it has severely veered left of these intentions. Working with an HOA and it's affiliates garners stress, animosity and at times rage between the parties involved. There is no democracy involved in decisions made. And my bottom line is if a homeowner is putting their hard-earned money, time and effort into the place that they purchased, why does a racket like HOAs have such a HUGE say-so in so many personal matters?! I agree that HOA management has, in many instances, become a profitable enterprise for those who have little regard for the people they harm. I read one comment in which the home owner owes "$140 ... $66 of which is for 'late fees'," and the HOA is threatening foreclosure. Do we really live in a society that allows that to happen? [I know that the answer to that question is: Yes, we do.] It is time to stop the fleecing of home owners. Not only should HOAs be shut down, but condos need to be regulated better, too. I live in a jurisdiction where liens can be placed for unpaid condo fees, fines and penalties and can usurp the mortgage for first position! Prosecution and jail time should be meted out to anyone found guilty of mismanagement or improper business practices with regard to HOAs and condos. Our legislators need our votes, so let's see how they vote on this issue. I vote to dissolve; but also, I vote to hold the culprits accountable for their wrongdoings (including requiring reimbursement of mismanaged funds).REPORT COMMENTS

I was a director of a HOA for about ten years and continually fought a losing battle with the other directors and management company to act responsibly for the community. I am getting old and just gave up the fight. Decisions were especially unfavorable to town home communities. The town homes pay county taxes and must pay again for neighborhood amenities that single family homeowners receive as part of the taxes paid by both the townhome owners and single family owners. The Woodmore HOA mismanaged by Pleasant Prospect CVI is the worst and they should be removed.
