As a female, I do understand that there are many legitimate domestic violence cases. But unfortunately, there are many fabricated cases in order to gain personal benefit and been protected by our dearest judicial system to obtain whatever its takes such as; protection order, immigration status, subsidize rent, or pure malice greed, revenge to former spouse/family federal mail tapering, innocent people been accused. -

Why are men considered guilty until proven innocent in this area? One of the cornerstones of our legal system is the concept of innocent until proven guilty. This is critical because people lie; it's as simple as that. I sympathize greatly with victims of domestic violence; such situations are horrible. I have personal experience as a child seeing and experiencing abuse. But, even with that background, I know that does not make it okay to punish someone without proof simply because of their gender. The pendulum has swung too far in the other direction and in an attempt to protect the perceived victims our legal system has become very unfair and sexist against men. It should be possible to protect victims of crime without punishing everyone accused by a possibly dishonest person who gains advantage by lying. Not every person claiming to be a victim is speaking truthfully. Why is that simple fact being over-looked?REPORT COMMENTS

I could not say it better. But also add that when it's a matter of self defence, it becomes even more unjust for the accused even when there is clear evidence to support the self-defense claim. These people who falsely accuse people are taking away precious resources from the people who truely need them and do so without any punishment when/if they are proven to be vengeful liars. The police can make false statements in their reports to the da's office and not be punished and the DA can submit motions to amend anytime they feel without any evidence being able to be argued and the accused has 0 recourse to fight these claims often being thrown back in jail then and there because the judge is to scared to say no and the bail goes up. Charges are added and the DA doesn't even have to investigate . Enough is enough people, something has to be done. PD have a caseload that suffocating them. The DA has everything at their disposal. This kind of injustice can cause the most law abiding person to become criminal from the treatment they endure especially from the punks in the booking process. Being subjected to that kind of inhuman treatment and conditions should be a crime in itself. Not correcting this injustice and not taking the millions of dollars that these "victim advocates groups" get pumped into out of the equation will only feed this out of control monster that has been left unaccountable for the injustice being done to the the falsely accused and the lives that are ruined by them. These false accusations have to stop I was falsely accuse of domestic violence when i was the victim in the case it was caught on camera and I filed charges also the judge granted my protected order and denied hers against me because of the facts on the video 1 month later I was arrested and charged with domestic violence and giving a bail for the same charge I beat 1 month earlier the state attorney in the case wouldn't hear my case because of a reason I yet to find out from them although it was caught on video this last time it wasn't the first time this had happened to me with the same person I'm tired of men getting the blame when some of these women are just at fault as menREPORT COMMENTS

I could feel inside of me what my son was going throuht. My heart was like if it wanted to come out of my chest. My older son also felt the pain of his little brother. He said "MY BROTHER IS ALIVE, IT'S WHAT MATTERS ". We knew that this nightmare would be over one day. We spent that night in my house flat roof clamouring to God, looking into the sky. Because what we knew was, that God was listening to us. From the beginning His angels were caring and saving my son from dying. I was only clamouring because I wasn't able to be there caring for him. I have no words to describe the pain I felt. But, God said to me "GET UP OFF THE BED AND LOOK FOR ME, BECAUSE YOUR SON IS ALIVE ". Therefore so, day by day I went to church praying to God for my son, knowing that God's justice will prevail and the truth will come to light. Permitting that U.S. Embassy gave me a visa, I arrived to the United States. Those were the longest ten (10) moths of my life. I saw my son through a little crystal window. We look at eachother, we cried and I told him "I AM HERE NOW ", "I AM HERE NOW ", "I WANT YOU TO KNOW THAT YOU DID NOT DO ANYTHING, THE ONE WHO DID IT, LEFT ". He said, "THANK YOU MOM ", but he maintain to himself in silence and did not say anything else. He was like that for two years, under strong psychological medications. When I went to visit him, he did not speak or think clearly. He fell asleep putting his head against the little crystal window,and could tell by the saliva coming from his mouth... that was so, so painful. He never talked, and like that he was presented to court and sentenced to more than three (3) decades in Florida States Prison. Florida 2013. Once in prison, I gave thanks to God for listening to my prayers. To be able to hug my son for the first time. To see his smile and his desire to fight and look for justice. I gave thanks to God for preparing me much before my son confessed to me the occurrences from that day. Yes this is a continuation the fact that I don't have a criminal record this is amazing to me that they will haul me off to jail like that then tell me I can't go back home she got a extended restraining order the next day when I got out on bail she told a coworkers stating that the reason I went to jail was that I own some people lot of money and they had police pick me up the difference between the truth and Lie is that a lie you have to continue lieing and it always be different story the truth you remember 20 years from now it will be the same story the truth is I didn't act like that angry black man who turned it and who's supposed to turn into this monster guy that didn't happen at all so she put in her report even the police came 3 times that I seem very comfortable with the situation then at one point she put another report that I was threatening but I didn't go for the bait she was trying to provoke me you know I have a hard time trying to figure this out what would make a person falsely accuse you of battery a person you've been sleeping when I can't imagine doing that to somebody oh yes this happen in Orinda California and she is continuing slandering me my name and reputation but I can't communicate with her she going through a third party I mean this is a nightmareREPORT COMMENTS

Yes this is a shame that this could be perpetrated on innocent people I was accused of domestic battery by my live in girlfriend who I told I was unhappy and I was packing that night and will be moving out the next day well after 3 police call the third call she claimed I pent her against the bathroom vanity which was a lie never touched her no use for profanity against her they haul me off to the jail had to pay bail emergency restraining order now I'm homeless and there's nothing to be done about that but I'm going to fight it and I went to the police department the city that it happened to file charges for false arrest false charges and they are like they didn't want me to do that then I found out that once you file false charges against somebody like that that mean you including the police because they had to be the one that from their judgment this see some kind of abuse. Found out some information from a good friend of mine that used to hang with my ex girlfriend. My ex girlfriend has a pfa on me for rape and assault. But here is the starting issue....there was no proof...yet alone no rape kit done to prove this....but the pfa went through for three years....just recently though I found out from a real close friend of mine that she talked to him and told him that she lied about everything she accused me of on the pfa. ..now that I have a reliable witness....I don't know what to...and I don't know much about the court system but it would also be nice to know how to go about stopping thisREPORT COMMENTS

I am no longer able to see my children after an argument occurred, the police came and informed my children's mother that unless she was hit or put in fear, they couldn't do anything. The officer mentioned that several times and intimidated my ex to press charges and make up a story and let the judge figure it out. My ex is a horrible addict and as a result of everything, she received, subsidized housing, exposed the children to situations that were not necessary and caused long term psychological damage to everyone. She did recant the story but the courts say its typical for an abused woman to recant. No support, no justice and more important there's no doing what's in the best interest of the children.REPORT COMMENTS
