Not allowed to speak, face your accuser, plead guilty or go to jail at the whim of a judge and Cops that could care less. Protective Orders / Restraining Orders ARE the abuse! Thanks US lawmakers.... for giving manipulative people everywhere plenty of tools to destroy the lives of innocent law abiding citizens. This isn't rocket science... STOP taking court action against US citizens, unless and until, they have been proven guilty of a crime in a fair court of law... with due process. There are many witnesses to The fact that this girl has never been harmed and That she actually has caused mental abuse To my son as well as spit on him, cheat on him But the only thing the court sees is her lies. Its Sad you can just make up things about a person With no proof and ruin a good person's life. Something has to be done to stop the abuse of this law. This girl needs real help. She has abandonment issues and parents who Do not want to parent. They cant look in the Mirror and see where they were not there for Her. I told my girlfriend I didn't want to be with her anymore. She began to get angry and got in my face and started scratching my arms and neck. Then she walked away and started throwing my stuff towards the door telling me to get out. I walked over to get my things and she began punching me in the face. I did grab her arms to get her to stop punching me, and I just told her that I'm done with dealing with her mental illness. She sat on the couch and called her dad. Her dad called her mom. Her mom called her aunt and told her to go get my girlfriend. I was already gone by the time she was on the phone. She says she never even talked to her aunt until she arrived. When she refused to give the police a statement they told her I'm going to jail either way. So she gave a statement admitting that she scratched me, punched me, and broke my things, along with me grabbing her arms to stop her from hitting me. An hour later I was detained at my dad's house by local police until the police from her town got there to arrest me. I asked the officer why I am being arrested and he said she had marks on her that I put on her (there were hand marks from me trying to stop her from attacking me). I was taken to jail and posted bond at $1,004.00. The following Monday I had an arraignment and she asked the judge to lift the no contact order. She also told the violence advocacy that she was the abusive one and that I did nothing wrong. She told them how a 4th party had called the police. They said they will tell the judge and he will take that into consideration. A week or two later, I had to appear in court again, this time with a public defender. He went in and talked to the judge. He comes back out and tells me that I should take a lesser charge. I told him I'm innocent and don't want to take a lesser charge, where he strongly advised me to just take a lesser charge because if not, I would be drawn back to court for pre-trial 1 and possibly multiple pre-trials. I had only been at my place of employment for 6 months and didn't have any vacation days to fight this charge. I took a lesser charge, and had to go to a behavioral center for an assessment. They said they do not think I have any anger issues. So that was the end of that. We ended up getting back together and our relationship has been good ever since. I do not blame my girlfriend or her family for me going to jail. I do not blame the police officers for arresting me. I blame everything after that. I was treated like a criminal while in police custody. Correctional Officers harassed me, calling me a piece of******and yelling at me for no reason while in holding. The court did not want justice, they wanted to charge me. They knew, from the police report and the domestic violence advocacy, that I had done nothing wrong. They also know that most people do not have time or money to fight the case. They had me in the palm of their hand, and did nothing to give justice. I too am a victim of a woman I dated shortly who falsely used the system to destroy my life. 2 days after I asked her to move out; my civil liberties were all violated severely when arrested on virtually everything in the book - though she didn't have to provide proof of any of it prior to a warrant! She "legally" stole everything I owned (by having me thrown out). She committed perjury multiple times throughout the process - with NO repercussions. She "bragged" about what she was doing to me, all my belongings, & my life - yet NONE of this was admissible in the trial. *My trial ended in a hung-jury (polled 11 acquittals to 1 in my favor). However, my lawyer demanded another $25K for another trial?? Shouldn't have I gotten another trial for free, since I was now broke? Nope-I was talked into taking a plea for misdemeanor DV charge - not knowing the plethora of consequences that would have. *I have never been accused of such a thing before or since (it's now 6 years later). *This STILL has left my life in ruins as I STILL cannot get gainful employment (in CO it stays on your record for perpetuity). I'm living with my parents as a 42 year old, taking whatever employment I can, although I used to be a Regional IT manager, honorable 5 year USMC vet, have a B.S.B.A degree, etc... *I'm told now that starting my own business or staying with small companies that don't do background checks are my only options until the laws get changed... *WHAT an injustice - as this has destroyed me financially, my self-esteem, and I ended up with PTSD from this whole ordeal.. A few facts about Protective Orders / Restraining Orders: 1. Every initial Protective Order / Restraining Order is issued with NO trial, NO due process, and NO burden of proof... simply an accusation of fear or abuse.... simultaneously, if it is PROVEN that the "accuser" lied under oath and falsely accused, they are guaranteed to NOT be prosecuted! Yes, if the "accuser" admits that they lied under oath, they are still guaranteed to NOT be prosecuted for it (its felony perjury, but never prosecuted for domestic orders... NEVER.. try and prove me wrong). 2-3 million Protective Orders / Restraining Orders issued every year in America and NEVER a prosecution for lying to get one... and EVERYONE knows it.... that's why they don't think twice about lying. 2.Protective Orders / Restraining Orders are the common "go to" tactic in a HUGE number of divorce situations. These orders grant the supposed "victim" possession of the house, cars, and often times custody of any kids... based ONLY on an accusation! Very often, the "accused" doesn't even know they're being accused of anything, until police show up at the front door! This is now common knowledge.... its a matter of: who gets to the courthouse first? The FIRST one to accuse the other of abuse, gets the upper hand... and this happens EVERY day in EVERY courthouse in America! 3. Protective Orders / Restraining Orders are NOT 2 way orders.. at least not in Virginia, where I live. What I mean by that is: The supposed "victim" can contact or harass the supposed "abuser" any time they want... that is NOT a violation of the order. As a matter of fact, if the supposed "victim" (petitioner) calls the supposed "abuser" (respondent) on the phone, the "abuser" (respondent) is now in violation of the order, and could be facing a year or more in jail!... Yes, for answering their own phone!.. that is straight from a magistrate! The "victim" (petitioner) can NOT be held accountable, because they are NOT bound by the same restrictions!... Can you say manipulation? This happens all the time... how do you think I know? Protective Orders / Restraining Orders are NOT 2 way orders ... they are ONE WAY ONLY!.... ridiculous! The truth is: the overwhelming majority of these domestic abuse orders are lies and tools for manipulation and outright theft of personal property!... and our government has CAUSED this!... anyone can lie, but when our government takes court action on US citizens based on NOTHING but LIES and then refuse to EVER prosecute, that's not the false accusers... that our LAWMAKERS!!! This has been going on for a LONG time! They have had plenty of time to fix this.... the time is NOW! 4. Dealing with my fiancƩ's ex. She ha's made false allegations of abuse. He was not arrested and she had no proof that abuse occurred besides her testimony. It was brought to the judges attention that the case was based on no evidence but hersay. The judge said yes but still issued a restraining order. There is descrepencies between here testimony of events which illustrates that her story has changed over time. She has used the restraining order to prevent him from seeing his son and she has repeatedly violated the restraining order. She is mentally ustable, she mentally incompetent, and on social security disability. She has bitten my fiancee so hard that it has left scars and she has gone as far as hitting while he was holding their child. Yet she can claim that she is a victim. The courts have not held her accountable for her actions, if he would have violated the restraining order he would be in jail. She ha's had no consequences for her misconduct.REPORT COMMENTS

i just spent 6 months in ohio prison. i believe i was sent based on my prior incident of dv with my ex wife 10 years ago. despite no evidence ever provided to my attorney in this case, her desire to charge me was enough. i simply tried to move out of her residence and she tried to prevent this. i was looking at 2 to 5 years on a felony three, on the advice of my atty, i plead to lesser charge to try to get probation. this action against me cost me my job,my union presidency my pension, my benefits, my home, my car/truck and my reputation in a community i volunteered my time to youth athletics including her children..to me this isnt justice and needs to be corrected. i have three grown daughters of my own, and support domestic violence. my wife of 25 years hurt herself trying to exit our truck when i confronted her about cheating on me. i accepted responsibility of that back in 2005. i rebuilt my life from that felony conviction just to be torn down again by a scorned woman who desired to continue our relationship as is, instead of marrying me. all i tried to do was move out of the relationship which contradicted our religious beliefs.REPORT COMMENTS

That I stared at her video camera for 10 seconds, and that constituted harassment. Also returning my children's personal belongings, and hers, constituted criminal mischief. The abuse of these laws only hurt the true victims of domestic violence, as courts more and more become numb to who is a real victim, and who isn't. I was falsely accused of domestic violence. I had a final restraining order affirmed by a superior court judge against me, because he disallowed evidence into the case that culminated in child protection taking our 2 year old son into state custody. After 3 weeks of state custody of my son I could finally care again for him again. The state turned out to be a very poor replacement for a loving family. The domestic violence law in it's current version is not able to safeguard children from mothers with mental illnesses instead it is enabling child abuse.REPORT COMMENTS

I got out of jail the next day to find a love note from her in my truck that she left outside of the jail, and three days after I got out of she began trying to contact me and sending me naked pictures of herself saying that she loved me. Since all of this I have found out that she has done this to at least 3 other men. I have been treated as if I were the lowest form of human by Johnson County Kansas. This is so true. I brought my ex to this country with the purpose of having a family. Within a week of being in the US she totally changed. The was the abuser in the relationship and not only that she would also abuse her son and would beat him up really bad very often. I had to call child protective services and she almost got arrested. She hated me for this and now she went to court and made false allegations and she got a order of protection. A few weeks later she called the police and told them lies and they arrest me for violating the order. Nobody ask a single question, they just took her word for it. I have spent thousands of dollars on lawyers and she get everything free. She left the home taking my son with her and she got in a shelter and now she's claiming that she's the victim. I know she's trying to gather evidence to try to get a green card as a victim of domestic violence. This law is stupid, it allows women to lie and to get a green card based on just their testimony. The system is horrible. I am lawyer and am amazed as to how the DA's office will set you up with a lopsided investigation and simply take the word of the accuser and arrest you without further evidence. This is even after the fact that the alleged victim testified to inciting violence and beating me up several times, the DA's office is merely interested in seeking convictions even if it ruins your life. You are forced to go to trial, and pay thousands of dollars before you are even allowed to speak. On top of that, the DA's office is given complete prosecutorial immunity, even if they twist the evidence, bring false charges, withhold evidence and engage in other misconduct, all in the effort to get a conviction and continue funding for their DV departments. My husband was jumped total of two times in one day yet he is being charged with some serious charges! Both his an mine statement some how disappeared an or being over looked. While the two who jumped him are free to live there life. The charges were dismissed about eight months ago due to the two not showing up at court yet they were allowed to refile charges. Next court hearing my husband was unable to attended due to the fact he was incarcerated cause of the charges so it was continued yet once again. Next hearing the two were a no show including the arresting officer an still it has been continued . The police report was far from factual an my husband remains in jail . I have been railroaded, because my ex girlfriend's son is a New Orleans, Louisiana police officer. It is the most traumatic thing in my life that has happened to me. I haven't done anything I've been charged with. I just believed in my heart that she has been helped by the system, because her son is pulling strings. I don't believed that this is really happening, it sometimes feels like a dream, but I know that it is real. I feel like Jesus when He was falsely accused and then crucified. It's not just domestic violence that is a problem, it seems anyone can cry wolf and have someone thrown in jail, sent through a drawn out court process, and paying thousands to prove they have been falsely accused. The new strangulation law in VA makes it easier than ever to ruin a persons life just by making a report. Not only were the accusations made lies, but it was their way of having me removed from the home. I do not understand how a judge could approve a domestic violence restraining order based on I caused someone else to make threats. I was falsely charged with domestic assault and actually could afford a good lawyer. He originally asked if I'd go to jail for 5 days and take a peace disturbance. I told him I would but guess the PA wouldnt agree so the offer was take an SIS and I refused. 12 months later after being out of my home it was court day and my attorney said I'll fight for you but the only certainty of a non conviction was to take the plea. I tool the SIS and have no problem with the programs I have to atttend or the 2 years supervised probation. What I have a problem with I didn't fully understand the impact it would have on me later living with the fact I took a plea on something I didn't do. (no evidence, just her phone call and false statements) of putting my hands on a woman. And yet she gets to do whatever she wants and all the PA wanted was a win. My life was also ruined by this. Don't take any type of plea,nolo or deferal. It counts as you pleading guilty. It is what they offer poor men who can't afford to goto court. Everyone will lie to you, the DA,the judge, and your lawyer, saying after a certain time it will be dismissed. I promise you it will never truly go away. You will never hold any type of professional license, adopt children,hold a government position or work any were that checks fingerprints. Domestic violence is big business...this will only get worse. (See woman from Gary Indiana who is trying to make it so we are added to the sex offender watchdog list) States also receive federal funding to make these unjust arrests. see: (VAWA 1994 federal funding guidelines) I hope someone reads my post before falling for the deferall/nolo scam.
