She will not be considered a resident of SC because we don't have a green card and she will not be eligible for in state tuition. We are made to wait for nearly 8 years just to get a green card even for the highly skilled category whereas people from the rest of the world would have their green cards processed right away. Even China, the most populous country in the world, has fewer years of wait time compared to us. You might probably feel this is okay, but when a tragedy strikes, you are still expected to continue to work and do excellent work, which is almost like bonded labor or risk being fired and sent back.
