I agree that lots of software companies are now using this as a loophole to find a way to keep people onsite long-term especially since H1B processing has become stringent due to checks on employer-employee relationships. I am an Indian with an MS from USA waiting in the EB2 queue. There is no reason why Infosys, TCS, Wipro, and Cognizant should be allowed to misuse EB1 category whereas those who have studied in United States at the graduate level are required to wait for "years" to get their employment based green card. The immigration system in US is badly broken and the politicians are playing all the politics they can. Not Only EB1 but EB2 Also have frauds in them. Almost all the applications in EB2 are not qualified to apply in EB2 (Indian IT Consulting Firms located in US (millions of them) do this faud). If you do education background check and employement background check you can easly find it out. A person in IT that shows 8 years experience in Resume will have only 1 year of experience and in most cases that person will be a fresh Masters Graduate in other science background (Not from IT or Computers) getting 2 months of training in that technology.REPORT COMMENTS
