Ten years ago I got into a fight at a bar. This big guy tried to attack me from behind but I caught him at the last moment and ducked his punch and landed mine. The guy was 6'6" and weighed 240lbs. I am 5'8" and weighed 180lbs. My punch knocked him to the ground and naturally, being a lot smaller, used it to my advantage so I punched him again. While he was down I took off running before he could get up and pummel me. I stood at the side of the bar waiting for my friends so we could go home. Instead I was met by cops and arrested for assault. On the way to the hospital the guy had a brain aneurysm and died. That automatically trumped my charges up to involuntary manslaughter. I fought it but ultimately lost the case and went to prison over a fight I didn't even want to have. I have been released from prison and don't think it's fair that I paid my debt to society but I am still viewed as a social outcast by many potential employers. I don't care what regular people think of me but this has cost me many jobs. I paid my debt. I was convicted by a jury of my peers and handed down a judgment that I fulfilled. This is the only trouble I have ever been in in my whole life and I don't think it's fair that I took the punishment that was handed to me by the law and yet I'm still being punished for it. A friend's son, in his early 20s, was walking down the street and stole a can of gasoline from the front of an attached garage. Had the can been sitting two feet out of the garage, it would have been a misdemeanor. He had no previous legal trouble at all, had recently had family issues and moved from his parents middle class home. He was a normally nice kid, good student and law-abiding citizen, going through a confusing and discouraging time of his life. Recently jobless and broke, he gave in to a stupid impulse. He got a public defender, whose own son had recently been convicted of crimes and who was very bitter and angry. Instead of counselling this young man and arranging to have him plead to a misdemeanor (I work in the local criminal justice system and I know this is routinely done for even multiple offenders), she took out her own parental frustrations, frightening him so badly that he didn't even show up for court, fearing he would be carted off to prison immediately. So now he has a felony conviction. He did his jail time, served his probation and hasn't gotten into any more trouble and is shaping up (at 27 now)to be the fine young man he was headed to becoming before. But he will always have that felony conviction following him around.REPORT COMMENTS
