    I am a Police Lieutenant/Watch Commander with the Marine Corps Police Department. I joined the department when I was 36, but because I don't qualify under the: Title 5: Administrative Personnel CHAPTER I: OFFICE OF PERSONNEL MANAGEMENT SUBCHAPTER B: CIVIL SERVICE REGULATIONS PART 842: FEDERAL EMPLOYEES RETIREMENT SYSTEM-BASIC ANNUITY Subpart H: Law Enforcement Officers, Firefighters, and Air Traffic Controllers 842.803 - Conditions for coverage. (a) Rigorous positions. (1) An employee's service in a position that has been determined by the employing agency head to be a rigorous law enforcement officer or firefighter position is covered under the provisions of 5 U.S.C. 8412(d)." I am basically limited to 0083 Police Officer positions as career options if I want to remain in the Law Enforcement field. Although I am proud of the position I hold, and the importance of my duties, I would prefer to have the option of applying for positions in the 1811 field or other "Title 5 U.S.C. 8412(d)" covered positions. I perform the exact same functions of my LEO colleagues, as defined by the very "position description" I operate under, but I am not granted the same opportunities. General employment "fairness" aside, I should be allowed to pursue employment in those other ?Title 5? covered positions simply because I chose to do more for my Country and the safety and security of our citizens. The fact that the OPM specifically singles out the 0083 series as not being included in the Title 5 coverage?s, but an Air Traffic Controller is seems almost ludicrous in its very nature. I put my life on the line every day that I put on my uniform and run towards the bullets while others are running away. Why then, am I not granted the same opportunities as those that are covered when I am performing the exact, if not even more dangerous job, than they are? A serious re-examination of the inclusion of 0083 Police Officer's into the Title 5 U.S.C. 8412(d) coverage needs to be made, since it is our lives that we have chosen to place in harm?s way, to be the ?first responders? in the event of a crisis such as was the case when the terrorist attacks of September 11, 2011 occurred. If the 0083 Police Officer position were to be retroactively included into the "Title 5 U.S.C. 8412(d)" coverage, I would be able to pursue the positions that I feel would benefit even more from my knowledge, skills and abilities. I want to do more for my country, but the unjust limitations of the "Title 5 U.S.C. 8412(d)" exclusions have made it impossible for someone like me to pursue loftier positions. Please re-examine the reasoning behind not including 0083 Police Officers under the "Title 5 U.S.C. 8412(d)" coverage and reverse the decision. It is simply put: unfair and unjust and limits the professional pursuits of Police Officer?s such as myself from being able to do more for their country than they are allowed under the current statutes.     0083 Officers place their lives on the line everyday just as much and even sometimes more often then the capitol police do, but yet they don't recieve the same retirement. Just because they are not protecting the senators or congressmen doesn't mean they are not in danger or greater. Please do what right and truely show your appreciatation for those protecting our homeland.
