As a foster Mom I am the first to support reunification---if a parent has shown they want to change and they do the work to do so. But if, after a year's time, they continue to make the same wrong choices, the child's rights to security and permanency should trump the parent's rights to get chance after chance after chance. Agencies and judges routinely ignore ASFA. I had a child placed with me under a "safety plan" by the county child welfare agency. The first 105 days (3 1/2 months) of her stay "didn't count" because it was during the "safety plan" period. The child had been removed from the parental home, but the agency justified excluding that time "because the biological parent's attorneys would argue it". Ok. Add another 15 months of continual foster care; the child had been in my care for a continual 18 1/2 months. Was TPR filed, per ASFA? No. How about at the next hearing? No, although the agency asked the judge for a "goal change". You'd think that at that point, the child had been with me for 21 months - well past the ASFA 15 month rule - and the judge denied even a goal change, despite minimal progress by either parent. The child was in care for 25 months before the agency was able to file for a TPR. And just because they filed it, doesn't mean it happens the next day, it doesn't. From start to finish, the child was in care for 30+ months. That's 30 months of uncertainty, lack of permanency, of dealing with restrictive rules that prevent being a "normal" child, etc. Why so long? Because there's no oversight as to how long agencies and judges let children wait for their life's direction to be decided. ASFA has no teeth in it.REPORT COMMENTS

More people would be willing to be foster parents if the risk of losing the child would be minimized. I'm fine with rehabilitation and reuniting but there needs to be an enforced time limit.
