The following opinions I am about to express, result from my own personal experience. More importantly, these are meant to address situations in which the child is not directly being abused. I am not addressing other serious situations where there was forced sexual assault, violent battering, or any cases with actual weapons, or any other crimes of this serious nature. I am referring mainly to two parents who have unresolved conflicts which have escalated into potentially harmful and violent situations. These are parents of children. And are the people who need serious help. They should not be criminalized. This is a category of domestic violence which should be treated conditionally, and with care to keep the child safe from the environments which the parents mutually created. In these situations, the child should never be isolated from one parent or the other. The child should be allowed to continue the otherwise healthy relationships they enjoyed with each parent individually, prior to the break up of the parental relationship. I haven't seen my son in 7 months. My wife left in late may of 2014, with our son, then 5 1/2. She left me with a ton of debt, and I fell into severe depression and anxiety. I was subjected to continued emotional harassment. Unknown to me, I was ostracized from friends, family, and neighbors, by the slow establishment of stories she would tell others about what was happening in our home. Using the stigma of drug addict and abusive husband, I was profiled publicly. By the time I found out, it was too late to defend myself. I was left without any financial support, near zero communication, and I had been completely blamed for everything about her life that my partner was unhappy about. My biggest mistake was not being outspoken about the abuse I was subjected to throughout the 17 years of our marriage. The few people who truly know me, understand I am not the type of person the petitioner claims I am. Now The courts have granted her petition for a full protection order, and have refused to acknowledge any of the obvious, authenticated evidence to the contrary that I have presented. I was rushed through a hearing, only minutes after being presented with, for the first time, a stack of papers representing a request for a full divorce. Prior to that moment, I was holding on to the fact that I had only ever been served with "separation" papers. Having to face the full disillusionment of my own marriage and family only minutes prior to our hearing, was so emotionally crushing, I found my self severely compromised, and unable to properly represent myself. The Judicial System, in regards to Family law, and justice, is inherently flawed. Lawyers make more money by cutting couples off from each other, encouraging conflict and refusing to communicate - which extends litigation, sometimes for years. I'd like to see equal right for father's who fight for their kids. My son who has been falsely arrested and charged with domestic is fighting for his children. Then-wife called 911 on me three times, with no evidence of assault. Third time called police while I was sleeping after a night of her drunken rants. Told police I was suicidal. Spent a month in solitary, never knowing why. Six weeks in jail at age 65. Parkinson's disease. I'm a Wake Forest grad and war veteran. No previous record. Class A misdemeanor prevents me from housing and employment. Have written proof of her jailing me to avoid community property/divorce. Year later she showed up unannounced and tried to kill me with automatic pistol. Didn't fire. Now she has criminal record. What was a happy home now two lives destroyed by one person's misuse of system. Police never spoke to me, even though she was obviously drunk at time of call. My case is not unique. He has shelled out much cash only to get probation and the risk of losing his 20 month old son to a liar. This isn't right the law needs changed. This petition while being in great need, does not cover the fact that those filing false allegations are not just wives against husbands, or girlfriends against boyfriends. There are a growing number of cases involving, in-laws against in -laws, sibling against sibling and so on. I've been a victim of falsely accuse of domestic violence in fact even now as I type , on August 26,2015 at 124 am I was arrested in nyc in queens, my ex girlfriend plan the whole incident. At 12 am I decided to go to my car for 1 hour and think if I should stay and live in a home of being control being force to perform sexual acts, being force to give up money , living in fear of her threats and tired of walking on egg shells in my own apartment. I pray and thought long and sitting in my car I said enough is enough I would leave her but first I would tell my ex girlfriend and see if she agree , I got out my car walk to the front of my house and sat down on the steps then in 4 mins she came downstairs and said we need to talk I no longer want you living here I said this is my apartment you leave then I told her you know what I'm moving out keep the apartment and I do not want to stay in a abusive relationship any longer, she saw that I was serious and said no let's talk about us , I said no I can't tolerated this emotional roller-coaster any longer, she just kept trying to work on the relationship I was thinking I need to say I'm seeing someone else maybe like that she would end it faster and stop trying to convince me, I told a lie and said I am dating someone else she stood up and said good for you enjoy now you're see what I would do she walk upstairs and lock the door behind her when I open the door and I took two steps up she knock on a neighbor door saying please help me crying saying that I have a knife call 911, before you know it about 10 cops show up and cop cars cover the street, they ask me what happen I explained what happen and told them if they don't believe me to check the camera's we were only discuss about our relationship and I decided to take a stand and end this toxic relationship, I did not know what was her story to the police but one cop came downstairs and said your being under arrest place your hand being your head spread your legs, if felt like my whole life turn upside down, I told the nice officer on my right what happen why, he said she claim you went after her with a knife to her while she was holding a baby then claim I punch her bottom lip, I said that's impossible officer we were sitting in front of this home and nothing ever occur upstairs in the apartment, I said please check the camera's none of her saying is true ,I was still arrested and spent the night in jail , later release and was charged 4 counts and service an order of protection to stay away from my ex girlfriend, today is Sept 2nd I lost my jobs , for the first time a criminal record, all because I stood up to end an emotional and sexual abused relationship. I have nothing no money my bank accounts empty, I am in hiding. I was told by neighbors that she's been calling the cop's still making falsely claims about me, meanwhile she texted me that she's sorry that she lie and gotten me arrested please come back home we need you, I refuse toREPORT COMMENTS

As a male victim of domestic violence and abuse, it is the most difficult thing to deal with, when, not only are the support services available to dv victims unavailed to men but often times I have been left with a feeling as though the providers have a great distain at the mere thought that a young male without disability can even consider asking for such services (most like to further his abuse upon the "true" victim) . I have even been laughed at and yelled at in other instances for asking for the much needed assistance which should be provided without any prejudicial biased or discriminating presumptive assertion by the people who are the first point of contact or first line of defense against domestic violence. Policy should be in place to better regulate law enforcement practices by setting up policies and best practices, juudicial process could have more thorough investigatory proceedure in place and instilled within the service providers who are there to assist victims of dv should be ano open mindedness for the ever changing nature of the domestic relationship; especially as it pertains to financial abuse and emotional abuse - for it is true that domestic violence can be inflicted upon men and even those who may appear to be weaker or less able bodied can be just as abusive, hurtful, destructive and violent as any other person can. This has been the case in each situation I have faced in my adult life where I had not only been turned away by those who are under oath to protect me against harm, they have actively furthered my pain and the damage caused with respect to the issue of domestic violence and abuse.REPORT COMMENTS

I completely agree with all the statements. ANYONE who falsely accused another of domestic violence should be penalized with jail time and punitive damages. I was falsely accused, processed, jailed like any other criminal so to be let go after five days encarcerated and a document of the supposed victim stating she will not prosecute. Moreover, my friend who took her to the DA's office video taped the entire conversation on her phone. Now, I have a criminal arrest record for life, bail money paid from my savings and if I want to get it expunged I have to PAY FOR IT???!!! It will always be there along with my finger prints. As long as a woman is accusing a man doesn't matter the if accuser: -Has multiple criminal convictions. -Is diagnosed mentally ill -Has been revealed as a dishonest by her own words in declarations filed for the same case. -Has dozens of civil order violations documented by local police -The accusations evolve over the year. -Has made pervious accusations against the sane person (me) that turned out to be unfounded. After 10 months & $40,000 later, the Court finally dismissed a false domestic violence claim against my son! He finally was able to regain custody of his daughter. My granddaughter was the one that was hurt in the end. Her vendictive mother refused to allow her to see any of her Father's family for over 10 months. I was the only grandmother she had and was very close to her. My son was falsely accused of physical & sexual abuse against his own daughter. Only after the Court appointed expert found No abuse & that my granddaughter had been brainwashed did the Court throw the case out. My son & our family lost 10 months with my granddaughter while the vendictive mother was all the while brainwashing her against her father! The case was dismissed but the vindictive ex wife was allowed to walk away with no consequences for her unthinkable conduct! The law needs to change.REPORT COMMENTS

My life too has been turned to hell.. lost my jobs, so. And rights. My son's mom attacked me yelling and screaming out of control.. she ripped my jacket and all I did was push her off me. She made self inflicting wounds. Even her mom had bruises the cops took pictures of and I never touched her.. then after getting out of jail .. doing everything the court asked.. son's mom did follower the restraining order to get my advised visits.. so I filed a modification and when she was served the papers .. she framed me again and said I was at her front door .. didn't even say nothing about being served and the cops put a warrant out.. I try to fight the warrant but was jailed for 21 days till the case was dissmissed. And list another job that I just recovered from the first arrest.. I've had enough of this abused from every side .. the cops the courts my son's mom.. Even my dv counseler tried to get more money out of me than I owed and he sent my paper s to the court late and got me out in jail again... It's much too much.. and the one that's hurt and punished the most is my sweet heart son.. evil is this law of obsession... The law only protects the ruling class....REPORT COMMENTS
