The fact that there are still Congressmen claiming that this bill excludes U.S. citizens absolutely disgusts me. The language of the bill, particularly Section 1032(b)(1) provides that the REQUIREMENT to detain is inapplicable to U.S. citizens. However, it does not altogether foreclose of the option to do so. Furthermore, in the paragraph proceeding the aforementioned provision in the bill, there is yet another exception to the requirement, allowing just three people [the Secretary of Defense, Secretary of State, and Director of National Intelligence] to waive it completely, as long as the Secretary lets Congress know that it's in the Nation's best interest. Real reassuring. What happened to checks and balances? Moreover, that waiver of the requirement to detain "covered persons" in military custody can be read yet another way. The key words of this provision, and another, are "military custody." The provision exempting U.S. citizens also uses this language. (It may not appear that the drafters' intent was where I'm going with this, but the language of the bill makes it a logical and technically correct conclusion.) To be specific, the provision states: "The requirement to detain a person in military custody under this section does not extend to citizens of the United States." Ok. So, we're exempt from military custody. What about every other kind of law enforcement custody? Ridiculous. Enacting this bill will give the government the legal power to totally disregard the Constitution.REPORT COMMENTS
