Abusive Parties Perpetrate Abuse Through Family Law
We, the people of the United States of America, who are also women, mothers, fathers, law-abiding citizens, and advocates of the proper application of our nation's laws, are writing in hopes of bringing to your attention a grave injustice that is occurring in our state as well as many others across the country.
False allegations of domestic violence are being filed against women by men who seek to injure them in the most heinous way possible, by removing them from their children and their homes, with the primary motivation to these accusations being to simply gain a tactical advantage in a divorce proceeding. These false accusers have found a sword to wield with which they hope will help take spousal support and children away from their mothers, thus furthering their abuse as well as their own malicious interests through the family law system. Mothers have been thrown out of their homes and away from their children, some falsely arrested, and suddenly subject to the mercy of a system that pins the accused as guilty before proven innocent. The lives of innocent children are being damaged in the process.
We call for these accusations to be vetted before those accused are treated as criminals. We call for harsh penalties for those found by due process to have made false allegations, penalties so harsh that abusers will think twice about using the legal system to further their own interests.
There is a growing trend of women becoming the victims of false allegations of domestic violence. The process of reunification with the children caught in the middle can take years, as they are examined and re-examined by therapists and custody evaluators who take these false allegations seriously, as they are obliged to do.
There are many cases which should be subject to immediate scrutiny, especially those in which the accused have no criminal record, have never been arrested or charged with any crime, have never been sued in civil court, are educated, have lived their lives as law abiding citizens, and where the spouse has a clear tactical advantage in filing false allegations.
An accuser's voice can be the only one heard for many months, if not years, which should be shocking and reprehensible in the eyes of the law. The actual truth in these cases can mean nothing for a long period of time compared to accusations without evidence to support them. Those who suffer most are the children who cannot understand why their mother has been taken away, and mothers who cannot discuss the custody issue with their children. This gives the opportunity for the accusing parent to malign, alienate, and manipulate the children against their own mother.
