Unconstitutional Conviction

On April 15,2005 2005 Demetrius Thomas was arrested by Shreveport Police for first degree murder.59 days later Demetrius he was indicted via short form indictment of second degree murder. Prior to trial numerous pre-trial discovery were filed,but the most important motion was NEVER filed by the court nor trial counsel and that's a motion for Bill of Particulars to specify which section of R.S 14:30.1 Second Degree Murder statue Demetrius was being charged with. That was a vital motion! What's more, Demetrius was convicted of murder without an autopsy when authorities had the body. However,because the Caddo Parish Coroner's Office was under investigation for illegal performances, Demetrius was deprived of an autopsy. Furthermore, Demetrius was convicted of murder based on the testimony of ONE witness,who was not present during the shooting. This witness ONLY gave conflicting testimony that Demetrius possessed a weapon he describes in vivid details to investigating detectives;however,during trial he was NEVER asked to describe the weapon by the prosecutor nor defense counsel on cross. What's more,the weapon the witness described does not match withheld evidence matched by ballistics to be the murder weapon, which was a 9m.m. SHELL CASING and the witness told detectives Demetrius placed a revolver handgun in his (THE WITNESS) hand.THIS IS WHAT THE PROSECUTING WITNESS TOLD THE INVESTIGATING DETECTIVES! But that evidence was NEVER introduced into evidence. Why? Because the District Attorney knew the witness statement to detectives didn't match the withheld evidence an that's why the bullets were not presented in Trial. Trial judge John Mosley in Section 2 of the Caddo Parish Courthouse unconstitutionally convicted Demetrius due too political gain. That isn't justice,by all means that's injustice. Demetrius opted to have a bench trial predicated on the fact the residing judge under no circumstances would allow the Caddo Parish District Attorney to obtain a conviction base on their lack of evidence & the conflicting testimony of the witness. That wasn't the case because Demetrius is incarcerated in Louisiana State Penitentiary convicted by the very judge who gave an oath to uphold not only the Constitution of Louisiana but the Constitutions of the United States. Judge John Mosley Jr.; violated the integrity of the judicial system,the constitution's of both the United States & Louisiana. This petition is for two reason (1) that Demetrius be afforded the constitutional fairness afforded him by both the constitution of the United States & of Louisiana because it's his Due Process right,and (2) to have Judge John Mosley Jr.; removed from the bench as a Caddo Parish District judge because he convicted Demetrius Thomas illegally & unconstitutionally as well as allowed the District Attorney & it's assistance along with defense counsel to violate Demetrius' constitutional rights in a plethora of ways. All the evidence is within the court records. This petition calls for what's right to be done now because Demetrius has suffered the injustice for far to long.
