Hold Custodial Parents and the State Child Support agencies Accountable

If you are a non-custodial Parent paying child support for a child that is failing in school and nothing is being done to resolve the issue.

I am a father of 4 children and have been paying child support all of their lives. As the children go closer to graduation age, they started to fail high school. My oldest daughter was pregnant at 16 eventually, dropped out and went on to have two kids of her own receiving public assistance. The next to graduate would be my son, he to failed his senior year and I paid child support until he turned 19. After filing a motion with the court and exposing the custodial parent as a flat out lier, I found that there was actually no recourse within the system that hold the custodial parent accountable if the child fails to graduate or attend school as required. In most sates when it comes to the ages of majority the the law reads as follows;

"18 years of age except an unmarried child who has attained the age of 18 years, is a full-time high school student, and who is not self-supporting, is considered a minor until the time the child completes the 12th grade or attains the age of 19 years, whichever occurs first."



"until the time the child completes the 12th grade or attains the age of 19 years, whichever occurs first." This one part is being thoroughly exploited in the system.



My issues is as follows. My youngest daughter turned 18 last year and had not graduate but I was being told that she would graduate int he spring. The child support agency had started sending the payments back to me because her mother had not returned the required documents informing them that she was still in high school or a full time student. Keep in mind that I had a 0 arrears and payments were being deducted through wage assignment. Three months pass, and I file a motion to have the child support case closed, but instead the child support agency begins to take the money out of my paycheck again, because they say the mother provided a letter from the school stating that my daughter was still enrolled. Fast forward to May and my daughter does not graduate, so I have a second hearing and her attendance can not be verified. It is now august 2014 and I finally get the transcripts from my daughters school and she was never on track to graduate in fact she needs 90 credits out of 220, she had 47 days of unexcused absences from school and withdrew on April 1 of this year. All of that, and yet the child support agency claims that she is still eligible for child support. The law needs to specifically define full time student and require school attendance as a part of the continuance of child support beyond the age of 18. I am searching all over the internet for the agency that should be holding the Child support agency accountable. Please Support!
