Fair and Just Representation for Parents
Misrepresentation in the Court of Law,
You enacted legislation on the child welfare act that is detrimental to any and all parents in the US. The Termination of Parental Rights
Most of your legislation is good and fair for the parent, you gave specific guidelines for reunification to the family that are good and fair actually very good to avoid Termination of Parental Rights and you even set good consequences for not following your Legislation.
HOWEVER you also gave each State and County reign on how to intact your legislation and there is many of them not doing a very good job in full filling your vision and taking advantage of our legal system to deny parents of there constitutional right to be represented by legal council even if they cant afford one. the States will assign Publics Defenders to represent them whos case load is so great they don't have the time to represent a parent who can and probably will have there child ripped from them to never see them again and could be from a false allegation or a not very good case worker. and sadly we all know they don't fully and freely represent you in the name of there employer the State.
So in the name of Justice of our Great nation we propose to you that you in act a new Legislation that says you truly support the American Family and give the parent the right to choose there own Legal representation that they feel confident in to protect and do what is best in the interest of there children and at the same time holding them not so very good Courts to the Rules of the Law.
Is it fair that the State has two to three Law offices fully funded by the State to attack you with such a detrimental act of taking a child from a parent who has a over worked under pay single lawyer and maybe a clerk. In which after wards most parents are subject to have to pay up to the full cost for a Unjust representation. Is it constitutional to have a Lawyer you get to talk to 15 minutes prior to the court session that is going to take your child forever. Is it right
You made legislation to correct a corrupts system but at this point it just sounds good. The child welfare system is still corrupt .
There's a State spending $120,000,000 in foster care and pre adoption and only $7,000,000 in Reunification. Now if they took part of that $120,000,000 for private council plus the amount there going to force the parent to pay they wouldn't even be shorted cause there'd be a lot more reunifications going on and a lot less constitutional rights being stepped on. All your legislation is garbage all it does is speed up the process to steal a child in the name of the law if a parent cant be fully represented. you need to act and react now to protect our constitutional rights of being represented fully in the court of law. and give the parent the right to choose there own counsel to represent them in this detrimental situation.
