    In many cases children enter family court with two parents and leave with one primary parent and a payor/visitor, pushed to the periphery of their lives. The Guidelines are based on the assumption that children have primary residence with one parent and spend approximately one-third of the time with the other parent, rather than an assumption that a child will spend equal time with both parents. In most cases, the Guidelines create a windfall for the custodial parent as a child support recipient. National Parents Organization proposes that the guidelines be developed to: Treat the child support obligation of both parents in a shared parenting situation where both parents are custodial and residential parents equally unless the court finds that such treatment would be unjust, inappropriate, and not in the best interest of the child. Lower support amounts with due regard to the needs of the child. Base child support on after-tax income, not gross income. Not include earnings form overtime and second jobs. Not include bonus income. Encourage equal treatment of all children, including first and second families. Encourage shared parenting. Incorporate a true self-support reserve for poor payors. End or modify the child support after high school, unless special needs exist. Remove legal requirement to pay for college. Clarify how the child support is to be used, and specify the types of expenses it covers. Base child support on actual income not attributed income. I have been in the divorce process nearly 4 years. The courts have an obvious bias against the fathers and still favor the mothers even if the kids want to be with the father, the legal guardian states the children should be with the father, the forensic therapist states the children favor the father more than the mother, etc. I was forced by the court to settle my child custody case since I am a "MAN and should be happy with 50% custody." With these being said, I make 4 x the salary of my ex-wife (we both have the same level of education and she never spent any time at home after giving birth). Now because I have custody 50% of the time she is considered the custodial parent by the NY Child Custody laws and need to pay full child support and of course she does not need to account for any of the monies spent. Additionally, I need to cover health insurance, dental, vision, etc as well as other payments at the rate of 75% for after school activities and her babysitting costs. At this point, even though I make 4 x my ex-wife's salary, she ends up clearing more money and now I have barely enough to live on my own and support my children's needs when they are with me 50% of the time. What I am asking and begging for is for you to petition and work on passing fair child-support laws to protect not only the ?money making spouse? but the children as well. It is time for a real child-support reform for not only men that have been unfairly treated by our court system but fo

    Both parents are responsible, not just the father. If you reduce the father to poverty level to the point they have to leave the state of NY to keep a roof over their head, where does that leave the kids? Especially when the ex refuses to allow the kids to visit because she is allowed to, and turns the kids against you making you only a paycheck, not a parent. They say you can stop this, yeah ok, I tried. Meanwhile she quit her job because why work when you make enough in child support to afford a house for free. Child support needs reform. Or judges that are non biased against fathers! I have 2 other kids I have to keep a roof over, food, clothes, working 60+ hours a week just to pay Child support to someone who refuses to to admitted she is also responsible, and the courts support her? I was laid off for 6 months in 2008, I searched daily for a job, NY child support refused to lower payment terms, instead they hit me with arrears. How can I raise 2 kids on less than 15,000 a year, when she is getting over 30,000, this month is my last month to pay off arrears on emancipated adult children. Let's see if I have to beg them to stop taking it out of my check. Sad since the kids all moved out of her house and are married themselves years ago. Her free ride is almost over!

    I myself are being railroaded in the unjust family court and child support system in otsego county NY ...while my ex earns 30k a year and has way less debts as I earn less the judge felt her going after my VETERANS disability pay wasn't enough and gives her 100.00 a week without evening looking at my expenses ..also her lying on paperwork wasn't enough to get a cut of my VA payments the judge just turned a blind eye to it all....

    I have to child-support cases on the second child-support case The court a ministry to judge treated me like I was no good. In the middle of the court proceeding he kept turning off the tape recorder to give the child's mother advice on what to bring in to collect more money. After six years I had to move five times because I cannot afford to pay the rent in New York City I am now remarried I have to mow kids and sometimes I feel like it's a mistake because of the cost of living. You fill out an assessment form putting down your entire cost of living expenses and for what nothing is taken into consideration. I would like to return to court to see if I can get my case re-modified I'm so afraid of trying to get help in making things worse or then what it is. For one child I'm paying close to $400 biweekly the mother to stop working she moved to Puerto Rico and where does that leave me. So my understanding the mother has been working now for seven years I thought in child support both parents have to be working. I've been searching on the Internet I'm going to the child support enforcement office trying to seek help everybody looks at me as if I'm crazy.

    I'm a single father who pays child support for 2 beautiful children, I see them almost everyday and they stay with me on the weekend's. So I by no means am a dead beat dad. However now that I'm paying support for my second child, I am unable to afford housing for myself and had to resort to living with my mother to make ends meet! While their mothers live well off! How fair is this I can't live off of 200$ a week especially in New York!!

    Seeing this system fail both the father and children. This high percentage that is paid out is very unfair to father who are trying to provide. I hope this can be changed so fathers have more time to spend with there kids

    This week in suffolk county ny I just saw in the news and newspaper that all (deadbeats) I'm quoting the news 12 and Newsday article will be automatically sent to jail if they are caught with a suspended license due to child support

    I wish this law passes i am a father who pays childsupport and never failed on my payments. I pay for to boys seperate mothers my child support payment is 300.00 weekly i understand its my obligation but something has to give.

    My child is now 19 but I had him with me between 2003-2005 and had him since 2007- until now. I was caught up up on child support even to the point of over paying. His mother took me to court and the judge created an arrears that I never owe even to the point the dhr had told me they see no errors in payments but they have enforce the judgement. I would like to sue court for my child and I suffering. I lost a lot and couldn't provide for my child like I want due to NYC court systems. If there any lawyer out there that can help achieve this please help my child shouldn't have to suffer going through college tool. Thank you and God bless..

    There is no accountablility on the mothers part. She can spend the money on anything SHE wants and it is TAX FREE to her! The courts dont care about the quality of the childs life when they are with the father on visitaion. I couldnt afford to do anything with my kids when I get visitation, then they get bored and dont want to go to dads apartment anymore and I cant blame them. The courts dont care about MY cost of living. The judge in my case even disregarded the law because she felt the $130,000 rule was not right?!?!?!!? Where is the wifes responsibility? I gave my wife enough money monthly to pay for house, car, gas, electric, cable and she had a good job. Now the house is behind in payments and MY credit is screwed! I have no clue what she did with the CHILD SUPPORT I paid to her because there is NO ACCOUNTABILITY!!!! I'm boke, kids dont wanna come over to an apartment and do nothing and now shes killing my credit...sounds fair way to care about my kids....and the divorce was her fault and her idea!!!!

    The ironic thing is when my son's mother realized I moved on out of spite she said she was going to put me on child support so my girl friend or any other woman couldn't have me because she couldn't. It is not fair at all. What happen when the father is sick or disabled or loses their job and have a hard time getting another one. I know there are some dead best dad's but to judge us all that way because of spiteful woman its not right nor just its down right stereotypical and unethical. Then if they own you money they have some imaginary right to play with your money which they garnish from you check meanwhile your son's mother is going yeah let him feel pain. If the movie minority report was real many woman would be behind bars and they know it too. They should investigate more they would not be surprised they government knows they just don't care. It's all about the money.

    I've paid child support for 9yrs. I never missed any payments. When I had a court order to raise the payments. In 1 month the child support agency stated that I owe $2000 in back pay, and this issue never been discussed in court, and I have 3 little children I take care of this is very unfair to them.
