    I am in total agreement with this. I am a divorced father of 2 children. I recently went back to family court for my "income evaluation". My support went up an ADDITIONAL $500.00 a month. I now pay my ex wife more in child support than she makes in a year. I am far from being a deadbeat dad. I had to get a 2nd job to make ends meet. I had copies of my mortgage, my divorce loan I am still paying on and every monthly expense I have. Calculating off my GROSS INCOME is so unfair. I am basically working 7 days a week at 80 plus hrs. My ex isn't flexible about visitation and now I have to WORK EVEN MORE. I will have even less time to see our young children. I physically wont be able to keep this work schedule up for another 13 years. This is all about an "entitlement complex" from a spiteful ex wife who wants nothing more than to see me struggle the rest of my life.

    Absolutely, my boyfriends ex wife spends the child support on herself, new clothes and massages. She doesn’t even work. She should have to at least account for where the money goes. Not only that but she asks for money above and beyond what he already pays. It’s not fair when he’s just as involved in his daughters life and pays for everyday items when she’s with him.

    Yes, the NYS Family Court/Child Support system is flawed, outdated, corrupt and totally biased... If family court judges really applied the law and left out their covert subjectivity, parents and (especially) children would be better adjusted in the family unit. I have two children which are obviously affected by the mother’s greed and the family court’s bias. Just as with most fathers, my take home pay is a joke between alimony and child support. My only comfort is my good court document record keeping. Children become young adults and later request some type of explanation; all of my ex-wife’s petitions and filings clearly show her greed even though she says to all, “I did what I did for the kids”. The documented truth is a better story than a fabricated lie... 1. Order of Protection for mother and children for alleged events outside of the USA. I didn’t know NYS Family Court had jurisdiction outside of the USA. This was later dismiised. 2. Asked mother to allow to take chidten one week to Disney during summer vacation. She said no, filed a petition at family court and judge listened to her exaggerated lies and also said NO to a summer week at Disney. I don’t have ANY negative record i believed NYS Family Court looks out for the best interest of the child. Judge then apologized to my attorney, off the record, for the decision (he was a recent appointed family court judge). 3. During divorce negotiations, i requested joint custody (one week mom, then one week dad); she and her attorney strongly opposed (bc of less than full child support money)... i thought the best interest of the child was paramount. Now, she often requests that I take the children more often (oh, while you still collect FULL child support? NOT). All this and more will be available for my children when they become young aduls and want clarification. Until then, sorry kids.. Recourse: Go back to court or do nothing.. The NYS Family Court system will never have the slightest consideration towards the father so let’s just live our reality. At the end of it all, the children will be forever emotionally and psychologically affected for life! Thanks NYS Family Court Justice system! A NYC Father.

    I am also suffering from this unfairness. The child spends at least 50% of his life at my home, the home where he was brought to when he was born and will always consider "Home". The mother, who just picked up and left one day while I was at work, earns more than I do yet I have pay her. The last time the mother tried to have my visitation suspended, child told his lawyer he wanted to spend more time doing things with me. But, while she gets to take him on vacations and trips and eat out ALL of the time, I have to borrow money from my mother every month just to keep the lights on in the home he loves to come home to. After taxes and child support I bring home slightly more than 1/3 of what I earn and as a humble human services worker I do not earn a lot. It so painful that I can't make the memories with my son we would like. I am so proud that even with this situation he still loves to come home, leaving behind his mothers expensive gifts and activities. BUT WHAT DO MY WORDS MEAN. IS THERE SOMONE REALLY LOOKING TO DO SOMETHING ABOUT THIS. I PRAY EVERY DAY THAT SOMEONE WHO IS ABLE TAKES UP THIS CAUSE. SOMEBODY HELP....PLEASE!!!!!

    NYS family court has the most corrupted system. Fathers aren't allowed to speak in the court. Mothers are always given the full custody even though she has a new spouse with criminal records. Child support always awarded to mothers regardless of how many days children stay with the father. And not deductible tax return because legally the father is not a custodial paren.t.

    I just found out i pay 167 a week i only bring home 333 a week i see my daughter equal time i make 400 $ more a yearthan the mother she is re maried we both gave up child support 10 years ago now i am going to lose my house car and other things cause of this 167 a week now i have to work more and i will be oit of my kids life nystate destroys families i am a dam good father i love my kids this is so not fair

    Above says it all. This is the most unfair system I have ever had the pleasure to deal with. It assumes all fathers are dead beat dads and treats them accordingly. News Flash there are more good fathers than bad. Fathers are just as important as mothers and there needs to be justice. This system only makes a bad situation worse, not only for the fathers but also the children involved. PLEASE PLEASE HELP!!!!!

    I believe it is unfair to base child support income that includes overtime. I am no faced with working 1000 hours of overtime to pay child support and to be able to provide for myself while my ex-wife only works 32 hours a week. I can not even look for another job unless it can guarantee that the job will pay what my current job pays with overtime. Child support should be based off of direct pay, not to include overtime or bonus. Neither of these are a guarantee.

    I have 50% custody of my son yet I have to pay child support as if I have him 0% of the time. I don't mind paying child support to make sure he has a good life when I do not have him, but it cannot be considered reasonable that I pay his mother 100% of what the state considers appropriate for his needs when she only has him half of the time and then I have to use what remains of my income to ensure he is cared for properly the other half of the time when I have him. I want the very best for my son, but lining his mothers pockets while placing myself in economic hardship is not good for him.

    I would love to have custody of my 10 month old son. I filed for custody , the mother filed for custody the day after ( 10/2016). She then filed a false report 11/2016 , that l assulted her 1 week before she gave birth . I was arrested ( unjustly). I allegedly assulted 1 week before she gave birth ( false) , arrested 8 months after the alleged assult ( unfair , unjust system) I'll be in court on the 23 of January to defend my good name ( never been arrested in all my life) (42 years in th US)

    I live this nightmare in Wisconsin, this is the plight of every parent in america who pays child support. These laws destabilize families and create poverty even when it shouldn't even exist. I make around $100.000 per year, and because my ex refuses to work (she gets $2500 per month tax free income from support) both families are stuck in poverty. Percentage based child support calculations are insurmountable and destroy any hope of financial stability. These laws ruin the lives, hopes and opportunities of every child they impact and place the burden of support on the state, federal, and local governments who must respond to the financial crisis with increased welfare support. Often times, the earning parent paying the support are not even eligible for financial aid, and are forced into a form of unreachable poverty where the fruits of their labors are unjustly deviated from them.

    Dear law makers!!!! Please make this state more desirable for fathers that want to spend time with their children and quit punishing people only trying to remain in their kids life. The gross income chart is an obsolete way to conduct child support payments. Lets be realistic, the average father making 30-40K will not be able to survive on the income NYS allows him to bring home after taxes. Courts are bias and seemed only concerned with the mother in any situation. Lets bring in fairness and equality for all.

    I'm a wife of a man who is suffering this right now is unable to see his children for many years now we live in Massachusetts and the mother lives in va New York is constantly taking money from his account and don't bother to credit for Massachusetts because of this my husband will loose his driving rights . They don't realize or don't care if he can't drive and get from a to b how do they expected him to pay. They are quick to take money but take there sweet a&$ time to credit the account. The mother has remarried and does nothing for these children better yet she collects the support and doesn't even care for the kids and my husband can't contact them or see them but is demanded to pay. Here is a father who wants to be in his kids lives and support them and spend time with them and is be punished . The mother sits back with her legs in the air with not a worrie in the world just as long as the money comes to her. It's a unfair situation that he has had to deal with since the days of there births. Why this has to go threw three states is beyond me. I understand what ever state child support is filed in is the state that try's to collect but once both parents no longer reside in that state why is it not transfored to the states They do live in , because of this HUDGE problem we are forced to go back and forth between three states to try and find anything out then get the run around because nobody at any office has any clue what's going on. Why not go after the mother who has the children for collecting child support, welfare or what ever else kind of money she can get for doing nothing and make her get a job. I understand it's hard for some mothers but this mother and I'm sure there are more out there only cares about one thing and that's who she can screw over for money including the state. This has gone on since my husband and I have gotten together. She's had him arrested and put in jail after she called him to come get there kids cause she had enough then decides ( because she didn't get any money from him rite there) to call the state police on him for kidnapping , he was exspadited to Virginia for this and put in prison. We had a letter from her stating she gave permission but in va a mother can change her mind just for spite and the father who is trying to do the right thing is punished. How is any of this right? Why is this happening? Why can't anyone see the flaws in this system and fix them. Is it just pure laziness ? Fathers who are trying are the ones that are taking advantage of. I'm so tied of seeing this man suffer and not be able to see his kids but yet pay and pay or be threaten by the state. Take his abitlity to get to work away then expect him to pay how the hell is any of that right? You tell me or you can do what every other person does when we call , pass us off to a voice mail leave all our information and NEVER RECIEVE A RETURNED CALL!!!! That's why nobody has a clue what's going on push everyone to voice mail so nobody has to deal with it!! This should be corrected and fast.

    My husband has 3 kids ages 21, 16 & 7. The two older ones are from his 1st marriage and the youngest from his last relationship. The ex wife takes pure advantage of him leaving everything up to him to do for their daughters. His sons mother is the worst makes over 100k a year and owns her own business, but still goes after him for money & sends the kid every other weekend with nothing, so that we can buy more stuff on top of what he already gets a month. It's sick and sad. I also feel that a "kid" at the age of 20 should not be getting child support. If in school help with tuition, but not being supported you can get a job. My husband can barely make ends meet now and I have to pick up the rest which is just so stressful. These laws need to be re-evaluated and more considered especially if a man re-marries. He has bills & responsibilities as well why does he have to work twice as hard when these kids have moms too!

    Something has to change, I have my kids 4 nights out of the week including a Friday or Saturday overnight. The nights I don't have my kids I could work extra or do something to get ahead or have money to do stuff with my kids. But the more I work, the more she gets (for the kids). I think its wrong, very wrong. If I choose to work more the nights I dont have my kids to have a little extra or to have a savings or heck even be able to afford some health insurance for myself would be nice. And they wonder why suicide in divorced males is so high.

    I am have been recently disabled and out of the 1200 I obtain a month, Child Supports leaves me with 379. They take about 821 dollars. My children also obtain abut 600 total due to me being disabled. I went to court and completed all the paperwork on my own to modify the order. The judge said she would but was not sure what amount. I then received a letter and it stated they were going to deduct 479 a month. This was back in April. They actually increased the support payment instead by 80 dollars. I have been living on my friends couch for almost six month because Social Security does not allow me to work and Child Support is leaving me with 300 a month. Add to that the mother and the kids still ask me for money and I give it to them. What am I to say, no? to my own kids? I don't know what else to do.I want to die.

    Courts need To look at the time period which thèse laws were made and economy was better, having just the man working and could support à family on one income....Now days it takes both husband and wife To work just to get by....Courts should atleast look into changing it to net pay rather than gross...The childs mother makes just as much as father after taxes...RIDICULOUS !!! Support receivers should also be taxed...Every other possible source of income is such as alimony... #SYSTEMFAILED

    This outdated system needs to be updated and it needs to be done in the interest of fairness. The entire process is flawed where women can claim child care and the judge doesn't even ask the father's side yet takes whatever is given to them. There can't be a time where a man walks into a courtroom and is automatically a villain because he has a child. My entire process with the Suffolk county family court system was an embarrassment as they treated me as if I was a criminal. I was never given an opportunity to get visitation and missed my date for visitation because I was scheduled to work. Did I get another date? No I was deemed a dead beat that just didn't show up. I ask the fathers here what happens if you don't pay? Easy, I found out when I tore my right quad at work. I wasn't paid for 13 weeks however the day after I called child support and told them what happened. I was rewarded by having my license suspended and all my money being given to the mother of my child. I don't mind paying my amount even though they include child care for a child who no longer requires it. Also I mentioned the mother lives in Manhattan and yet the support goes through Suffolk county. I was told to get a lawyer as if I could afford one. We are men many of us good men who care about our kids yet are judged by the malicious intents of the women we were involved with. It's time for the NYS court system to listen when we speak because it's clear they don't hear us.

    Honestly, with the amount that is awarded to these Mothers who seek more money after they already been awarded a high percentage, at some point shouldn't the father get a chance to raise his kids? It's clear the mother can't control her spending habit's. they look at bank records, pay stubs and bills but don't notice the pattern? Does the Judge even care? I don't want to Rant but the kids should have a right as well as the Father.

    this is a case where a mother is fighting to get custody of back from father since 2013 all because she was a little late and their name was called....so Judge Bivona gave the father, physical, legal, sole, final custody for first time appearance. This father has both of his kids from two different mother's in the court system. he took out a false order of protection against his youngest baby mother back in 2014 to stop a family vacation and Judge Bovona, granted the order without the mother being present. for the entire year of 2014 the child was not able to see her mom unless the visitation was supervised by a court appointed person. the visitation was $70.00 for 1/2 hr. people can walk in the Middletown court and tell lies and get what they want because the mother ended the 6 yr relationship between the parties. not to mention he is taking her back to child support court to get more money...but this mom buys her child clothes, pays for after school activities etc and still having money garnish from her pay check. this father walks around with brand new clothing, just brought a motorcycle, etc. he recently got a big check from child support because my daughter was on disability for 9 months and check was to small for them to take out child support...so she was in the rears. there should be a way for the court to find out if the money is being spent on the children. all Judge Bivona, cases should be reopen because this man has placed children in the wrong parent hands.
