EB1 is a total SCAM. I patiently waited for 12 years for my GC in proper channel. And I manage 5 to 10 of these guys from from TCS. Funny thing is they will get the GC in 6 months. Even my director is a H1b but since he works for American company, the company files him in EB2. He too waits years before he can have the GC. Where as these guys who we manage, gets GC in 6 months. Where is fairness in US immigration system? Total abuse of LAW. -

I work for a big company and i have seen first hand employees comming from india on l1 visa from companies like tcs, cognizant and infosys and getting green card in 4 months, senators these people will become citizens of america in 5 years. The people are not even true managers they are QA Manual Tester, developer. May be in the Company his/her designation is a Manager, But THEY are not TRUE Manager, Fake Manager. This category should be based on experience and role in US. Most of these so called managers from Indian outsourcing companies and small consulting companies are doing development/testing work sitting at client locations. This is a fact, people are exploiting EB1 category. I know about cases from Indian software companies who tried this route and had success. People with genuine relevant work experience and qualification are stuck with long queues of EB2 and EB3. I hope the immigration reform that is being talked about will try to stringent the process and vet the applicants for such frauds and misrepresentation. I know many people from some of the largest Indian IT firms (Cognizant, Infosys, Tata Consultancy Services, Wipro) as well as small Indian IT consulting firms (10 to a few hundred employees) who have and are continuing to misuse EB1-C category. They openly agree that there is a loophole in the EB1-C category and they are continuing to exploit it. We need to stop this category or severely limit its use to stop this abuse. How can there be thousands of international executives in one IT consulting company? There has to be a stringent limit on how many EB1-C applications one company can file per year. Also, the cap on this category should be much smaller that other categories like EB2 and EB3. The overflow of VISA numbers from other categories should never go to EB1-C category. EB1-C should have only a fixed cap per year which should be a very small number. Looking at the statistics from 2015 and 2016, there were more about 20,000 to 30,000 people which got green cards in EB1-C category. How can the companies start producing tens of thousands of so called "International Managers" in last two years? No surprise here. Since the wait in EB2 and EB3 has increased, companies are just misusing the EB1-C category. Please stop this abuse and if possible investigate the wrongfully approved EB1-C applications in the past two years.REPORT COMMENTS

We would like to appraise you of a particular area of United States Immigration law that has a huge potential of fraud and misrepresentation along with being unfairly biased in favor of the people who choose to abuse it. We are talking about the Employment-based first preference category EB1C (International Managers). As you are already probably aware, the requirements for eligibility in that category is just a year of overseas managerial experience in a company that conducts business in both US and abroad. We are sure you will agree that compared to the fair and stringent requirements of EB1A (persons of exceptional ability) and EB1B (outstanding researchers), this is a rather simple qualification to prove. Moreover it opens up avenues for fraud and misrepresentation particularly by overseas companies doing business in USA to unfairly take advantage of this simple requirement. The following example illustrates the fallacy: Person A (originally from India) has a US masters degree in a STEM field and works for a company in a managerial job that requires a Masters degree and a few years of experience. This person can only file in EB2 category which is badly backlogged. Person B (originally from India) has a bachelors degree in a STEM field and works for a company in a job that requires a Bachelors degree and a few years of experience. This person can only file in EB3 category which is even more severely backlogged. In contrast, Person C (originally from India) works as some manager (over a year) in an Indian software company that also conducts business in the USA. This person can file in EB1C and will get preference over Persons A & B. Please note that for Person C, educational qualifications are irrelevant as there is no such requirement and moreover they are determined by the employing company. So potentially a person with a high school diploma can qualify in that category, not to mention that the prospect of frauds opens up exponentially. Contrast this with EB1A (persons of exceptional ability) and EB1B (outstanding researchers). In terms of immigration preference, person C is considered at par with a Nobel Prize worthy scholar (EB1A) or a renowned Researcher in a STEM field (EB1B). I am sure you are able to see the fallacy easily. With the recent measures taken to curtail fraud in programs like H1B, the perpetrators have increasingly turned to this EB1C category. We would like to request you to kindly take up the matter with the appropriate authorities about this issue and restore some parity in the above categories. Ideally the EB1C category should be abolished or downgraded to a lower preference category. Request your help with this.
