    Companies like Cognizant, TCS, Wipro, Infosys and HCL are misusing and abusing the EB1C category for many many years. Time has come to stop EB1C category or at least make the minimum requirements for EB1C more stringent. I know folks from Cognizant and TCS who proudly says "We have raped the EB1C category for years and still doing it." These companies are bringing the folks on H1B and showing them as project manager or program manager here with a fake team they are managing and filing on EB1C category. Those folks were never managers in India, so these companies were not able to bring them on L1A. How can someone on H1B be eligible for EB1C if that person is not in an multinational executive ? EB1C category is for multinational executives. Project managers and program managers are not at the executive level. In long term, EB1C category should be stopped or be made super stringent only for multinational executives like VPs, Directors or up and who have worked in those positions in at least 2 countries outside United States for at least 2 years in each of those countries and who are working in United States on L1A only. In short term, USCIS should immediately start denying all pending I-140 and pending I-485 in EB1C category wherever they find that the candidate is on H1B and never worked in executive position (VP, Director or up) outside United States.

    THIS IS TRUE. PLEASE REMOVE EB1C category or suspend that category ASAP. IT IS HIGHLY DISAPPOINTING TO OTHER PEOPLE WHO ARE NOT ABUSING IT. Companies like TCS and HCL and infoSYS are misusing it a lot.

    Accenture,Infosys,Tcs, Tech Mahindra, Cognizant, IBM Etc.. all these companies who bring their employees on H1B,L1 visas. Are changing their roles to file Green Carc in EB1 CATEGORY AND getting Green cards in a year. They are exploiting this a lot. Not sure what the congressmen are doing.

    Most of the EB1 cases I have seen are fake managers...who never had anybody reporting under them. They can't manage a single person under them...they are just regular workers who come to USA under L1B. Stop misuse of fake EB1 cases so that genuine persons who are waiting under Eb2 and Eb3 get some relief.

    B1C fraud mentioned in this petition is entirely true and i have seen cases for EB1C is filled for people even without anyone reporting to them with a category called functional managers . These people get the GC in 6 to 9 months while the honest EB2 and EB3 workers from India and China wait for more than 8 to 15 years to get the GC. Please audit the EB1C manager category cases.     most of the eb1 managers are scrap. They are not International managers. They are fake. They don't even have any high skills or higher education. Indian IT companies file for them so that they can keep them for few more years. Please stop this abuse. They really don't deserve getting an eb1 category. This is big injustice to all eb2 and eb3 guys who are waiting for priority date from decades.

    It's high time USCIS takes into task these companies that are cutting the line and taking advantage of the loopholes that exist within the immigration system. The H1-B holders are made accountable as a result of these malpractices and have to wait decades or even more for following correct process and procedures to get their Green Card. At the end, valuable resources are being wasted and remain under utilized which definitely would have a bearing on the economy.

    I have been in US for 10 years and earn more than most eb1cs. I studied from a top US university and I have been paying taxes religiously for more than 10 years. It’s hard to see that someone making $80K comes to US on L1 and gets EB1c done within 6 months. Mainly from Cognizant and other Indian firms. I followed the process and I am stuck in line for 10 years. EB1C abuse needs to stop now!

If one L1A team member has extension, He will put all the names of the co-workers names in the Organizational chart showing to the USCIS as they worked for him. After he gets his extesion, The other L1A team member for his Green Card uses the same persons which the other person used for his extension. The USCIS is not checking how the persons who worked for one L1A team member also works for other L1A team member. This is totally unfair. USCIS PLEASE PLEASE STOP THIS FRAUD.

    Monitor anybody from these offshore companies like tcs on l1a supposedly "managers" they are non technical and come here because their uncle is a big shot in the company and get gc sponsored. Audit it with good auditors and you will know the truth
