    There is virtually NO oversight of PNAP or the PA state board of nursing. Their actions are subjective, and they scare and coerce nurses into signing "agreements" that have devastating effects downstream. Historical case law demonstrates their tendency to hide facts to support their decisions. They have been exempt from laws and statutes that are applicable via the Americans with Disabilities Act. They can demand compliance or continuation with whatever sanctions or conditions they apply to a nurses license, with the nurse having very little recourse.

    I am a person that was reported due to a dui. For that one mistake, I am in a three year probationary period with my license. This is costing me money, time, marriage and anxiety. I was not even given the chance of due process. I am a disabled veteran and find this practice unethical and in violation of the constitution I volunteered to defend.

    I was really up against it with PNAP. They wanted me to enroll for a DUI and disorderly conduct that happened nearly TEN years ago - years before I had even entered nursing school. They convinced me that there was no other option but to provisionally enroll. Seven months and several conversations with attorneys later, I decided to fight those *******. SEVEN MONTHS and the BON had not even signed the contract yet, so I had time before it became official. Listen, if you are having trouble with this, and believe me I know how depressing it can be, do not give up. I fought them and I WON. Call Hark & Hark out of Philly. They really know their stuff and are VERY familiar with how PNAP and the PHMP can be. DO IT FOR YOURSELF AND FOR YOUR FELLOW NURSES. DON'T LET THEM DICTATE TO YOU! They are a destructive organization and so full of **** its unbelievable. It may not be tomorrow, next week, or next year, but one day I will make sure everyone knows about these people and they will fall.

    I joined PNAP in 2010 to 2014; I completed the program after almost 4 years and about $10000. I had no hiccoughs during this program. . After two months of being out of the program, I was accused of diverting from my employer. It has been unsubstantiated. I was drug tested by my employer on site (urine, blood, and breath were all Negative); I was sent to an "independent evaluator" who tested with two urine screens (negative) AND a hair screen (NEGATIVE). After all that, PNAP has decided that I must join the program because I had some drinks while unemployed. This is insane. I completely understand Public safety overrides this arena. Where have I jeopardize public safety. We should NOT use illegal drugs, we should NOT steal from our employers/hospitals/patients. I was in PNAP for drug abuse. Not alcohol - which is legal by the way. If I am having a drink or two or three, not driving, and certainly not working; why am I being asked to "join" PNAP and forsake my career again. This is bull crap. I'm fighting this and will mostly like lose my license. But I will make it known about this abuse of power.

    I joined PNAP in 2010, after I was convinced it was my "only" option. Here I am now with a suspended license and no way out except to adhere to the BURDENSOME and EXPENSIVE requirements of PNAP. There is no such thing as individualized treatment here, and minor infractions lead to automatic suspension of license with no possible end to this punishment. I lost my livelihood, my passion I once had for my career is gone, and I pray daily for an alternative to this arduous program. Thank you everyone who signed this petition!

    PNAP is a money making scam! It is a ridiculous hipocracy that offers help to no one!!! Someone who occasionally smokes pot and rarely has a drink is not an addict. I am and have always been a responsible person. I was fired from my job where I was due to receive a 6% raise due to my "exemplary job performance" yet I am considered an addict by PNAP and forced into their ******** program because I tested positive for marijuana. I am forced into the same program as nurses who were caught stealing drugs and may never recover...with or without PNAP's "help"!!

    I've been a nurse for over 10 yyear. As a minority living in Camden I fought hard to even become a nurse. I've been subjected to this program due to a jealous friend husband name Jonathon and Cindy Wolf that wanted to have a swinger love affair on our wedding moon in the islands. The couple reported me using that she was a former patient in the hospital and reported my marijuana use while on vacation. I was tested and place in the program note almost five years later I'm up against the board again because I had taken some cold medicine to get well that has alcohol in it and again is being threaten license suspension and placement back in the dmu for another 3 years. I had to file bankruptcy recently due to my financial troubles. Here I am in this program for something that happened on vacation not in any threat of harm to any patients. Congress needs to do something. I sit through meeting with addicts abs others that could have really been in harm way. I do have faith in the Lord because he had the final word. But I'm going to fight with his will and prayer to be fine with this and exposed pnap and the bon for treating everybody and every circumstance as the cliche template addict.

    I have been nursing since 1998. My children are grown and I travel nurse with my black lab Molly. I have not had the misfortune yet of having to be disciplined by the board. But my daughter has dealt with this for over 4 years. She graduated from The University of Alabama with honors and volunteered for VDAP which was her biggest mistake. After 4 years in the program she failed a drug test because she had a drink over Christmas and got 5 additional years, two months of rehab and was forced to take the awful antiseizure medication Lamictal. Failure to follow the psyche recommendation meant she immediately would have to give them her license. After 3 months of FMLA she was fired and her daughter went to live with her exhusband. I want Hollywood to make a movie about how unfair this is and expose the truth to the world. I contacted a lawyer but don't know if they can challenge the Board. It seems they have the right to convict without proof, have trial without jury and sentence without remorse. No group in this country has such unparalled power. Please take this power away from a handful who are allowed to rip the lives of thousands of us to threads without an ounce of proof to back it up.

    And lets not forget that the nurse is not even allowed to know what the ACCUSATIONS are in order to form a defense. In fact the board often doesn't even have proof of any of the accusations. Instead they ask the nurse to fill out a form of personal history, medications, etc. Then they use what the nurse wrote on the form as the allegations. Of course the nurse doesn't realize that trumped up allegations will be drawn directly from the paperwork they themselves filled out. I believe this is known as entrapment. In addition, upon signing a consent agreement, the nurse signs away her constitutional right to a defense attorney, and loses the right to challenge "co-mingling". Co-mingling is a grave injustice done to nurses because the prosecutors share both an office AND information with the 'hearing examiners".(administrative judges) Thus if a nurse decides to take it to a hearing, the hearing examiner (judge) is already prejudiced against him/her. This would be grounds for a mistrial in criminal court. In fact, murderers have more rights than nurses do. Criminal offenders get any jail time prior to a trial as "time served". Nurses do not. A nurse might sign initial paperwork in June, and participate and pay for the program from that point on, but the three years doesn't start till the FOLLOWING year because the board didn't sign the consent agreement until 8 months later. Nurses who have legal charges that were dropped, and nurses with old arrests for dui, (even before they became a nurse, or that occur on their own time) are being railroaded into this program. The psychologists and PNAP refuse to provide any part of the psychological report including a proper receipt to use for tax purposes. This is a HIPAA violation. The whole thing is a money making racket as PNAP and PHMP force a nurse to go to an evaluator that *they* choose for the nurse. The evaluator can charge obscenely expensive fees and there is nothing anyone can do about it. How many psychologists make $1000 on a 45 minute interview (with no neuropsyche testing to prove there is an impairment)? Then the evaluator will refer the nurse back to PNAP;s program and PNAP then makes money on every nurse in the program. If there are roughly 2000 nurses in the program (PNAP's statistic) and each pays $300, (NP's pay $600/year) that is $600,000+/year. And lets not forget that each nurse has to bear the cost of ALL treatment, ALL drug tests, ALL the collection fees, and the cost of any evaluations done by psychologists and social workers. Therefore, while PNAP is making $600,000 a year, none of that money is redirected toward helping the nurses. Where is all that money going?? Conflict of interests? What do YOU think??
