Petition to Congress Regarding Enforcement of Section 3 of the 14th Amendment
To the Honorable Members of the United States Congress:
We, the undersigned citizens of the United States, respectfully request your attention and action regarding the enforcement of Section 3 of the 14th Amendment to the U.S. Constitution.
Section 3 of the 14th Amendment states that individuals who have engaged in insurrection or rebellion against the United States, or given aid or comfort to its enemies, are disqualified from holding any office, civil or military, under the United States. Recent events, particularly the January 6, 2021, attack on the U.S. Capitol have raised serious concerns about whether this constitutional provision is being adequately enforced.
Former President Donald Trump's actions and rhetoric leading up to and during the January 6th insurrection have been scrutinized extensively. His repeated claims of a "stolen election" and encouragement for supporters to "fight like hell" on the day of the Capitol attack have been viewed by many as incitement to insurrection.
Trump's public statements and actions in the aftermath of the January 6th attack, including his initial reluctance to call off his supporters and his praise for those involved, raise further concerns about his role in these events.
The Colorado Supreme Court found that Trump engaged in insurrection, a ruling based on evidence presented during various investigations, including the House Select Committee's report on January 6th. This decision highlights the need for Congressional action to enforce the disqualification provisions of the 14th Amendment.
It is crucial that the president-elect, as well as any future officeholders, are held accountable to the standards set by the Constitution. Ensuring that individuals who have engaged in insurrection cannot hold office upholds the integrity of our democratic institutions.
There is a pressing need for Congress to take definitive action to uphold the integrity of our Constitution. Allowing individuals who have engaged in insurrection to hold office undermines the rule of law and the principles upon which our nation was founded.
We, the people, are concerned about whether or not Section 3 of Amendment 14 will be tried again under the ruling of an incumbent president. Given the incitement to use his Supporters to overrun the United States Capitol Building in Washington, D.C., and the readiness to manipulate them, the implications of such actions if the individual becomes president again are deeply troubling. Many of us do not want to find out what further actions could occur under such leadership.
Conduct a thorough investigation into the actions of former President Donald Trump and any other individuals who may have engaged in insurrection against the United States. Not to mention the other constitutional and federal laws that have been broken; here's to name but a few:
18 U.S. Code ยง 371: Conspiracy to commit offense or to defraud United States, which includes planning to commit fraud against the United States.
The Federal Election Campaign Act (FECA): Violations related to campaign financing.
The Help America Vote Act (HAVA): Violations regarding election administration and integrity.
Emoluments Clause Violations: Prohibits federal officeholders from receiving gifts, payments, or other benefits from foreign states without Congressional consent.
Obstruction of Justice: Instances where Trump may have obstructed justice during the investigation into Russian interference in the 2016 election.
Abuse of Power: Allegations of abusing power by pressuring Ukraine to investigate political rival Joe Biden.
Violations of the Take Care Clause: Actions undermining federal regulations and laws, violating the requirement to ensure laws be faithfully executed.
Violations of the Appointments Clause: Appointing acting officials to key positions without Senate confirmation.
Therefore, we implore you to help us find a nonviolent and civil solution to this pressing issue, with Congress taking decisive action as the key to resolving it.
