    Last year I went thru a divorce after a five month marriage, the family court system is not set up to handle these kinds of cases. Although no children were involved the case was horrific. Judges are not phycologist they are not accountants nor are the attorney?s. They are just there to make money, which is fine but there should be a cap. In my divorce I had false domestic allegations filed against me, which was dismissed, my personal laptop taken to the FBI by her attonery. The Florida Bar does nothing but excuse attonery behavior, even though they claim ethics are paramount. Yes I did file a complaint yet the Florida Bar the ones who oversee such injustice and they are mute. Why? In a divorce anything goes to damage one person over the other. It is a sick and vile system that has no mercy if you are a man. Not only did I have to pay her side but defend myself against all other charges just to be force to settle. I divorced a cocaine felon who works as a Florida Park Ranger for the state of Florida, and was treated worse than any felon I have ran into by this so called civil court. With the help of FWC officer's as well on her behalf. The system is sick it is broken it does not mend it only tears at the very fabric of its original intent. It needs to change not 3 years not 5 years from now but today. Where is the will of the people we elect to change law?s which destroy families past any hope of meaningful existence after the final gavel has been struck.

    Representative - I am respectfully requesting that you would raise concerns with SB57 on the House floor at 3rd reading of this bill. We have many concerns with this bill as it seeks to really marginalize the role of non custodial parents after divorce and encourages a heavily contested custody battle during divorce. The fallout from this "divorce rewrite bill" will devastate families and hurt children by not encouraging an ongoing family relationship with both "fit" parents after the divorce. One parent should not be able to control the other through poor and unconstitutional legislation. This bill further sets the table for a "winner take all" system designed to strengthen the custodial parent and erase the noncustodial parent. Future legislation should be written to take into consideration the "best interests of the child" standard when dividing parenting time for two fit parents. It should also seek to reasonably resolve differences to create two healthy households for children to grow up in. The beginning of separation and divorce can set the tone for the children's outcome by taking away this "win at all costs" approach to litigating these matters. Rep. Burke seems to feel the opposite and therefore has taken the approach that the attorneys and paid court players are more important than children and their families. No one wants to see a divorce or separation. We don't want to see it made easier or erase a loving parent from a child. I have included case law as well as some of the specific issues we have with the bill. I will be asking for other House members to offer their 2 minute times to give you time to speak in opposition to the bill. If you are willing to speak on the floor, feel free to use our information on SB57 or ad lib your own. We just ask that you speak out in opposition & ask where the Illinois Fathers Amendments to Rep. Kelly Burke's bill are. Feel free to contact us for clarification on any issues you may have or questions you would like answered. We have extensively worked on this bill to amend it with the intention to improve it, but to no avail. Let me start by asking you a question. If a parent is denied decision making responsibilities, parenting time and then access to school and medical records what meaningful right does a parent have left? In Troxel V Granville the US Supreme Court held that "The custody, care and nurture of the child reside first in the parents, whose primary function and freedom include preparation for obligations the state can neither supply nor hinder." Senate Bill 57 is indeed hindering that freedom in its current state. Furthermore the Due Process Clause of the Fourteenth Amendment requires more than a preponderance of the evidence standard when denying parental rights. In Santosky V Kramer The US Supreme Court also held that ?The fundamental liberty interest of natural parents in the care custody, and management of their child is protected by the Fourteenth Amen

    Due to the Attorney for the Child assigned to my case ? whom my ex brags was recommended by his own attorney -- my ex received full residential custody of our younger daughter 4 years ago, after abusing myself and older daughter for years. Naturally, our younger daughter is now being abused as well, so I recorded 9 phone calls as evidence. If you type this brief URL into your computer, you will hear a 2 minute recording of my ex abusing our younger daughter -- one of nine recordings submitted to the Supreme Court earlier this year: http://tapeacall.com/3a8wrfaawx . Although I tried to have the AFC replaced, that request was denied and I was told it?s virtually impossible to do that. When my older (now 23 year old) daughter Brittany and I had to meet with the AFC, Brittany recorded the meeting on her iPhone, since she didn't trust him -- after he ignored her detailed accounts of abuse during the divorce, and he gave her father custody of her younger sister anyway. (Taping the meeting is completely legal.) When the AFC denied saying many of the things he said at the meeting, I revealed that our older daughter had taped the meeting. The very next day a Decision was emailed to me, dismissing the case without a hearing. The law clerk and AFC seemed to work together to keep the recording away from the judge, sending me a letter stating it came to them after the Decision. But I have the fax and UPS records to show that it was received BEFORE the Decision. It looks as though they rushed to close the case down immediately after receiving the CD, since the Decision contained a number of inaccuracies as well as bizarre errors in logic. I?m happy to share more if interested. My younger daughter needs help. (Note that I find men are given great preference in custody cases in Westchester, NY.)

Abolish Child Representatives/Guardian at Litems as their only purpose is to extort moneys from the parties and contribute to judicial campaigns 7. Abolish State Judicial Cartels - mandatory appointment of a child rep at $400 per hour. If the parents cannot pay, they are jailed for contempt of Court. 99% of child reps do not see the child more than once, but charge hundreds of thousand of dollars during the protracted 9 -some as long as 11 years - divorce procedures, which he Judicial Cartel members deem appropriate.

    Please investigate my case. I have a special need child. I decided to divorce because his father refused to give him prescribed medical treatment. But I lost my custody in judge's small claim court order. Because I insisted to have my son prescribed medical treatment, the judge blocked me from accessing to his medical record and only allowed me to see my son at CASA. CASA facility unlawfully jailed me and the officer hired by CASA faked "warrant" and jailed me under faked name and police department. In such condition, I could not go back to CASA. I have not see my special need son for 7 years. I don't know if he got treated or not. If he is healthy or not. Please investigate my case and help this special need child.

    If laws are written such as the UCCJEA and the PKPA to protect the child, there should be absolutely nothing any other state can do. I am tired of having my child kidnapped from me. I have had full custody of my beautiful daughter for a year and a half. But she's not with me, because Kentucky will not abide by Nevada's jurisdiction. Nevada is the home state. I have not seen or spoken with my daughter for 7 years. This has broken me. All because her dad is selfish. He abuses women he is with, is arrested, charged, has restraining orders against him, but is allowed to raise our daughter. He tells her women are evil. They are twisted. Can you imagine what my daughter's self esteem is like. I want to be a positive role model in my daughter's life. I want to love her, comfort her, help her explore the world and it's beauty, I want to help her through school and break ups. Please help us. Lucille McGowan

    Representative Levin's office forwarded my 10th State Appeal (February 2015) to Commissioner Turetsky's office, for investigation into Macomb County Circuit Court for failure to follow any state, federal, court rules, or statutes. 10 state appeals and one attorney malpractice trial were filed. All errors in the law remain with( 2) two motions under advisement. I want any politician to get this court corruption investigated. christine morrison

    I trusted the law and justice system and chose to go to court to solve the dispute. But I was not treated lawfully and fairly. My judge violated the laws. In order to cover court's mistakes, my judge faked a case number and put me in jail and blocked my cancer treatment. I was ministerially disappeared in US soil. When I was finally released, my cancer already spread out. What family law allowed the judge do it? Using alternative way to kill cancer mom is a crime. If US really have justice, please investigate my case.
