I humbly request the President of the United states and Congress to please consider the painstaking and excruciatingly long wait for EB2 India and other oversubscribed countries. I came to the United States in 2001 as a masters students and went through legal procedures to apply for job and H1B. After staying here for sometime and getting to know the strong values this country had, I decided to apply for green card. I have been waiting for almost 10 years for the green card and I have been here for 17. My son has been in the US for 17 years and is getting ready for college and we still do not have a green card. We are strictly law abiding citizens, paid our taxes, volunteered in the community as well as in disaster zones, provided for charitable causes. My family has been regular at church and have a played a part in church activities for all 17 years. The long wait has taken a toll on us as a family and we are praying to see the light at the end of the tunnel. Hope this voice along with several others will be heard.

Please fast track green cards for merit based immigrants. Just being born in a country shouldnt be a criteria to wait for green card issuance.People form countries esp India have to wait for more than a decade to see a Green Card.

I strongly support the above and please help in getting traction to the green card lines and this can be achieved by reducing temporary work force and get more permanent immigrants as and when needed and clear existing green card backlogs that way the lines doesn’t grow up more and make it a merit based immigration providing better and permanent opputinities to PG or masters and phd’ s. We are currently living in a state of uncertainty to live or leave this country and are half way that we can’t start a brand new life from beginning by leaving this country ..

What was the original rationale behind country caps for employment based immigration ? There is already a diversity visa immigrant program to ensure a degree of diversity in immigrants admitted on a yearly basis (though that has been subject to controversy of late). Employment based immigration (which is NOT the same H1B) requires at least one of the foll: 1) Evidence of major accomplishment/ achievement/ ability 2) Evidence of managerial / executive experience abroad within the same entity that has been doing business in the US 3) Labor Certification establishes that there are insufficient U.S. workers who are able, willing, qualified, and available to fill the position being offered to the alien at the time and place where the alien is to be employed, and that theemployment of the alien, if qualified, will not adversely affect the wages and working conditions of similarly employed U.S. workers This needs to be supplemented with additional documentation to establish the bonafides of the applicant and the petitioner to detect/ prevent fraud. With the current laws and protections in place (if enforced correctly), there is no need to establish a per country cap to bring in skilled workers. This would also ease restrictions on businesses who need to navigate a complex immigration system besides focusing on innovation and/ or productivity in an already competitive market.

If these immigrants are such a gold mine, why aren't they remaining in their own country and benefiting India? The US is the third most populous country in the world. We have workers HERE, if they need training, then train them. The US is overpopulated , which has been devastating to our environment.

Don't blame our country for laws and rights. We follow all the laws and have all the rights. We have no issues with our laws. If you are genuine, there is no nepotism, favoritism or corruption in this country.................................................. Get this straight in your heads. Now lets see who is not following the laws. Here are list of few fraud cases can't list all, as this is endless list. When we created these rules, we didn't consider how people will use the loopholes and take advantage of our system. America is a LAND of LAWS.................................................... http://www.mercurynews.com/2017/07/20/san-jose-businesswoman-pleads-guilty-to-h1-b-visa-fraud/.... http://indianexpress.com/article/india/indian-origin-woman-pleads-guilty-in-h1b-visa-fraud-scheme/.... https://www.americanbazaaronline.com/2017/08/10/indian-american-entrepreneur-rohit-saksena-sentenced-h-1b-visa-fraud/.... https://www.americanbazaaronline.com/2017/08/10/indian-american-entrepreneur-rohit-saksena-sentenced-h-1b-visa-fraud/.............................................. Now lets talk about why American's are losing their jobs and rights of immigrants............................... 1. Indian managers are inefficient, they don't know how to negotiate, have no management skills, have no knowledge of processes or project management, don't know how to deliver the projects within the budget (i.e. 35-40 work hour week). The only way they can manage the projects is ask the people to work till midnight, work over the weekends, ask them to work like slaves. American's knows "they have only one life", they know what they want in life, they refuse to work on these terms, so they are let go, as these Indian managers know there is pool of cheap indentured H1B immigrants available in the market. Slavery of INDIANS BY INDIANS. ...... Why don't you refuse to work more than 40 hours, this is labor law. Are you afraid to loose your jobs, American's are losing their jobs too, but they don't accept slavery. Why don't you create a petition to all the H1B immigrants to send a letter to your employer No working more than 40 hours. Ask for overtime pay. Laws and rights are there you have to know how to respect yourself. If you don't respect yourself, why anyone else will respect you. Employers are taking care of their benefits you take care of your rights. Don't be beggars, if you think you have the skills be the leaders. Only one life, living a life of respect is much better than living a life of uncertainty and slavery .................... ............................................................ 2. Another issue with working cheap and as slaves. Companies budget their spending on money, not on number of headcounts. If they can afford 4-5 Americans on $1M budget. They can afford 15-20 H1bs on same budget. They are ready to work overtime and over the weekends. So company gets more work hours within the same budget. This is causing 4-5 times more number of visas. Which is your problem. Take care of your problems, all the laws and rules are there. This is not an immigrant visa, this is work visa. Even if you get immigration, your work problems will still remain with you. American's don't hire based on skin color, but you do. You surround yourself with people from your country, hometowns or who speak your language. There are no problems in our System, the problem is within you, probably the way you are raised. No one is taking advantage of you, you are asking employers to take advantage of you. Respect yourself, only then others will respect you.

I agree with the petition strongly. Merit based systems do not have limits based on nationality. It is unfair to bright engineers, scientists and scholars from higher population countries like India and China. It is not in the best interest of US - as services industry and high technology product companies are completely reliant on quality and talent of the people they hire - and if the pool is available elsewhere, company heads will have to setup larger research and development wings overseas. Current regulations discourage the migration of hungry, ambitious and smart people from highly populated countries, as regardless of their talent, skills, or achievements they'd have tough time making it in USA.
