Mr. Obama;
My elected representative, Carol Shea-Porter, refuses to represent me or the people of New Hampshire’s first congressional district. As such she chose to ignore the request to introduce a resolution of censure in response to your speech and interactions with Mr. Calderon on17 April 2009 and 19 May 2010. I therefore exercise my liberty as a citizen of the United States of America to chastise you for failing to adequately fulfill your job obligations as President of the United States of America as described in the Constitution of these United States. I am joined in this effort by fellow proud United States citizens whose names and dates of signature appear on the attached petition.
Whereas on 21 January 2009 you took the oath of office including a sworn promise to: “faithfully execute the Office of President of the United States, and will to the best of my ability, preserve, protect and defend the Constitution of the United States”.
Whereas the United States Constitution clearly states in Amendment 2, the RIGHT of the people to keep and bear arms shall NOT be infringed.
Whereas The United States Constitution, Article 1, section 8, grants power to establish a uniform rule of naturalization and Article 1, section 9, prohibits congress from passing an ex post facto law.
Whereas The United States Constitution, Article 1, section 8, grants Congress the power to levy taxes to provide for the common defense and general welfare of the United States
Whereas The United States Constitution, Article 1, section 8, grants Congress the power to repel invasions
Whereas The United States Constitution, Article 4, section 2, guarantees CITIZENS of each State shall be entitled to all privileges and immunities of CITIZENS in the several States
On 17 April 2009 you stated in a speech with Mr. Calderdon, “ I continue to believe that we can respect and honor the Second Amendment right in our Constitution, the rights of sportsmen and hunters and homeowners that want to keep their families safe, to lawfully bear arms, while dealing with assault weapons that as we know here in Mexico are used to fuel violence”
Mr. Obama, the second amendment could not be clearer with the words “shall not be infringed”. There is no power granted to any government in the Constitution to limit the types of arms US citizens choose to keep and bear. As such your statement was an unconstitutional suggestion. Further, as a self described “constitutional law professor” you should be well aware that the Second Amendment to the United States Constitution has nothing to do with sportsmen or hunting. While those are certainly hobbies enjoyed by millions of Americans, the Second Amendment exists for the common defense of the United States from all enemies foreign and domestic. Further, as a personal observation you failed to appoint to the Presidential cabinet a single supporter of the Second Amendment.
On 19 May 2010 you opened your speech with a comment on returning the Mexican President and First Lady’s hospitality with a State Dinner. You failed to mention that at American taxpayer expense you are flying in a personal friend and chef from Chicago specifically for the dinner. Is the White House Chef you and Michelle choose not satisfactory? In challenging economic times this foolish spending calls into question your grasp of the current situation in Our Country, The United States of America.
Immediately after you stated “…nations and people are linked like never before, both the promise and perils of our time are shared. Nowhere is this clearer than among the neighbors, the United States and Mexico”. This is a clear rejection of America as an independent and sovereign nation. The Declaration of Independence, which you made the sick assertion that we need to rewrite (January 2009), States “Governments are instituted among men, deriving their just powers from the consent of the governed” The United States is NOT Mexico. Your power comes not from Mexicans, but from Americans. The United States Constitution applies only in the United States. Similarly the Mexican Constitution has zero power in the United States. As Such We The People of the United States share NO responsibility for the promises or perils of Mexico. They are also a sovereign and independent nation. Their constitution does not guarantee Mexican citizens the right of Life, Liberty and the Pursuit of Happiness. That is a unique set of rights reserved for American Citizens by our founders – the writers of other nations’ Constitutions who did not include such guarantees did so consciously.
You later stated, “When our neighbors are in need, whether in Honduras or Haiti, we respond together.” No Mr. Obama, we responded to Haiti as two separate nations. Mexico was proud of their work in Haiti and flew their national flag at their compound. You expressly forbid the American flag to be flown, an action for which you owe the American people an apology. America spent orders of magnitude more money in Haiti than did our impoverished neighbors to the south. There was no shared response.
Your next remark is an insult to all who have lent their names in support of this letter of censure. You stated, “In pursuit of our shared future, I have a true partner in President Calderon.” Mr. Obama I emphatically demand you recant these words and apologize to us, We The People of the United States of America. As sovereign nations with drastically different forms of government as described in our respective Constitutions, the United States and Mexico share separate futures. We may be friendly neighbors, but we are still independent nations.
You went on to say, “For the sake of our shared prosperity and security, we discussed the need for immigration that is orderly and safe…” “To fix our broken immigration system, I reaffirmed my deep commitment to working with Congress in a bipartisan way to pass comprehensive immigration reform.” Mr. Obama I again call upon you as a “constitutional scholar” and refer you to Article 1, section referenced above for convenience; Congress has the power to establish laws of naturalization. Congress has fulfilled that enumerated power in full. In Article 1, section 9, again referenced above, Congress is prohibited from passing an ex post facto law. Mexicans, and those from other nations, that are currently here illegally are criminals. Suggesting that you ask Congress to retroactively change American laws for the express benefit of Mexican and other foreign citizens is reproachable and unbecoming of a President. To suggest that criminals simply be assigned an arbitrary penalty and tax so they can “earn citizenship” is another disgusting remark you must recant and apologize to We The People for. Citizen criminals who steal from the United States government, and by proxy We The People, are tried in a court of law and if convicted face severe prison sentences. Waiving this criminal act for foreign nationals is beyond comprehension. Again, it is demanded you recant and apologize for such a suggestion which is clearly incompatible with either the United States Constitution or the powers granted to you as President through said Constitution. As is often the case Mr. Obama, we need to enforce the laws we have, not use new legislation as a legal band aid to reward criminals.
Your next remark in regards to the recently passed Arizona immigration law described it as a “misdirected effort”. No Mr. Obama, it is not misdirected. It is unfortunate response by a State with violent criminal activities perpetrated by criminal aliens. It is unfortunate because the duties of protecting against invasions and for providing for the common welfare (not the entitlement program) are granted to Congress in the United States Constitution, Article 1, section 8. Arizona, as a result of the United States federal government’s refusal to acknowledge the will of the American people to repel the invasion of illegal aliens, was forced to take matters into its own hands. It is the Federal government’s ignorance that led to this law. Further the law is unworthy of your comment as neither the Attorney General nor the Secretary of Homeland Security have read the bill.
You continued, “President Calderon and I also reaffirmed our commitment to stand together against the drug cartels that have unleashed horrific violence in so many communities”. Indeed the cartels have unleashed horrific violence, even being so brazen as to take on the Mexican Army in combat. Mr. Obama you did not talk with Mr. Calderon about Mexican helicopters flying without permission in sovereign US airspace (Texas). You did not address that the Cartels could be stopped at the US-Mexican border with appropriate implementation of lethal force. You did not speak to America of defending OUR border, only to Mexico of spending American money to help them with THEIR problem.
Your final remark Mr. Obama, whether intentional or not, is a slap in the face of all who have joined me in this censure. You paraphrased a supposed Mexican proverb, “Tell me who you walk with and I will tell you who you are”. You then made the biggest blunder of all saying the “United States walks with Mexico”, thus implying that Americans are Mexicans. While many, many proud Americans are of Mexican descent, they are in fact Americans. Barack, for this you must apologize to We The People of the United States of America. We are Americans, proud citizens of the most ethnically diverse country on this planet. If Mexico wants what America has, they can rewrite THEIR constitution and change their laws. America bows to no one, even though as our current President you have on numerous occasions. Will you stand up and declare America the best country on Earth?
Next up to the podium was Mr. Calderon, for whom you bear responsibility as the person delegated by the Constitution to receive him, Article 2, section 3. He referred to illegal immigration as “migration”. He went on to indicate that “we (referring to both countries) should increase our exporting capacity.” You did not correct him that we are independent and sovereign nations. When the United States prospers there is no guarantee for Mexican prosperity and the converse is equally true. Barack, the People of the United States want the animated contest of freedom, our freedom, rather than tranquility of servitude or as you call it, shared responsibility.
You stood by idly Mr. President as Mr. Calderon insulted America. His last point was, “In Mexico we are and will continue being respectful of the internal policies of the United States and its legitimate right to establish in accordance to its Constitution whatever laws it approves, but we will retain our firm rejection to criminalize migration so that people that work and provide things to this nation will be treated as criminals. And we oppose firmly the SB 1070 Arizona law given in fair principles that are partial and discriminatory.” Yes, Barack you did, you stood there and let the President of Mexico insult our country. You failed to correct Mr. Calderon that anyone entering the United States illegally is by definition a criminal. You could have even pointed to Mexico’s highly armed and defended southern border. There is little freedom for citizens of other countries to enter Mexico through its southern border. Mr. Calderon’s assertion that Mexico respects our internal policies is unnecessary. If Mexico tries to interfere with our country we could turn them into the next Afghanistan. You did not correct him when he repeatedly referred to entering this country illegally as migration. For this you owe, We The People of the United States another apology.
In conclusion Barack your actions as President of the United States, on 19 May 2010, were reproachable and an insulting to individual American citizens. Further, you suggested congress consider legislation inconsistent with our constitution, which you previously swore to preserve, protect and defend. I remind you that you primary job responsibility is to preserve, protect and defend the Constitution of the United States of America.
“A” is for America, not Amnesty!
