We never see whhere our money goes. My walls rotted from the outside in due to old siding and improper installation and were 4 yrs past due on new siding required by bylaws. Our HOA failed to adequately manage a budget which resulted in each homeowner having to pay over $16k in a special assessment (the HOA president conveniently moved just before this was annonounced). Sadly, the funds were desperately needed for essential items like roof repairs, siding water damaged, etc. HOA's are unaccountable, there are no checks and balances. We have been through the ringer trying to sell our condominium due to the HOA being unresponsive to our attempts to settle back HOA fees to complete a sale and rejected our payment and then send us to collections.We have spent a ridiculous amount of time just trying to get a response from the Property Managment Company the HOA pays to manage the community...not to mention, the surplus of the special assessment was to be returned to the homeowners once repairs were done and SURPRISE! they are not returning a dime! We have certainly learned a valuable lesson and will NEVER purchase any type of property that involves an HOA. In a period of several years, they assessed the $16k special fees and the monthly HOA dues have gone from about $200 to $386 dollars!!! Absurd, especially considering there is not a lot to maintain.The concept likely started out with a much different objective than what the HOA's have become. Boy! You need something...good luck...they willl stall and fight you and delay..but, if you monthly dues are a second late, they will charge you fees and contact you like crazy...Funny that way, huh? It is disgusting and they do have rights to pursue foreclosure and liens on property (in CA) however, they often skip the proper steps violating the civil law. Anyway, be very careful, keep documentation of every call, letter, etc. when dealing with them or their representitive at the property management company (not that you will ever get a call back). OK. Enough ranting! I truly understand the frustation and ridiculous nature of these entities and they should be eliminated or have serious regulations. Good luck to all who are struggling.
Our home was STOLEN by our HOA using the recently enacted Florida Law, while we were tied up in modifications with our bank. After our bank, who was SEIZED by the FDIC finally resurfaced under new ownership, almost two years later, We contacted the HOA TO MAKE PAYMENT for any late fees, now that we had secured a modification. They initially agreed to document the settlement and then..... STALLED and STALLED and STALLED and two weeks later, after repeated attempts to reach the HOA Attorneys TO MAKE PAYMENT, we were served a foreclosure summons. Diligent attempts to reach the HOA attorney and make payment were ALL IGNORED, until we had to hire a Foreclosure Defense attorney, who received the same response from our HOA's attorney. THE REAL INTENTION WAS TO STEAL THE PROPERTY and they all NOW have the RIGHT UNDER FLORIDA LAW to simply ignore you, stall forever and jack the fees owed into the sky with NO LIMIT. Protesting this injustice will simply cause your home to be stolen from you by the HOA as awarded by the courts. The Florida Courts are on the HOA's side in every case we've ever seen.

The new Florida Law allows an HOA to "legally" STEAL YOUR PROPERTY - don't be confused about this by any means. What the HELL gives HOAs the rights to jump ahead of everyone with a stake in a property - the bank(s), the owners, mortgage holders and/or their tenants and take occupancy and title rights from the owners - even on a homesteaded property - REGARDLESS of the amount owed. REALLY! - they can STEAL your Million Dollar Property for a $1,000 or less if you're simply traveling for a few months and forget to make the payment - or worse - if you're tied up in foreclosure, trying to get a modification while the banks and the courts drag on and on - and there's NO WAY for you to get it back after they take possession by Florida Law. They can do WHATEVER they want with your property and you STILL OWE 100% of the debt on the property - They have NO OBLIGATION to pay the bank anything at all. An HOA should file their claims in court like anyone else and have them recorded in court and they'll get their fair share when the property is properly disposed of by the owners, the banks and the courts - This is the ONLY FAIR WAY - NOT The way the current FLORIDA LAW is doing it.

By all rights and in all fairness, the HOA has to stand in line with banks and wait for the most timely resolution of the property status as governed by the laws in the courts. Someone has to get this ILLEGAL LAW overturned and charge any/all HOA board members who "legally" stole properties with criminal theft. They need to taste of the injustice that they have been forcing on others.
I was behind on my HOA by two quarters. The Hoa sent a bill for 1600.00 within a short time after I received another bill with fees and attorney fee totalling $7100.00. The courts allowed the Hoa to sell my house for $7100.00. I am still in disbelief. Is this still America. This should be illegal.

My HOA is 22% single-family homes and 78% townhomes. The HOA provides no services at all to us-- literally zero-- while using the money we pay to improve the townhomes. Now they are requiring that every screen door and window and heatpump be submitted to them before we can replace these (they have 60 days to respond). This is a huge maintenance risk and completely unecessary. They also require an architect or engineer to sign off on every structure-- this will add thousands of dollars of cost for those who wish to install a swing-set, fence or shed. It is not necessary. These associations have no oversight and are against every property right Americans hold dear. The HOAs, not the people who live there, need to be controlled.
HOA's formed years after the first lot is sold and homes have been built on every lot does not meet the requirements of the Planned Community Act in North Carolina. There is no mention of a HOA in the covenants, restrictions or deeds in my subdivision. I now have a newly formed HOA filing a lien against my home even though I told them I would not be a part of their voluntary HOA and refuse to pay their illegal fees due to these homeowners hiring a management company to oversee the voluntary HOA.

We are going through the process of a mortgage modification. Our monthly HOA Assessment of $45.00 was paid every month on time and our balance was zero. Our house insurance, property taxes are current and we had no outstanding home violations either. Our HOA then hit us with a $250.00 legal charge for monitoring FC procedures! A supposed 1 hour of work by the HOA attorney. I served 1 year as the HOA sect'y but quit the board due to in my opinion un-ethical practices. I am certain this was done in malice!!!!!
Nancy you could not have said it better... I think we need laws in place to help the homeowner. Not saying we don't need to pay it but it could be looked at on an individual basis. We are barely making our house note and the house has been for sale almost a year!
HOAs are privatized corporate governments with no interest in homeowners other than how much money they can extort from them.
Gives HOA the upper hand where they don"t even try to communicate to u what you owe. It's hard to know because of all the fee assessed. I paid the wrong amount by about 80.00 and received another 1500 in fines. If there was better communication I would have know the correct amount. They rather make lawyers rich instead of working with homeowners that pay their salary. After paying over 2000 in fines my kids were unable to use the pool because I had to do a payment arrangement. I only owed about 250 in dues with late . The attorneys office said there's nothing you can do but if you don't pay all these fee"s we will evict you.

Remember you can always run for the board and change the rules looks like something I may have to do.
It's hard enough to try and keep your home from going to forclosure because you can't afford the mortgage payment, but them you have to worry about the HOA's on top of that.

$1700 total only 440 are the actual dues. The owe us a park and a ludicrous amount of landscaping. It is crazy to think the can take my home and harass me unchecked by the federal and state government.

Owned 1758.00 in past dues, fines, and fees. Okay, this was on me. Had lost job and unfortunately had to file bankruptcy. PAID this in payments as approved and scheduled. Never missed a payment. By the way only $420.00 was actually dues. Received a bill three months later asking for $328.00 for collection fees, fines, late payments for the time I was making the agreed payments. HOA's are worse than the drug cartels. HOA's are supposedly legal????
I have a problematic neighbor who is successfully using my HOA against me. They've asserted dog-barking fees when I have provided signatures from all neighbors who'd be affected, if indeed my dogs barked excessively, and a recording of the actual dogs who bark, but they chose to ignore every piece of evidence I've submitted and side with this neighbor. They claim they have reports of police going out to my home, I don't doubt the neighbors called the police, but I have never been fined or warned by police dept. or animal control.
HOA's are the new mafia - except worse, since our laws allow them to extort homeowners in any manner they choose, sometimes even after they flee their own homes to try to stop the abusive fines. We were never late with a dues payment, never had a shotty yard, nothing...Yet a few years after we purchased the entrenched Board, headed by a plaintiff attorney chairman (and acting directly against its own CCR's by not taking a community vote) 'unanimously' itself a $100 and $50 a day fine structure, stuffed it into our mailbox....and 5 years later take us to court for an alleged $220,000.00 in fines!

The 'Gee, this is what you signed on for" Judge awarded them $180,000.00 - for the 'crimes' of 1) a brick flower border (IDENTICAL to dozens of others all over the community) and 2) an INVISIBLE therapeutic jacuzzi, tucked into a nook formed by the large home, not visible to anyone except the homeowners thru their dining room window.

Not kidding, Wish I were. Appealing. In fact the jacuzzi had been GONE for over 3 years when she awarded them $100 a day UNTIL PAID for it - thus its still accruing.

Should ANYONE ever be flogged out of a quarter of a million dollars for NON -ISSUES dreamed up by an abusive, greedy and entrenched HOA? Where are our protections, I humbly ask you? Someone pinch me, I must be in the old USSR. I am a physician, thus politically challenged in that I don't have time to follow every single blip of news and legislation...but did we tear up the Constitution and someone forgot to notify me? If so, where do I opt out? What country is taking in 50 year old physicians with kids to feed and not trying to nail them to the wall? Several generations of my family have served in the Armed Forces, and I myself am an Army 'brat'.

Did we not collectively bleed enough to be protected from being terrorized from within our own borders? Because that what it is - government sanctioned terror.

Please, fix this system or abolish it. Its beyond ridiculous and its severely hurting a tremendous number of people. Word is getting out about the rampant abuses - too late for me of course - but it WILL resolve itself by bankrupting thousands of thousands of 'forced communities' when it does. But that will also severely hurt a tremendous number of people.

HOA's are the scurge of the earth. Unfortunately, in order to build a new home in a nice area you are stuck buying into an HOA. I swore that I would never buy a house in an HOA and thought that those who bought into them got what they deserved for not reading the documents. Well, my wife and I moved into our new home and found out that the document that we signed initially didn't contain ALL the information. We found this out 3 days before closing! What were we going to do? Walk away? 6 months into the process and 3 days from moving in? The laws are ridiculous and the HOA groups are hidden from everyone. Try to get a document from them. Try to contact them. Good luck. We are going to deal with them as long as we can but forget civility, these folks are just plain mean and extremely nosey.
If you are thinking of buying a home in the NEW BRITTANY HOA THINK AGAIN. I have been denied detailed financial records which back up their so called financial statement which would aultimately show the misuse of the members money. Records which would also show if ALL members are paying their dues, including the rich developer who wants the homeowners to foot the bill until he sells his undeveloped lots. Drainage issues which are the homeowners responsiblity per the bylaws should not be paid out of the members pockets.. Contracts should NEVER be given to other homeowners in the association. These kinds of activities leave things wide open for chances to pilfer the homeowners money between each other and if in fact that is going on it is criminal I guess the records will show that, but wait they will not show the records. Congress thinks that introdusing legislation to impose 50.00 fines is protecting homeowners from expensive lawsuits to enforce your right to view the records. Would you pay gladly 50.00 to steal thousands? A thief certainly would. What idiot would think they are diligently enacting laws to protect homeowners by imposing a 50.00 fine for the opportunity to steal thousands. I paid all of my HOA fees & HOA is not posting a few of the payments to my acct. HOA is not responding or correcting my acct. even though bank statements were shown. My life savings are in this condo & I am unemployed as well. I have hired an atty & I am trying to head this off at the pass. Hope i dont lose it all.

I have purchased a new home and I am renting my townhouse out to my son who has just come home from Camp Pendleton after serving 4years in the USMC. Our townhomes and the land they sit on are totally owned by the home owner but our insurance and exterier repairs are done by the HOA because it is written into our governing documents. They are not repairing our homes and we fear our master policy is going to lapse may 27 because they will not have the funds to renew it. As far as my home I am not worried. My daughter who works for state farm told me if the master policy lapses I then can change my ho6 policy to a homeowners policy and I will have full coverage. But what about the common area? We have a pool and club house that I own with the other homeowners. What if there is no insurance what is my liability? Has my struggle to meet my financial abligations,protect my good credit all been in vain? Should I have just walked away like many others and saved my self alot off money? Should I just give this mess back to the bank and make them pay my out of control HOA.These are questions that are on the minds of all homeowners.These out of control hoa's are contributing to the massive foreclosures. HOA's, Mello Roos are just excuses to take money from hard working Home Owners. Banks love them because they keep the property value up, states love them for extra source of funding, but THE PEOPLE who are paying hate them. Let us vote to have HOA's, Mello Roos abolished.

I live in a home that has HOA as well as have a property in NC that has a POA. Both completely suck. They set laws that are so absurd and remind me of them attempting to be dictators. It is not like homeowners hang engines from trees. When we bought our PA home 5yrs ago we were told we couldn't keep our brand new boat in our driveway. There is a 2800 acre public lake less than a mile away. Stupid I know. I thought why? This is a dumb law. But we stored it at our place in NC that pushes for boats. Time goes by and I notice my neighbor has his boat for 4-5 days then returns it to his paid storage. So I had a conversation with him and he said you can store it in the driveway no more than 48hrs. I never saw that in the by-laws. The old by-laws said no watercraft. The new do not state that I obtained a copy. Yet magically when my husband questioned it they added that phrase to the by-laws and we were like no no no, I have a date copy. You can't just add whatever you want. Has to be voted on. So really I want the HOA's and POA's banned. They are nothing more than dictators that get more money from us hard working people. My POA in NC the board brings in 4 million a year. The Chairman makes 250k per year. Go figure that one. And the roads are falling apart cuz they didn't do a bid for doing the work and went with first person and paid it all up front and the guy's co. never finished the work and has now since filed bankruptcy so we are stuck. Dumb POA. Our entire NC POA needs to be dissolved.
A board member from my HOA told me not to make the HOA payment until I knew if my home loan modification was determined. He was completly wrong, and now the HOA is threating to take my home. Even though I have not missed a mortgage payment. HOA will not even accept a payment schedule!
hoa's should be done away with period, especialy in communities like mine (asford division myrtle beach sc) where we have no pool, tennis court, club house, etc. i also thought that you needed 51% of the homeowners to be in agreement before a hoa was passed. am i wrong?

something needs to be done with these out-of-control HOAs and their lawyers. My HOA charged me 'finance charges' of $25 when I was late a few months, but never sent me a bill, when I paid what I thought were my dues plus late fee (from the last bill), I was send to collections over the $25. Now their lawyer has lumped on fees, including a $76 fee for responding to my dispute letter, making the outstanding amount due about $450.

Due to a job lay off, we got behind in our HOA dues, now the collection agency is charging us $1500 dollars in frivolous fee's for a 500.00 bill. Lies... they said and are charging us for mulitple liens fee's ... which I checked wtih the County Assesor and nothing has been filed on our property! the long list of execssive fee's are just outragous to pay, what can I do to ask for a fair settlement, can I report them? do we have any rights? I want to pay them, but it is too hard give them $2000.00 for a $500.00 bill!
