The way things are today in this country it is unthinkable that a family that was struggling to make the morgage and had worked out
an agreement with the bank to save their home only to have it taken away by a HOME OWNERS GROUP is unthinkable. The laws that allow HOA's to do this should be removed as they only support Property Managment companies many of which don't honor their maintenance agreements and Real Estate Lawyers that charge trumped up Legal fees to homeowners. In my case I truly owed only $1755 in real fees to the HOA. The Management company and the lawyers fees raised that by 400%.

I was behind on my HOA by two quarters. The Hoa sent a bill for 1600.00 within a short time after I received another bill with fees and attorney fee totalling $7100.00. The courts allowed the Hoa to sell my house for $7100.00. I am still in disbelief. Is this still America. This should be illegal.
They collect money and do nothing,no repair,paint, etc
My HOA is 22% single-family homes and 78% townhomes. The HOA provides no services at all to us-- literally zero-- while using the money we pay to improve the townhomes. Now they are requiring that every screen door and window and heatpump be submitted to them before we can replace these (they have 60 days to respond). This is a huge maintenance risk and completely unecessary. They also require an architect or engineer to sign off on every structure-- this will add thousands of dollars of cost for those who wish to install a swing-set, fence or shed. It is not necessary. These associations have no oversight and are against every property right Americans hold dear. The HOAs, not the people who live there, need to be controlled.
HOA's formed years after the first lot is sold and homes have been built on every lot does not meet the requirements of the Planned Community Act in North Carolina. There is no mention of a HOA in the covenants, restrictions or deeds in my subdivision. I now have a newly formed HOA filing a lien against my home even though I told them I would not be a part of their voluntary HOA and refuse to pay their illegal fees due to these homeowners hiring a management company to oversee the voluntary HOA.
We don't need HOA, you make people suffer more.
We are going through the process of a mortgage modification. Our monthly HOA Assessment of $45.00 was paid every month on time and our balance was zero. Our house insurance, property taxes are current and we had no outstanding home violations either. Our HOA then hit us with a $250.00 legal charge for monitoring FC procedures! A supposed 1 hour of work by the HOA attorney. I served 1 year as the HOA sect'y but quit the board due to in my opinion un-ethical practices. I am certain this was done in malice!!!!!
Nancy you could not have said it better... I think we need laws in place to help the homeowner. Not saying we don't need to pay it but it could be looked at on an individual basis. We are barely making our house note and the house has been for sale almost a year!
HOAs are privatized corporate governments with no interest in homeowners other than how much money they can extort from them.
