Our politicians should not be in bed with white collar criminals by slapping them on the wrist for their crimes. We need hard time, long sententeces, and real justice. There is a double standard in America, and I ask you, do you support white collar criminals by allowing them to subvert the law? Congressman Amodei, The requirement in HR 4002 that federal criminal statutes with no mens rea element must now include a minimum "knowing" state of mind would allow someone who developed a piece of property that sat on methane gas produced by rotting vegetation to sell the houses and walk away, leaving the homeowners to pay for remediation. The reason for a strict liability standard is that no real criminal penalty applies and proving a knowing state of mind is very difficult. The defendant is strictly liable because he was in a better position to know of the hazard than are the home buyers, the defendant reaped a significant reward and the home buyers will be left with the consequences. Strict liability in regulatory cases serves a justifiable societal purpose. And it is a radical departure from stare decisis to essentially eliminate strict liability from our criminal statutes. I wonder who gets made well by the inclusion of this change to our criminal statutes?

I strongly oppose H.R. 4002. Many of us victims are STILL paying the price every single day for the greed on Wall Street by PEOPLE who chose to ignore the laws while stealing our homes so they could gain even further wealth. Enough is enough! We victims are still wanting a stronger Justice Dept who will prosecute for these crimes against the American people. Justice for ALL. This bill would go even further in the opposite direction & I, as a citizen, strongly oppose it.
