I am a father serving in the military. Without the service of paperwork (during military service, even though I am supposed to be protected under the the SCRA)a default judgement was issued in my absence for 55% of my pay for two children. I make 48000 dollars per year. I was responsible for two mortgages and all of the marital debt. Meanwhile my wife sat in the marital home without paying the mortgage with the nearly 2400 dollars per month she was receiving in "support" and the mortgage for the home defaulted. Where are the boundries? I have fought in two wars for this country and just like that my own givernment steals my money to give to an able bodied college educated woman? I dont even have a degree! You are supposed to represent the interest of the people and the fact of the matter is you're ignoring the men in this country to avoid looking anti feminist. I understand that these precedents were established because of unfairness to women. There are also laws still on the books about African Americans not being allowed in the city after dark. These laws are no longer enforced because their need no longer exists. This is also true of these dated child support laws. You legislators have allowed archaic anti male laws to continue pushing fathers away from their children....it's no wonder that so many men give up on trying to maintain and afford a relationship with their children. Stop enabling these DEADBEAT MOTHERS. Do something before this problem blows up in Americas face. Whatever happened to equality?

The monies that the state awards, enforces and collects is directly proportional to how much it receives from the federal government as incentive reimbursement funding.

If any debt collection agency did this for any other debt, they be facing massive fines and criminal charges. They would be put out of business immediately.

My exwife receives 2000 dollars a month in support (maintenance in disguise) and 500 dollars a month in day car expenses. The judge did not and would not impute her income even though her prior job was over 100K per year. I have two kids from a previous marriage that I support FULL time for the last 15 years. The judge did not consider them AT ALL and slammed me with an obscene amount of support. After 4 years she is going back to work. Rumor has it even though she will be making close to 70K a year, my support will not be modified at all thus creating a huge windfall for her. Change these laws and quit bankrupting dads.

In illinois, the divorce court says they are only concerned for the well being of children. Yet they conclude that all marriage in this state are no fault and call it a no fault state. Morality has place In the system here and unless the mother gives up her parental rights, the father has little chance of getting custody of his. He has no say what so ever in where his kids live or the environment the mother places them in or who lives with them. It is assumed that the mother is morally sound and better for the children than the father. She is presumed the better parent. The courts in illinois will not burden her with having to keep track of where she spends the child support.
Not for sympathy but for why these laws are crap. My ex-wife married her parimore less than a month after our divorce was final. They already had a child together during our marriage that my insurance paid for. Her husband has a net worth in excess of $2 million. She started a trucking business of all things but claimed she has job and no income and her husband is unemployed when she brought me back to court for higher child support. I have two kids with her. The collapse of the economy caused my 22 months of unemployment and the loss of mine and my children's home. I took a job unrelated to what I did for the 23 years before my lay off in '09 and it pays $43000 a year anD is 65 miles away. Also it pays $16/hour less than my carreer plus I pay for medical insurance out of pocket now My ex got the maximum child support,(250/week) plus back support for the 6 months her lawyer dragged out the case. I now take home an average of $400 a week to cover everything. That same month she was awarded higher support she goes out and buys a toyota sequoa that has a starting price if &44000. I can't make my bills let alone feed my kids when theyre with me. I drive subcompact that has almost 200000 miles on it. What happened to my quality of life or the quality of mu childrens lives when theyre with me. My kids are living better then I could have ever afforded and I'm living like I'm just starting out at 18 with nothing. I'm 50. She will get an addition $80000 from me in child support over the next six years in addition to the $100000 she already got. It didn't cost over a thousand dollars every month to raise our kids when we were married. Plus she didn't work then either. Do you see the point I'm trying to make. In most divorce cases, the father becomes a cash cow. Paying child support plus half of unpaid medical bills and extra carricular activities as is my case. I feel like a rape victim. Child support should be paid by men only if within the first 3 months the biological parents notarize the financial responsibility of the future child. If the man does not want the child, yet woman wants it, she should be held responsible. (The argument that man should think before sex is invalid. The premise is different than outcome).

I am a woman who has been unfairly paying child support. Agency people say it is wrong and complicated but cannot do anything due to an ORDER. I so understand the rights of the children but when they are used to do financial harm to further the pain of a broken home, where does it stop??
I pay more for my son in a previous relationship than I do for the 2 boys that live with me. My ex just got a new car and has no ambition to better her own existance for fear that it will reduce the child support I give. Child support should be for the child, not the mother. We need more checks and balances. I should be able to calculate exactly where MY money is going.
I pay CS in the state of Oklahoma for 750 Dollars and my ex-wife moved to Alabama during this time when they garnish my pay for 1100 dollars for my 2 kids that dont live in the state. They also took my federal taxes for 1600 dollars and the state of oklahoma took my state taxes for 350 dollars. I found out that I own back pay for 11,000 when I got divorce last year. I been garnish for a year and paying this women close to 1800 dollars a month. The child support office in Oklahoma been trying to contact the state of Alabama to stop this garnishment with no results. My oldest son been living with me for a year and attend Cache High School in Oklahoma. I hired a Lawyer THAT COST ME ($3,000)trying to fix this situation with CS. I cant understand why CS can destroy my life with no accountibility of their action. There are no checks and balances on the DHSand as such they abuse their power and when you contact the governors office or the house of reps or the main office of dhs all u get is a computerized auto responce so how do they deal with us...black mail extortion threats of jail time...so We need to all band together and fight the system and make them realize our childern are not atms for the state..if a judge can make me find a job why cant he make a mother get out and work..especially if they get state benefits and refuse to work?

My husband has been put in jail 3 times this year for child support. the second time he had a job and $500 the judge turned down the money and sent him to jail. Now he was in college, actively looking for work and sending whatever he could to child support after being denied a decrease in how much he owned when he had no income, and they still put him in jail claiming he "Willfully neglected" to pay his child support. this has to stop!

Guess what? It happens to moms too, My husband accused me of domestic abuse and of cruelty over three years ago. Got a restraining order against me and managed with the help of the courts to quit his job and move to another town and keep me from contacting my son in any way. He also kept him away from his older two siblings. We have had no contact at all. Then the judge refused to hear about of us not being able to see or to talk to him in 3 years and 4 months. Now I am slapped with having to pay 14% of my wages to a man that refuses to work and yet I am required to. I am also required to pay 3 years of I dont know how much to a court appointed ad litem that I didn't want to start with and who wouldnt set up visits or even talk to me or take my calls for the last 3 years. Is this fair. The laws need to be changed. Children are being taken and turned against one parent because the other doesnt want to be saddled with child support themselves. The court doesn't even care that the noncustodial parent sees there children. As long as they turn over most of there money to and undeserving excuse for a human. Lets start making both parents put a certain amount in trust and allowed to be drawn out for the needs directly related to the children and nothing else. None of the things I was accused of even happened.
My son's mother decided she would take him from me because I didn't want to marry her and be s family with her kids. I didn't see him for 3 years and counting and now that I'm married and my wife and I have a new son together, she's come back on the scene and the state wants me to give her $550 a month. When I asked the agent " what about my new son?" she stated, that's not our concern and you should have thought about that. Like everyone signing this petition, I also pay child extortion (support). That's really what it has become nowadays isn't it, legalized extortion. One of the main issues with cs laws is government involvement with our personal lives. everyone who is involved has their hand in the cookie jar, so to speak. CS is a VERY big business in all 50 states. It's the reason why cs agencies try to collect as much money as they can from the NCP'S. In return The fed's will match what the states can collect. The states get rich off of this crap. With Texas and it's AG GREGG ABBOTT leading the way. As most of you are already well aware these scum bags could care less about our children. When I came to an agreement with my ex wife to handle child support outside of court, she agreed. Then went behinde my back and went to court, she lied and got half of my paycheck, and took some custody away from me. When my lawyer contacted the child support lawyer he said " Tell you're client he shouldn't have trusted someone that is out to get him". Keep in mind my ex has not worked in 4 years and gets paid as much as I do(from me) without working. I will lose my house and cars because she won't work, when will they start to look at things on a case by case basis?
I have recently been ordered to pay $800 in support for my 2 yr. old son that is almost half of my monthly income I have another son who's mother did not put me on support but we split expenses without court orders since she didn't enforce support through the court they act as if my oldest son doesn't exist. I watch so many families suffer from child support issues and DHS problems. I have so many issues with child support laws and DHS ISSUES AFFECTING OUR COMMUNITIES. Every single kid needs both parents and child support and DHS is designed to separate the family. The same kids are criminals of tomorrow because the system is raising them that way. I don’t see too many people married anymore because men are getting smart, why get married and let the court take your life away in the signing of an order by some old dude that had a bad day. I owe almost a million dollars in child support and alimony year to date. This is a form of castration of hopes and dreams for me and my children's future. Luckily, I instilled sound knowledge in them so they can make sound decisions for their own lives. I love my three children and they love me.
I was not in the courtroom when this enormous amount (2200.00 child support, 2200.00 alimony) was set in 1999. I have tried to have it modified and it was rejected every time. I have been put in jail and my license was suspended indefinitely. It is like in slavery the master would cut the slave's feet off and the master expected the same amount of production of work out of the slave.

I am a new parent and my daughter's mother put me on child support when she was only 3 months old. The thing that discusses me about the whole situation is that she lied to the courts saying that I wasn't financially supporting my child. It was easily believed by the courts. I am now paying $950.00 a month for ONE CHILD!!! The mother is working and living home with her mother. She is not even held accountable for what she spends the money on. As for me, I am responsible for the expenses at my house and including child support payments. At the end of one week, I am already broke and have to figure out how I'm going to make it to the next pay period. Technically I'm pushed into virtual poverty. Recently I've received a promotion on my job and I was put under pressure to report the promotion to my attorneys because I feared that the mother would find out anyway and could take me back to court and claim additional money. The question is, HOW AM I SUPPOSED TO LIVE!!?? When it comes to child support in this country, common since just goes out the window!! Maybe 30 years ago, mothers were claiming child support for altruistic and noble reasons pertaining to the child's interest. Now we are in a new era, there are a generation of young mothers who seek child support for their personal interests and use the child to support their own personal agenda and they (mothers) are never questioned. As a side note, I disagree with those who want custodial parents to keep track of all expenses that child support pays for. Everyone should keep in mind that the child benefits from all the money spent-housing, heat, electricity, clothing, food, etc. I think you would be hard pressed to prove beyond doubt that child support money is being spent on manicures or alcohol as some have alleged. There may be cases where this does occur, but those are exceptions to the rule. Custodial parents already have a lot to manage-keeping track of daily expenses and accounting for basic necessities to prove how child support funds are allocated should not be one of them. Perhaps a better way to manage it would be to monitor bill payment for rent/mortgage, water, electricity, and applications for public aid for the custodial parents receiving child support. If you are not a custodial parent it is easy to see that this should be an easy report to fill out. As an active custodial parent, I can tell you for certain that it is easier said than done.

My children's mother is filing a child support claim on me now. Right now she is getting her nails done instead of looking for a job. I work I make $360.00 weekly after taxes. She plans on taking my kids to live a man in PA but not before getting an ok from the Judge and a nice piece of my check in which I'm sure the Judge and the law will allow. Thanks a lot Uncle Same.
In Florida, I am 73% financially responsible for my daughter even though she resides with me 40% of the time. I make a decent salary yet am forced to pay $1000 a month in child support becuase of the backwards calculation of the law. I am being punished for educating myself and making more money than my daughters mother. I will continue to make more money and she will continue to take more. UNFAIR! I completely provide a stable home environment for my daughter while she is with me...why should I be required to provide another one when she is not with me????
Children need their fathers just as much as their mother. Just because they birthed the baby does not automatically make them a good parent. The whole system needs to be analyzed top to bottom. You never hear this come up in politics at all. I wonder why?

Child Support Laws should be revamped to make sure the monies are used for the child...after all it is called "child support" I agree that the laws are unjust. The amount of support that most pay is just absurd. Most people paying support can't even afford to live because support amount is so high. I know a lot who are paying support are also collecting food benefits from the government because they can't afford to buy food. Most have to live with family member's or friends because support is so high that they cannot afford to rent a place of their own. I feel that BOTH parents should have financial responsibility for the child!

But in the state of Virginia (which has some of the most racist and negative laws in the country, because of its Commonwealth status and being one of the 1st slave states to have slavery), men in general(especially Black men)are treated as slaves in respect to their children. Virginia has a Willie Lynch mentality that make him a slave to child support simply for the money factor. They incarcerate you when you pay your child support and when you don't. A lost of job and none payment will get you locked up. So how is that helping the child in the long run. I have been locked up behind child support, which forced my employer to fire me. Of course the court didn't give a damn, because it was about the law. They had no reasons to lock me up for child support, because the child support was being paid.
Now here I am 2 months away from becoming a 60 year old African male still paying child support to a state and the fact that all of my children are grown adults and will be starting their own families one day. Virginia as well as other states and rich white America has just found another way to divide and conquer the Black race.
Take the male element out of the child's life and the woman and children become even more of the slaves to a White Willie Lynch society.

Let’s take a guy who has lost everything and led a tough life dealing with depression. He gets a job and pays his child support weekly. Then he opens a bank account to make weekly deposits in and offers the account to the Child Support Recovery, and they say they can't deduct from his checking account.
Let's take this guy to court, charge him by the state with no court appointed attorney, put him in jail, give him a record which makes it tougher for him to get a job. Let's make sure that he stays a dead beat by charging unfair interest and penalties.
Let’s give him a social option to join crime by telling him "We don't care where you get the money, just pay it now."
So let's put him in jail, use other tax money to support him rather than him support himself while paying the best he can.
I am not an attorney or judge, nor am I a Wal-Mart building politician. But I assure you I have more common sense than destroying people who have a tough time in life.

The formula for child support needs to be removed. How can the mother make substantialy more then the dad, be re married and get that income as well and yet the father has to pay so much in child support that he cannot afford basic living needs as well as support the child that dose live with him.
There are people who care about and support their children who are treated less than criminals because of a separation with their drug addicted significant other. One quarter of my pay goes to taxes, one quarter goes to child support. How many of you can live off of half of your paycheck? But I'm sure the mother of my children will have a terrific blowout with the money!
I am single dad going through this now. My ex doesnt even pay taxes because she gets paid under the table and only works a few hours a week. She makes more money then me yet Im looseing my house and behind on everything trying to pay her. My child support money doesnt even go to my child it goes to dates for my ex and her wanted felony boyfriend to live off of cause he hardly works either. I still have to buy clothes and etc when my child is with me and thats not that often because my ex wont allow it. The system is SERIOUSLY screwd up and something needs to be done about it!!!!!
And I also think it's unfair that the custodial parent is not obligated to report child support payments as an income and the non-custodial parent is not allowed to claim child support payments on their income tax. The child support obligated payments of the non-custodial parent is not calculated fairly, for example the expenses for a child on a month to month basis is not always the same. Clothing should not be calculated on a month to month basis. No parent purchase clothing on a month to month basis for a child. The non-custodial parent is treated as if they committed a crime when a divorce takes place. It just so happens a single parent has to be the custodial parent, not that the other is a low life or incapable. It may just be a mutual agreement between both parents as to who will be the custodial parent to prevent separation of the children and avoid subjecting the children t a long and emotional court battle. You have hard working parents working to make sure they make their payments every month, but the courts never really account for the day to day living of the custodial parent. They also have to be able to pay their bills and meet their day to day obligations. My point is that the law need to be more sensitive to both parts and that they should not treat the non-custodial parent as being a low life and deprive them of their happiness, while the other parent is living with an extra income which they do not have to claim. Very unfair.

Half the time people are not taken before a judge to see if there will hardship on the parent that has to pay the support,but it is decided by someone in the Dept of human resources and they per-judge the non custodial parent and treat they like they are scum and a monster. I feel that people need to be treated fair and with equal amounts of right.It takes two to make a child so it takes both parent to support not on sitting on its but while the other struggles to support there family. And told that one child is far more important then any other. Parents that get child support should have a job and the child support units need to take in the economic situation of the non custodial parent and have the financial records of the custodial parent and if they are not work but living off someone or the state they need to be required to work job training and have a job and the department of children service be involved to make sure the child is not endangered and has proper care.

I am a father serving in the military. Without the service of paperwork (during military service, even though I am supposed to be protected under the the SCRA)a default judgement was issued in my absence for 55% of my pay for two children. I make 48000 dollars per year. I was responsible for two mortgages and all of the marital debt. Meanwhile my wife sat in the marital home without paying the mortgage with the nearly 2400 dollars per month she was receiving in "support" and the mortgage for the home defaulted. Where are the boundries? I have fought in two wars for this country and just like that my own givernment steals my money to give to an able bodied college educated woman? I dont even have a degree! You are supposed to represent the interest of the people and the fact of the matter is you're ignoring the men in this country to avoid looking anti feminist. I understand that these precedents were established because of unfairness to women. There are also laws still on the books about African Americans not being allowed in the city after dark. These laws are no longer enforced because their need no longer exists. This is also true of these dated child support laws. The state uses this funding to bolster their state employee and judicial pension plans--resulting in a massive conflict of interest and what some might characterize as nothing short of a criminal conspiracy. Berryhill that judges cannot sit on cases where they have a pecuniary interest in them because it would be a demonstration of actual bias.
Yet, judges, or state employed judicial hearing officers in the domestic relations courts sit on these cases every day. This has created a tyranny by having the state criminalize a civil matter. As stated in the article, it says that the district attorneys are getting into the act in prosecuting people for child support arrearages. This again results in a blatant due process and equal protection violation. When were the payor parents told, at the inception of the child support matter, that the matter would be converted from a civil case into a criminal case? When were they read their Miranda rights, such as right to remain silent about their financial situation, or given their right to trial by jury or right to appointed, competent effective counsel to defend them properly.
As can be seen by this lack of substantive due process--the entire child support enforcement mechanism is a fraud and a scam that smacks of racketeering. If any debt collection agency did this for any other debt, they be facing massive fines and criminal charges. They would be put out of business immediately.
New York State claims it is going after so-called “deadbeats” by criminalizing child support delinquencies and jailing those with large arrearages. Sounds good. However, if one were to investigate the situation they would find that most of the state’s largest delinquent child support obligors are unemployed, underemployed, undereducated, disabled, minorities, or deceased. That’s right–deceased! The state needs to keep those numbers on its books in order to maximize the federal funding it receives.

I was not in the courtroom when this enormous amount (2200.00 child support, 2200.00 alimony) was set in 1999. I have tried to have it modified and it was rejected every time. I have been put in jail and my license was suspended indefinitely. It is like in slavery the master would cut the slave's feet off and the master expected the same amount of production of work out of the slave.
I have been homeless and I have lost everything that I once owned.
I have contributed to humanity in many ways all my life. I love the United States and it's laws, but this has gone to far. The term "deadbeat father" has deemed me as a criminal in worldview. My x-wife is bitter and angry even up to this day, the court system in Alabama has backed her all the way. I tried to inform her that this will ultimately destroy our family's well being in one sense or another.
There is a "Chinese Proverb" If you seek revenge you better dig two holes. It doesn't help me by being Black or African-American, trust me. No one wants to hire me because of this label that I wear (Deadbeat Father) and this debt that looms over me.
People judging other people is a recipe to disaster.

Everyone should keep in mind that the child benefits from all the money spent-housing, heat, electricity, clothing, food, etc. I think you would be hard pressed to prove beyond doubt that child support money is being spent on manicures or alcohol as some have alleged. There may be cases where this does occur, but those are exceptions to the rule. Custodial parents already have a lot to manage-keeping track of daily expenses and accounting for basic necessities to prove how child support funds are allocated should not be one of them. Perhaps a better way to manage it would be to monitor bill payment for rent/mortgage, water, electricity, and applications for public aid for the custodial parents receiving child support. If you are not a custodial parent it is easy to see that this should be an easy report to fill out. As an active custodial parent, I can tell you for certain that it is easier said than done.
