USCIS DACA Expansion will unfairly Punish Lawful US Citizen Families awaiting Work Cards & Green Cards

The President's February 18th DACA Expansion initiative will UNFAIRLY PUNISH THOSE APPLYING FOR LAWFUL IMMIGRATION BENEFITS who are pushed back in queue as DACA takes priority.

DACA Q&A #6 on the USCIS website clearly demonstrates the USCIS knowledge that the DACA Expansion will produce significant delays for Adjustment Interviews (AOS) and Immigration Petitions both for US Citizens' foreign spouses and for Investors whose funds will create new American jobs.

DACA Expansion will DOMINATE USCIS RESOURCES delaying Work Authorization Cards, Interviews, and Green Cards for persons who Lawfully Entered the United States and are seeking Lawful immigration benefits pursuant to the INA.

US Citizens with foreign spouses, both military and civilian, Adjusting their Spouses status and EB-5 Investors alike will experience:

1. Extensive Interview Delays - making Green Cards take Longer
2. More Delays in Getting Work Authorization cards
3. More Delays in Getting Advance Parole in case of family emergencies.
4. More emotional duress and stress in waiting.
5. Loss of Income due to EAD Processing Delays due to DACA Expansion.

For concurrent I-130/I-485 filers, Social Security Numbers and Drivers Licenses require the Work Card (EAD) or Green Card (LPR) to be approved in most states. In many cases Life Insurance, Private Health Insurance, Auto Insurance, and Bank Accounts are denied due to lack of a Social Security Number and/or EAD.

US Citizens who have spent thousands of dollars, 100's of hours of research, and best efforts to comply with US Immigration Law are being PUNISHED WITH LONGER DISENFRANCHISEMENT OF THEIR FOREIGN SPOUSES WAITING FOR ADJUSTMENT while those who illegally snuck through our borders are about to dominate USCIS processing resources yet again.

DACA Expansion, an Executive Discretion benefit based on executive branch prerogative and selective interpretation of the INA is set to cause harm to US Citizens with foreign spouses whose immigration benefits are clearly prescribed in the INA, and who complied with our nations immigration laws. Those who break the immigration law are being rewarded with priority and those who follow the immigration law are being punished.

Execution discretion to stretch the INA is being given priority above Congressionally Exacted benefits that have a clear legal basis in the INA; Adjustment of Status to Lawful Permanent Residence (Green Card) for the Foreign Spouse of a US Citizen.

If DACA Expansion is to occur, it must occur only with appropriate pre-planning and allocation of resources. Namely:

1. Appropriate funding for new office space, new staff, new call centers, new software processing platforms, etc.
2. Time must be given for the USCIS to lease/build new office space. Recruit new staff for DACA programs. Train the staff. Install new systems to handle the volume.
